The land north of this parcel is residential (Pebble Brook subdivision and Mountain Shadow subdivision). The land directly east of this parcel isa commercial business. During our inspection of this parcel in preparation for this hearing, it was discovered that this property is not vacant residential land, but it is in fact commercial property. Assessors are required to consider, and when applicable, to apply the present worth valuation procedure when using the market approach to value vacant land, § 39-1-103(14)(b), C.R.S As required by 39-1-104(10.2), C.R.S., the market value is determined by utilizing data from the period of one and one-half years immediately prior to June 30th, 2012. If sufficient comparable valuation data is not available within the eighteen -month time period, the assessor shall use market data from the five year period immediately prior to one 30th, 2012. Income Approach Since there was no data availablefor for the capitalization of ground rents on vacant residential lots, the income approach was not utilized. Market (Sales) Approach Sincethere was an adequate quantity of qualified sales data available, the direct sales comparison approach was doomed the best method in determining the adjusted sales price. The Weld County Assessor's Office has verified that the comparable sales are arms -length transactions based on review of the Real Property Transfer Dedaration, telephone or personal confirmation interviews and physical inspections to confirm property characteristics at the time of sale. As of June 2012 value of the property was raised again from $ 75,000 to $95,773 which is almost another % 40 raise and that almost adds up to % 110 raise in 2 years from $45,000 to $95,773. We feel this is completely unreasonable given the current economic times which property values especially vacant land values have been continuing to decrease in value. This parcel of vacant land has no improvements, no water, sewer ,electricity ,or other utilities. And being a pie shaped with an almost 32 feet drop in elevation from east to west makes the property very undesirable ,and only about one acre may be usable.
