RE: GRANT OF CHANGE OF ZONE FROM A (AGRICULTURAL DISTRICT) TO
E (ESTATE DISTRICT) FOR KENNETH BATEMAN (KEN-WIL ACRES) .
WHEREAS, a public hearing was held on July 28, 1976
in the Chambers of the Board of County Commissioners, Weld

County, Colorado, for the purpose of hearing the petition of
Kenneth Bateman (Ken-Wil Acres) , 6425 28th Street, Greeley,
Colorado, requesting a change of Zone from A (Agricultural
District) to E (Estate District) for a tract of land located
r- in the Southeast Quarter (SE4)- of Section 16, Township 5 North,
Range 66 West of the 6th P.M. , Weld County, Colorado, being
more particularly described as follows and with all subdivisions
referenced herein being those platted and recorded in the records
of Weld County, Colorado.
Commencing at the South Quarter Corner (S'&Cor) of said Section 16, and
considering the South line of the Southeast Quarter (SE') to bear North
90°00'00" East with all bearings contained herein being relative thereto;

WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of the
petitioner for a change of Zone upon the aforementioned tract
of land, and
WHEREAS, Sections 8 . 2 and 8. 3 of the Weld County Zoning
Resolution authorize the Board of County Commissioners to grant
a change of Zone upon a showing by the petitioner of certain
facts , and
WHEREAS, the Board of County Commissioners heard all
the testimony and statements of those present, has studied
the request of the petitioner, and the recommendations of the
Weld County Planning Commission, and having been fully informed
and satisfied that the requested rezoning complies with the
Weld County Comprehensive Plan and the conditions set out in
Sections 8 . 2 and 8 . 3 of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners, Weld County, Colorado, that the petition of
Kenneth Bateman (Ken-Wil Acres) for a change of Zone from A
(Agricultural District) to E (Estate District) on the above
described tract of land, be, and hereby is, granted.
The above and foregoing resolution was, on motion duly
made and seconded, adopted by the following vote this 9th
day of August, A.D. , 1976 .

Aeld County Commissioners :
My wife and I were extremely disappointed to receive the
news that we had additional problems and expenditures
involved in getting the .Ken-Wil Acres subdivision approved.
This project has been in process for us since 1970 , as
a result of our horse facilities being cut in two by 65th
Avenue. We allowed our corrals , farm, trees , etc. , to be
divided in half, causing a great deal of expense, death to
livestock, and other incurred misgivings to our horse operation.
We were told at the time of the West Ridge development that
we would have access to 65th Avenue. At the present time,
11 driveways across to 65th Avenue have been allowed on the
west side. I feel that we have been greatly discriminated
against in not having an approval of just two outlets for the
new ten-Wil Acres. We have approved and paid for 64th Avenue
mostly from our own money. W,≥ have worked several years
to meet all of the county approved qualifications for this
project, and have drained our financial resources to the limit.
Escro money has been received by our realtor agent due to
the belief that everything was to be approved up until the
very last meeting. Mrs. Bateman and I feel that we are
entitled to your reconsideration of approval for the Ken-'Ail
Acres subdivision.

duly published June 25, 1976 and July 16, 1976, in the Greeley Booster,
a public hearing was held on the request Tor a Change of Zone A to E,
subdivision Plat (Ken-Wil Acres) and Dedication and Vacation of 64th Avenue,
ty Kenneth Bateman, at the time and place so specified in said notice.
-All five commissioners were present and heard the testimony presented.
Commissioner Jacobucci made a motion to approve the Change of Zone and
Preliminary Plat with conditions. It was seconded by Commissioner Moser
and carried unanimously. Commissioner Jacobucci then made a motion to
allow the vacation on both sides of the road. Commissioner Carlson seconded

Dear Gary:
The City -Planning -Commission at their June 8 meeting reviewed the following
three referrals from your office :
The -first referral is the rezoning and subdivision plat of Ken-Wil
Acres. The Planning Commission approved a motion -that the
recommendations made at their May 27, 1975, meeting are still in
effect. I am attaching -a copy of the letter which I forwarded
to you at the time the Planning Commission reviewed it.
The second item was the rezoning request from Mr. Coakley Cowherd.
The Planning Commission recommends the rezoning request be
approved; in addition that, since more of the property located
north of the iparticular request is also zoned estate, a con-
sideration be made toward rezoning that area to agricultural
as well . It would appear that some incompatible land uses would
exist if portions of the property remain residential and the
balance be agricultural .
The third referral was a subdivision exemption for Mr. John Rayburn.
The Planning Commission has tabled this request at this time since
Mr. Rayburn indicated an amendment to his exemption -application
would be -forthcoming. This amendment would be required by the

Dear Gary :
The City Planning Commission at their May 27 regular meeting
reviewed the referral from your office known as the Ken-Wil
Acres Subdivision . The Planning Commission has no objections
to the plat except for the following stipulation . It is
felt that since 05th Avenue is in fact an arterial street ,
that the accesses to lots 1 through 6 should be controlled as
much as possible . A suggestion is that common driveways be
allowed in order to minimize the number of accoss points .
In addition , the State Highway Department has expressed
concern regarding 28th Street being used as a frontage
road in the area. I have indicated to Al Chotvacs that this
was only a referral to the City and that he should get in
contact wi th your officc . If he has not done so to this point ,
I would suggest that he he contacted in order to clarify any
of the problems that might arise in the area .

Mr. Neal commented that the proposal in its present state had been reviewed
by the City of Greeley staff and Planning Commission in May, 1975. The
case was coming for review before the Weld County Planning Commission in
the near future , and Weld County has asked that we update our comments on
the proposed subdivision and change of zone. In the 1975 review, the
Planning Commission voiced no objertions to the plat except for the stipulation
that 65th Avenue is to be an arterial street and the accesses from the lots
to be platted in this area should he controlled as much as possible. The
Planning Commission at that time suggested that common driveways be allowed
in order to minimize the :iufnber of access points. Such a recommendation hap
been accepted by the County and was being required of the developer in this
case. This acreage itself (approximately 12. 2 acres) was inclu-ded in a
preliminary plat approved by Weld County on June 8, 1964. It was known -as
the Briggs West Ridge Subdivision.
Administrative Review Team members voiced no -additional concerns regarding
the review of this plat.

Dear 'ir. Holm:
The installation of a fire hydrant between lots 9 and 10
in the Ken-Wil Acres Subdivision on a 4' water main would
be acceptable to us.
The 4" water main is connected to a 10" line on the south
and a 6" line to the north. This is not the best situation,
but I Feel with the larger main feeding this -4" line that
exists, it would he adequate for this particular si.tuati.on.

Two (2) 8 to 10 foot pits were dug with a backhoe to determine the depth of the water
table, and no water was encountered.

The Colorado Geological Survey has reviewed the geologic report, subsoil
investigation, and preliminary plat for the Ken-Wil Subdivision. The
presence of wind-deposited sand overlying Laramie Formation may create
combinations of settlement and swell of foundations and floor slabs.
The excellent geologic report and subsoil investigation recognize these
potential problems and recommend mitigating procedures for residential
construction. We, therefore, recommend approval of the subdivision with the
_condition that all foundations and perimeter drains be designed by a registered
professional engineer.

This is in reply to your request for a soils evaluation of the
WliSE} Section 16 Township 5 North Range 66 West of the 6th P.H. ,
all in Weld County, Colorado.
The areas marked 51B-C are Vona soil and those marked 21B-B and 21B-C
are Olney soils. Thdy pose no limitations on septic tank filter fields
or home building.
The 66B-CD soils (Renohill) have shale at 20 to 40 inches and are
unsuited for septic tank filter fields without special provisions.
These Renohill soils also have a high clay content and thus a high
shrink-swell potential which poses problems for foundations without
special reinforcement.
The 86-DE soils are Cascajo soils which have moderate limitations
for septic tank filter fields and dwellings because of the slope
(greater than 5X) .
The soil survey is made on the basis of 50 to 60 inch borings.
This information should be used for general planning add does not
exclude the need for on-site investigation for specific engineering
purposes.

In answer to the Planning Commission question pertaining
to the frontage road between 64th Avenue and 65th Avenue, we
are enclosing a copy of the Division's right of way plans in
that area. Outlined in orange is the right of way. The present
frontage road system is on the Division's right of way.
The Division would wish to request that your office give due
consideration to the following:
Presently, the frontage road -between 64th Avenue and 65th
Avenue is not on line with the frontage road to the east. As
this area develops, the frontage road should be moved north to
line up with th portion to the east.

The Weld County Board of Commissioners has authorized me
to issue the following information to the residents ad-
jacent to 64th Avenue .
The County will participate in the improvement and paving
of 64th Avenue providing that adjacent property owners also
participate as outlined below.
The adjacent property owners will pay for the following items .
1 . Design and survey of the proposed road improvements in-
cluding , R. O . W. survey , horizontal alignment survey , vertical
alignment survey , and drainage design and survey . $0 . 30/foot
2 . Necessary -entrance culverts . Property owners to secure
and pay for culverts at Big "R" in Greeley .

Weld County will pay for and furnish the following items .

in escrow and will pay for the items listed above as
the work progresses .
