RE: APPROVE EXPENDITURE AUTHORIZATIONS FOR VARIOUS WORKFORCE
DEVELOPMENT PROGRAMS AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Expenditure Authorizations for Various
Workforce Development Programs between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Department of Human
Services, Employment Services of Weld County, and the Colorado Department of Labor and
Employment, commencing July 1, 2013, and ending June 30, 2015, with further terms and
conditions being as stated in said expenditure authorizations, and
WHEREAS, after review, the Board deems it advisable to approve said expenditure
authorizations, copies of which are attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Expenditure Authorizations for Various Workforce Development
Programs between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, Employment
Services of Weld County, and the Colorado Department of Labor and Employment be, and hereby
are, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said expenditure authorizations.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 14th day of August A.D., 2013, nunc pro tunc July 1, 2013.

Workforce Investment Act and Wagner Peyser Expenditure
Authorization (EA) Modification Requests
Enclosed for Board approval are Expenditure Authorizations requests for the Workforce Investment Act
(WIA) Trade Adjustment Assistance (TAA) Case Management and Emergency Unemployment
Compensation (EUC). These items were reviewed under the Board's Pass -Around Memorandum dated
August 5, 2013, and approved for placement on the Board's Agenda.
The information for the Expenditure Authorization (EA) for funding for the various funding
sources and the program information are as follows:
1. Trade Adjustment Assistance (TAA) Case Management — $30,082.00 (Period of
Performance 7-1-13 to 6-30-15). The FY 13 TAA Case Management funds will be used to
help cover a portion of the direct staff costs associated with the case management of clients
who are determined eligible for services under the TAA program. The program provides
employment and training services to individuals who have lost their jobs due to layoff or
plant/company closures as a result of the job or position being sent overseas.
2. Emergency Unemployment Compensation (EUC) Reemployment Eligibility Assessment/
Reemployment Services Program — $18,354.00 (Period of Performance 7-1-13 to 6-30-14).
The Federal Emergency Unemployment Compensation Funds provided are an advance
payment based on projected number of UI recipients who will be required to receive services.
With the passage of the latest law extending Emergency Unemployment Compensation
benefits, Congress continued to require the new eligibility requirement, which include
providing reemployment services and an in -person eligibility assessment. Included in the
services provided, the individual must receive labor -market information, a skills assessment, an
orientation, and an eligibility assessment relating to job search activities.
These funds services must be provided to each individual who starts receiving Tier 1 or Tier 2
of Emergency Unemployment Compensation benefits. The Colorado Department of Labor and
Employment Unemployment Insurance Program will is providing funds to increase these
services. It is expected that we will receive $70.00 per individual served. We will continue to
use temporary employees to help cover the increased work load for ESWC.

This EA covers a Discretionary Grant. The Line Item Budget for this Discretionary Grant is as
follows:
FY13 TAA: Funds shall be used to cover personnel and benefits costs related to the provision of case
management and reemployment services to trade -effected workers
HI. STATEMENT OF WORK:
A. X The Statement of Work for this EA is as follows:
1. Describe the services, program activities, and/or training that will be provided using
these funds. Identify whether the primary focus is participant services, program
planning, capacity building, supportive services, training, etc., and/or if there are
specific intended outcomes.
Employment Services fo Weld County will provide reemployment and case management
services to trade -effected workers to support their receiving reemployment trade adjustment
assistance under §246 of the Trade Act. Case management services for trade -effected
workers will include:
(1) Comprehensive and specialized skills and needs assessments;
(2) Development of an individual employment plan; and
(3) Provision of the following:
• Information regarding available training and how to apply for such training,
• Information on how to apply for financial aid,
• Short-term pre -vocational services,
• Individual career counseling,
• Employment statistics information, and
• Information on the availability of supportive services.
If it is determined the participant is in need of services that cannot be provided directly by the
TAA program, co -enrollment into the WIA Dislocated Worker will take place when
determined appropriate

V. OTHER PROGRAM REQUIREMENTS OR SPECIFIC FUNDING PROVISIONS
The services provided and work performed as described in this EA document shall be completed
pursuant to the terms and conditions of the WDP Agreement and any Federal and State laws and
requirements, including, but not limited to, Federal guidance documents, relevant State -issued Policy
Guidance Letters, Program Information and Operations Manuals, and/or specifications identified in
the Notice of Fund Availability (NFA) Letter or in the provisions below.
A. The following Additional Funding Provisions apply to this EA:
TRADE ADJUSTMENT ASSISTANCE (TAA) - Case Management Funds
3.1 Statutory Reference: Trade Act of 1974 (Public Law 93-618); Trade Act of 2002 (Public
Law 107-210); and Trade Adjustment Act, Chapter 2 of Title II of the Trade Act of 1974 (19 U.S.C.

2295 et seq.), §235A, as amended, by the Trade and Globalization Adjustment Assistance Act of
2009, February 17, 2009 and the Trade Adjustment Assistance Extension Act of 2011 (Pub. L. 112-
40). Also, 20 CFR Part 617 Trade Adjustment Assistance for Workers Under the Trade Act of 1974
and any succeeding regulations governing the TAA Program. (See also applicable Federal TEGLs
covering the Trade Act of 1974 and its amendments).
3.2 Purpose of Funding: Pursuant to §235A of the Trade Act of 1974, as amended, TAA funds
are provided to the Local Workforce Region to provide reemployment and case management services
to trade -effected workers.
3.3 Required Program Elements:
a. The Local Workforce Region shall assist each trade -effected worker in applying for a
determination of entitlement to receive TAA Program benefits and in registering each applicant
in the Connecting Colorado database.
b. The Local Workforce Region shall be responsible for serving trade -effected workers through the
One -Stop delivery system and shall work in coordination with the State's TAA Program staff to
deliver approved services to each trade -effected worker.
c. The Local Workforce Region shall provide reemployment and case management services to
trade -effected workers to support their receiving reemployment trade adjustment assistance
under §246 of the Trade Act.
Case management services to trade -effected workers shall include:
(1) Performing comprehensive and specialized skills and needs assessments;
(2) developing individual employment plans; and
(3) providing the following:
• Information on available training and how to apply for such training,
• Information on how to apply for financial aid,
• Short-term pre -vocational services,
• Individual career counseling,
• Employment statistics information, and
• Information on the availability of supportive services.
d. The Local Workforce Region agrees to provide counseling, testing and placement services,
supportive services, and other services provided for under any other applicable Federal law or
workforce program to all trade -effected workers.
3.4 Allowable Costs. A trade -effected worker (otherwise known as adversely -effected worker
pursuant to the Trade Act of 1974) means an individual who was employed in a firm at which the
workers are certified under the Trade Act as eligible to apply for Trade Adjustment Assistance (TAA)
benefits, and who was totally or partially separated from such employment due to lack of work.
A trade -effected worker is eligible to apply for TAA benefits; however, he/she may or may not
receive benefits through the TAA program. The State TAA staff review and evaluate the status of
each trade -effected worker applying for benefits to verify that they do qualify to receive program
benefits. Case management costs for serving a trade -effected worker, whether or not they are verified

to receive program benefits and/or are further enrolled in program services are allowable for
reimbursement.
3.5. Confidentiality. In accordance with the provisions and definitions at 29 CFR 90.33 and any
successor provisions, the Local Workforce Region shall keep confidential any confidential business
information it obtains or receives in the course of fulfilling its obligations under the Trade Act, as
amended, and shall not disclose such information to any person, organization, or other entity except
as authorized by applicable State and Federal laws. In addition, the Local Workforce Region shall
keep confidential any information it receives about each trade -effected worker in the course of
fulfilling its obligations under the Alternative TAA Program for Older Workers and Health Coverage
Tax Credit programs to the extent required under all applicable State and Federal laws.
3.6 Restrictions on Funding. Funds shall only be used to cover personnel and benefits costs
related to the provision of case management and reemployment services to trade -effected workers and
shall not be used to cover administrative costs, tuition fees for training, and/or reemployment and case
management operating expenses.

I. BUDGET INFORMATION: The Local Workforce Region has been provided with a maximum
amount of spending authority as identified on the attached Notice of Funding Availability (NFA) letter. The
work performed pursuant to this EA shall be completed with payment made on a cost reimbursement basis for
participants who have received the four core services. Additional funds may be provided under a separate
NFA letter which shall increase the amount of funding available to cover the cost of serving additional
participants. This EA authorizes the Local Workforce Region to request reimbursement from the State for
actual costs for delivery of services up to $70.00 per participant.

IL STATEMENT OF WORK:

1. Describe the services, program activities, and/or training that will be provided using these
funds. Identify whether the primary focus is participant services, program planning, capacity
building, supportive services, training, etc., and/or if there are specific intended outcomes.
Based on the new guidance received in January 2013, describe how your local region
schedules appointments for a specific day and time, and include information about the days
that customers may come in to complete the services.
a. Describe how will you deliver services to meet the four Work Search Requirements for
participants?
Employment Services of Weld County will deliver services to those individuals receiving EUC
benefits who are required to attend a One -on -One appointment utilizing a multi faceted approach.
Within 14 days of UI's notification to the workforce center regarding claimants identified as
required to attend the One -on -One appointment, Employment Services staff will send the IVR
notification to the claimants informing them of their required attendance as well as of the date of
the appointment. The IVR notification will also inform the claimant that they will receive a letter
expanding on the details about the appointment. Employment Services will plan to conduct One -
on -One appointments three days per week for the remainder of the year. If needed, additional days
and/or times will be scheduled for the One -on -One appointments to meet demand.
A follow-up letter will be sent out the same day the IVR is made and will provide the claimant
with additional information of the four mandatory requirements established by HB 3630 and
identifying that three of the four requirements can be completed prior to the One -on -One
appointment. The letter also directs the individual to the Connecting Colorado web site and

encourages the claimant to complete the three requirements prior to their appointment to shorten
the length of time they will be at the workforce center. A Courtesy Follow-up call will be made to
the scheduled claimants approximately 6-7 days in advance of the scheduled appointment to
remind the claimant of the appointment as well as to reinforce the requirements. During the
courtesy call, over the phone assistance will be offered to claimants who need guidance with the 4
on-line requirements.
Upon completion of the group presentation, claimants will able be to select one of five tracks to
obtain additional information specific to their self identified needs and complete their One -on -One
review of their work search plan and six weeks of work search logs. (Those individuals who did
not complete the required skills assessments prior to their One -on -One appointment will be
referred to the resource room to complete either the My Skills My Future; My Next Move, or the
Skills Profiler assessments.) Limited language learners or individuals with limited computer
abilities will be assisted one-on-one in order to complete the assessment requirement.
Representatives from Employment Services' various areas of focus will meet with claimants to
review services available as well as to review the claimants work search plan and their work
search logs. This review will verify the claimant is making proper contacts, provide the
opportunity to discuss job contacts and ensure the claimant is making the required 5 contacts per
week (or whatever was previously negotiated), discuss job search strategies, and to review the
claimants' skills assessment results. Based on each interview, appropriate Wagner Peyser core
services will be entered into the Connecting Colorado data base. The areas of focus consist of the

b. What tools, assessments, services, methods will you use to serve this population?
The day prior to the scheduled One -on -One appointment, staff will run a report for the scheduled
group to identify which of the requirements the claimant has completed prior to the One -on -One
appointment. A courtesy call will be made to the claimant to confirm the claimant's appointment
and assist with any on-line requirements that have not been completed. A listing of the scheduled
attendees will then be distributed to each of the Workforce Center's unit representatives
participating in the Weld County EUC Program process.
At the scheduled One -on -One appointment, attending claimants will be provided the following in a
group setting:

• An overview of HR 3630 Legislation
• An overview of the Work Search/Work Log requirements
• UI Expectations and contact information
• Marketing skills courses Information sites
• One -on -One Session information (information from each unit)
• An overview of Workforce Center Services and the Resource Room
• Information regarding available work shops
(NOTE: This group presentation will be counted as completion of the mandatory orientation to
services and the provision of labor market and career information for those individuals who did
not complete those services prior to the One -on -One appointment)
Same day assessments with Prove -It, Success Profiler, and Behavioral Traits assessments will be
made available to claimants in order to meet the career assessment requirement. Limited
language learners or individuals with limited computer abilities will be assisted one-on-one in
order to complete the assessment requirement. Information will be presented to encourage
claimants to schedule additional times to return to the Workforce Center and take additional
Worker Profiling assessments and to take the Colorado Career Ready Certificates if they have not
already done so. Based on each interview, appropriate Wagner Peyser core services will be
entered into the Connecting Colorado Data Base.
c. Additional Statement of Work requirements may be required as official guidance for this
program is received from the United States Department of Labor (USDOL). Throughout the term of
this EA, the Local Workforce Region shall incorporate additional activities of the program as
identified in any changes in Federal law and/or forthcoming directives from USDOL and/or the State.
2. If this is a discretionary grant, describe how this discretionary grant is leveraged by and
integrated with other workforce development and/or other partner programs. Include a
description of the value added as a result of this leveraging and integration.

The Performance Outcomes for this EA are identified in the Program Charts in Section
VI of this EA.
a. The Local Workforce Region shall achieve the following statewide performance
outcomes for this program:
• An increased number of claimants receiving workforce services within the
Workforce System, statewide
• An increased statewide Entered Employment (EE) rate for this population
• A reduced statewide Average Benefit Duration
b. The Local workforce region shall use the following local reemployment strategies to
ensure improvement of these performance outcomes:
Through the provision of the One -on -One appointments and the information and services
described in Section II A b. above, claimants will have a clearer understanding of the
services and programs available through the Workforce Center. It is anticipated that
claimants attending the One -on -One appointments will have an increased entered
employment rate as well as reduced benefit duration.

c. Additional performance outcomes required by USDOL shall be incorporated into the
Local Workforce Region's performance outcomes throughout the term of this EA, as
more program information and guidance is received from USDOL.

IV. OTHER PROGRAM REQUIREMENTS OR SPECIFIC FUNDING PROVISIONS
A. Emergency Unemployment Compensation Reemployment Eligibility
Assessment/Reemployment Services (EUC-REA/RES) Program
The Local Workforce Region shall provide services pursuant to the terms and conditions of the current
executed PY12 WDP Agreement, this NFA, and any Federal and State laws and regulations, including, but
not limited to, Federal guidance documents, relevant State -issued Policy Guidance Letters (PGLs), Program
Information, Operations Manuals, and/or specifications identified in the provisions below.
The following program requirements apply to the Emergency Unemployment Compensation - Reemployment
Eligibility Assessment/Reemployment Services (EUC-REA/RES) Program regardless of the source of
funding made available to the Local Workforce Region for its implementation. These funding provisions shall
apply to the EUC-REA/RES Program as described in the executed EA. The EA shall cover the time period of
July 1, 2013 through June 30, 2014

2. Funding Methodology.
a. The NFA shall provide a maximum dollar amount of spending authority and each additional NFA
issued shall increase that spending authority allowed for the program during the term of the executed EA.
The funding provisions and requirements shall remain the same regardless of the source of funds provided in
support of the EUC-REA/RES program.
b. The executed EA shall commit the Local Workforce Region to specific program requirements and
shall authorize the Local Workforce Region to request cost reimbursement of actual costs of up to $70.00 per
participant served for the time period of July 1, 2013 through June 30, 2014. EA modifications shall not be
required as spending authority is increased. A copy of the NFA shall be attached to the original EA
identifying the dollar amount available.
3. Purpose of Funding: Funds shall be used to cover the actual cost of the number of participants
served at a rate of up to $70.00 per participant for the rime period of July 1, 2013 through June 30, 2014.
Funds shall not be used for any other purpose.
4. Eligibility Requirements. This program is targeted at unemployment insurance claimants.
Participants who are transitioning from an initial unemployment insurance claim to Emergency
Unemployment Compensation (EUC) Tier 1 (or those participants transitioning from Tier 1 to Tier 2) on or
after March 23, 2012 shall be identified as meeting the requirements of attending the required reemployment
services, including a one-on-one, in -person session at a local workforce center (WFC). Participants are only
required to meet these requirements once.
5. Services Required for Payment. Services shall be provided to each individual who starts receiving
Tier 1 or Tier 2 of Emergency Unemployment Compensation benefits on or after March 23, 2012 through
December 31, 2013. The Local Workforce Region shall review and/or provide, at minimum, the following
required reemployment services:
a. An Individual Assessment (e.g. skills and career interests)
o Discussion on labor market and career information handout
o Focus on occupational assessments of skill levels, aptitudes and individual abilities
o Conduct and direct individuals to online career exploration tools, such as
o MvSkills MyFuture, MyNextMove, or Skills Profiler. These can be online or in -person. (See labor market and
career information handout).
b. An Orientation to the available services at the Workforce Center
o Notify claimants of the new EUC-REA/RES work search requirements
o Claimants must maintain work -search records and bring in a copy of the records for review at the in -person
appointment
o Provide a copy of work search records to UI, upon request
o Provision of the labor market and career information handout
c. An Individual Work Search Plan (In-Person/one-on-one Eligibility Assessment) relating to job -search
activities
o Participant must be registered and active in Connecting Colorado
o Engaged in an active search for work, based on past work experience, skills, capabilities, and local Labor
Market Information (EMI)
o WFCs may determine an appropriate number of job contacts, as appropriate to the local economy

o WFCs shall review the work -search logs (6 weeks minimum) and confirm the claimant's continued eligibility
for EUC-REA/RES. The work -search records should reflect the time period of 6 weeks prior to being notified
of the new requirements.
d. Individualized and current Labor -market and career information shall be customized to meet the
participant's individualized employment goals. Handouts and other resources shall be provided to each
participant..
6. Program Requirements. Services provided shall conform to the criteria, processes, and types of
services identified in the documents referenced in Section A.1 above. The Local Workforce Region shall
follow the provisions in the State's Policy Guidance Letter (PGL) covering this EUC-REA/RES Program
which provides additional guidelines for program implementation and operations. Additionally, the Local
Workforce Region shall comply with the following:
a. General Program Activities.
o Services may be delivered and program requirements completed for each participant in one appointment
o Additional referrals and reemployment services may be provided, as appropriate
o A one-on-one appointment and in -person Eligibility Assessment is MANDATORY
o Tier 2 claimants who participated in the enhanced work search requirements in Tier 1 will NOT be
required to comply with the minimum requirements again
o UI Claimants that do not attend/receive the services required in section 5 above are subject to a denial of
Unemployment Insurance Benefits (UIB) for that week (and subsequent weeks) of planned participation
o Participation may be rescheduled for individuals, even after the 6th week
o Workforce centers must schedule participants for an individualized appointment on a specific day and
time and enter that scheduling information into Connecting Colorado.
o If a referral is made, the participant shall participate in that activity or will be subject to a denial of UIB
for that planned participation week.
o Eligible participants must be notified of the orientation within 2 weeks and the services must be provided
within 5 weeks
o Participants shall be notified of the rescheduling if it was not initiated by them.
o Workforce Centers must record a service in Connecting Colorado for any potential eligibility issues and
when a participant fails to report to their one-on-one appointment
b. One-on-one Appointments. The State requires the Local Workforce Region to schedule eligible
claimants for an in -person one-on-one appointment on a specific day and time. If the claimant does not show
up for the scheduled appointment, workforce centers are required to report this "no show" and any other
potential eligibility issues to UI within two days and within the same week of the scheduled appointment
(which -ever is shorter).
7. Optional Services. The Local Workforce Region is highly encouraged to provide the following additional
services to participants:
o Resume and/or Connecting Colorado application - review for appropriate skills
o Work -search and career planning
o Individual and/or career planning (above/beyond the requirements)
o Referral to training, such as, training available through the Workforce Investment Act (WIA) or the Trade
Adjustment Act (TAA), Veteran's programs, and other discretionary grants
o Additional staff -assisted reemployment services, such as supportive services, covered by other program
funding
o Job search counseling, including workshops and networking groups

8. Delivery of Services by Local Workforce Region Personnel: Regardless of the funding source, the
delivery of services shall be provided by staff who are covered by a merit system in compliance with the
WDP Agreement, Exhibit A, Part 1, 1.1.A.xii.
9. Payment Process.
a. Upon issuance of this NFA, the Local Workforce Region may request cost reimbursement payments
subject to an executed EA. Costs incurred as of the start date of the period of performance identified in this
NFA may not be reimbursed until an original EA has been executed.
b. Verification that each participant has been provided with the four core services identified in Section 5
above shall be documented and reconciled with cash disbursements on a monthly basis. Cash may be drawn
based on actual expenditures incurred, however, with the submittal of monthly expenditure reports, the total
amount of cash draws for the prior month must be reconciled to the number of EUC-REA/RES claimants who
have completed their four services in the prior month, so as not to exceed a cash disbursement of $70.00 per
participant. At the end of the grant period of performance, all cash disbursements for actual costs of the EUC-
REA/RES program shall not exceed a total of the number of participant completers multiplied by $70.00 per
participant.
c. To request cost reimbursement, the Local Workforce Region shall follow the standard cash draw
procedures as described in the effective EA PGL and Subrecipient Financial Procedures PGL.
10. Restrictions on Funding: Funding is provided to cover ONLY the actual costs of up to $70.00 per
participant served. Documentation for each participant shall be noted in Connecting Colorado verifying that
the four required services identified in section 5 above have been delivered.

Pursuant to the Workforce Development Programs (WDP) Agreement CMS# 38158, the Local Workforce Region
shall submit to the State an Expenditure Authorization (EA) requesting authorization to expend or deobligate these
funds. The attached Fund Availability Summary for all funding sources provided under the WDP Agreement
CMS# 38158 shows the Total Funding Availability for Program Year 2012 and Program Year 2013 (PY13).
The maximum funding for Weld County under WDP Agreement CMS# 38158 shall not exceed Five Million
Sixty -Eight Thousand Nine Hundred Seventy -Five Dollars Forty -Four Cents ($5,086,975.44). The funding
allocations identified herein shall be available to the local workforce region provided that a WDP Agreement and
appropriate EAs have been fully executed. This NFA letter shall become Attachment E to the fully executed WDP
Agreement for your workforce region.
