HomeMy WebLinkAbout20130094RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 7, 2013 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, January 7, 2013, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner William F. Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer - EXCUSED Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Susan Brown / Esther Gesick Director of Finance and Administration, Monica Mika la MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of January 2, 2013, as printed. Commissioner Rademacher seconded the motion, and it carried unanimously. El CERTIFICATION OF HEARINGS: Commissioner Rademacher moved to approve the Certification of Hearings conducted on January 2, 2013, as follows: 1) USR12-0058 — Timothy Thompson, c/o A&W Water Service, Inc., 2) USR12-0064 — David and Kayleen Hunt, c/o A&W Water Service, Inc., 3) USR12-0065 — Bruce Sandau, Robert Sandau, and Bartels Family, LLC, c/o A&W Water Service, Inc., and 4) PUDF12-0003 — Mountain View Fire Protection District. Commissioner Freeman seconded the motion, which carried unanimously. Fl AMENDMENTS TO AGENDA: There were no amendments to the agenda. ID PUBLIC INPUT: No public input was given. El CONSENT AGENDA: Commissioner Conway moved to approve the Consent Agenda as printed. Commissioner Rademacher seconded the motion, and it carried unanimously. Fl NEW BUSINESS: 1) CONSIDER APPOINTMENT AND REAPPOINTMENTS TO THE FAMILIES, YOUTH, AND CHILDREN COMMISSION: Commissioner Conway moved to approve the Resolution. Commissioner Rademacher seconded the motion, which carried unanimously. Minutes, January 7, 2013 2013-0094 Page 1 BC0016 L PLANNING: 1) CONSIDER INITIAL HEARING CONCERNING RESCINDING USE BY SPECIAL REVIEW PERMIT #1709 - SUNCOR ENERGY (USA) PIPELINE COMPANY (CON'T FROM 10/15/2012): Chris Gathman, Department of Planning Services, reviewed the case summary and progress made since the last meeting. He addressed questions from the Board regarding the number of continuances. Jim Borgel, Attorney with Holland and Hart, confirmed concurrence with the negotiated terms of the Improvements Agreement and the intention of completing the Recorded Exemption and Subdivision Exemption plats later in the week. Jaycee Rock, Suncor Attorney, thanked staff for working with them on this project. Commissioner Rademacher moved to refer the matter back to Planning Services staff for completion of the process. The motion was seconded by Commissioner Freeman, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
