(Orchard/Cidery Site)
The Weld County Public Works Department reviewed the submitted application for critical items, including but
not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood
Hazard Development Permit. Comments made during this stage of the review process will not be all inclusive;
as revised materials are submitted other concerns or issues may arise. All issues of concern and critical
issues during further review must be resolved with the Public Works Department.
COMMENTS:
Weld County Functional Classification Map: (revised Feb. 9, 2011 —Amended 10/2011)
CR 17 is a local gravel road that requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot
right-of-way. This road is maintained by the Town of Firestone. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. (ADT count
was 45-62 in 2012.)
CR 24 (Firestone Blvd.) is a collector road. (ADT count was 1632 in 2006.)
REQUIREMENTS:
Noxious Weeds:
Should noxious weeds exist on the property or become established as a result of the proposed development,
the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of
the Weld County Code.
The access width requirements for emergency equipment (fire department) are a minimum of 20 feet.
The access drive and parking lot shall be recycled asphalt, graded and drained, to provide an all-weather
access.
No parking or staging shall be permitted on CR 17; use on -site parking only.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
Storm Water Drainage:
The applicant has supplied a water capture quality feature (WQCF) location and calculations. The area can be
an existing on -site low point that will capture the stormwater and hold any contaminants on -site or it can be a
shallow (1-2' deep) depression dug downstream of the parking lot, and existing and future building locations.
a. The applicant shall also provide flow arrows on the map showing where the stormwater starts and
how it flows across the property.
b. The applicant has calculated a 1500 cu. ft. WQCF necessary for the proposed use and conforming
to the Urban Storm Drainage Criteria Manual, Volume 3, Section 3.3.0.
Please add the following development standards to the plat:

1. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it
will reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions, concentration and/or
unplanned ponding of storm run-off.
2. The applicant must take into consideration storm water capture/quantity and provide accordingly for
best management practices.
3. Weld County will not maintain on -site drainage related areas or medians.
Grading Permit:
The proposed project appears to be disturbing more than one acre during the construction of the facility. A
grading permit is required prior to the start of construction. Please add the following development standards to
the plat:
1. In the event that 1 or more acres are disturbed during the construction and development of this site,
the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of
the Colorado Department of Public Health and Environment.
2. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of
construction. The grading permit application must contain: an erosion and sediment control plan, a
grading plan, installation details of all BMPs to be utilized, typical installation and maintenance
notes for all BMPs to be utilized, and a copy of the approved CDPHE stormwater permit. The
erosion and sediment control plan set must be wet stamped, signed, and dated by a registered
professional engineer licensed in the State of Colorado.
Traffic:
Traffic expected at the Cidery will consist mainly of private vehicles of owners, employees and tasting room
customers; approximately 20 cars a day on days the tasting room is open and less on days when it is only
owners and employees.
All traffic is expected to access CR 17 from the south of CR 24 as it has direct access to 1-25. Overflow
parking areas which are used exclusively for seasonal events are currently native grasses or will be seeded
with native grasses and will be maintained as such.
An Access Permit has been obtained from the Town of Firestone to access CR 17 (Permit # 2013-01.)
A vehicle tracking control pad consisting of recycled asphalt will be required to prevent tracking of material
from your site in the way of mud or debris on to roadway. This needs to be placed and shown on the plat as
recycled asphalt road base.

Environmental Health Services has reviewed this proposal for cidery and tasting room,
including planting an apple orchard. The facility will also be used for special events,
such as weddings or similar uses. A Bed and Breakfast facility was also indicated on the
Weld County Referral form as a proposed use. A Retail Food Establishment license
may be required if food is prepared and/ or stored on site. The applicant will need to
contact the Consumer Protection Section of Weld County Environmental Health
Services for food licensing requirements.
The facility is served by an existing commercial septic system (Permit No. SP -0300396)
and is permitted for 10 persons. The existing commercial septic system will require
evaluation by a Colorado Registered Professional Engineer to determine if adequate for
the proposed cidery, tasting room and special events. There is an existing home on the
property that is also served by an individual sewage disposal system (G19760335) that
is permitted for 5 bedrooms. It was not indicated in the application if the existing
residence was to be converted into the Bed and Breakfast facility. If so, the existing
residential septic system will also require an engineer's evaluation to determine if
adequate.
If the combined design capacities of the existing residential and existing commercial
septic systems exceed 2000 gallons per day, a site application will be required to be
submitted for approval by the Water Quality Control Division of the Colorado
Department of Public Health and Environment. Any large capacity septic systems
(serving 20 or more persons per day) require approval by the Environmental Protection
Agency under their Underground Injection Control (UIC) program.
The facility is currently served by an individual well (Permit #75616-A) and is permitted
for domestic uses. The applicant is proposing to connect to Central Weld County Water
District's water service. The applicant provided a letter from the District, dated January
14, 2013, regarding water service availability; however, the availability of service has
expired. The applicant will need to submit documentation that water service is approved
for the facility by submitting one of the following:
a. Written evidence from the Colorado Division of Water Resources
demonstrating that the well is appropriately permitted for the commercial use,
or
b. Written evidence from Central Weld County Water District that water service
is available.
The waste handling plan stipulates that refuse will be removed by Waste Management,
cardboard and plastic containers will be recycled Longmont's recycling facility, and
incoming pallets will be used for shipment of finished products.
When the apple orchard matures, apples will be processed on site. The apple waste will
be composted and used to augment the soil in the orchard. According to the applicant,
water and cleaning solution will drain to floor drains which discharge to a vault. The
volume of liquid draining to the vault will be monitored to determine whether the existing
septic system would have the capacity to discharge to, or would need to be upgraded.
The applicant may opt to continue to utilize the vault if the existing septic system is not
adequate for the floor drain discharge.
A discharge permit may be required for stormwater discharges and process wastewater
discharge from the distillery operation. The applicant will need to contact the Water
Quality Control Division (WQCD) of the Colorado Department of Health and
Environment for discharge permit requirements.
The existing access drive is recycled asphalt. Dust will be controlled by placing recycled
asphalt in the primary parking area, and the overflow parking areas (seasonal event
parking) will be seeded with native grasses and maintained.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. Any additional hydraulic load to an existing septic system will require an
Evaluation from a Colorado Registered Professional Engineer. The engineer's
evaluation shall be submitted to the Weld County Environmental Health
Department. In the event the system is found to be inadequate, the system must
be brought into compliance with current Weld County Individual Sewage Disposal
Regulations.
2. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any large -capacity septic system (a septic system with the capacity to serve

20 or more persons per day). Alternately, the applicant can provide evidence
from the EPA that they are not subject to the EPA Class V requirements.
3. In the event the septic system(s) requires a design capacity of over 2,000 gallons
of sewage per day the applicant shall provide evidence that all requirements of
the Water Quality Control Division (WQCD) of the Colorado Department of Public
Health and Environment 's Regulation No. 22 have been satisfied. Evidence of
compliance shall be provided to the Weld County Department of Public Health
and Environment. Alternately, the applicant can provide evidence from the
WQCD that they are not subject to these requirements.
4. The applicant shall provide evidence that water service is permitted for the
proposed commercial facility by submitting one of the following:
a. Written evidence from the Colorado Division of Water Resources
demonstrating that the well is appropriately permitted for the commercial
use, or
b. Written evidence from Central Weld County Water District that water
service is available.
5. In the event the facility's well water system serves more 25 persons on a daily
basis the water system shall comply with the Colorado Primary Drinking Water
Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County
Department of Public Health and Environment that the system complies with the
Regulations.
6. The applicant shall submit evidence of a Colorado Discharge Permit System
(CDPS) from the Water Quality Control Division (WQCD) of the Colorado
Department of Health and Environment for any proposed discharge into State
Waterways. Alternately, the applicant can provide evidence from the WQCD that
they are not subject to these requirements.
We recommend that the following requirement be incorporated into the permit as a
condition that must be met prior to final approval of the proposed uses:
1. In the event food is prepared and/or stored on site the applicant shall comply with
the Colorado Retail Food Establishment Regulations. The design plans for the
food service facility shall be submitted to the Consumer Protection Division of
Weld County Environmental Health Services for review and approval for
licensing.

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Produce shall be handled and stored at the facility in such a manner so that no
nuisance is created by odor, blowing of debris, fugitive dust, or spoiled produce
on or around the facility.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in Section 14-9-30 of the Weld County Code.
8. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
10. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
12. The applicant shall comply with Colorado Retail Food Establishment Rules and

Regulations governing the regulation of food service establishments (6 CCR
1010-2).
13.All pesticides, fertilizer, and other potentially hazardous chemicals must be
handled in a safe manner in accordance with product labeling. All chemicals
must be stored secure, on an impervious surface, and in accordance with
manufacturer's recommendations.
14. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Building Department Review Comments

Dear Sir/Madam,
The Weld County Building Department has reviewed the history and investigated any complaints or violations that accompany
the parcel. The findings are as followed:
Currently on the property is a 2 -story farm house and goat milking parlor that is approximately 4,800 SF. The 4,800 SF building
was permitted in 2003 as a goat milking parlor and all inspections were completed. The residence was built prior to building
permits being required. In order to use these buildings, for a new and more restrictive use, a commercial building permit will
be required. On the back of this permit you will find the necessary items that must be submitted with the application. The
submittal must be complete with all the documents before it can be accepted. In addition this building will require the
following. Engineered drawings for all structural work and architectural drawings that show the floor plan, elevations, ect. Any
structural members not being altered do not require engineering unless additional loads will be applied to the structure. Also,
a life safety plan showing occupancy and building type, egress routes, emergency lights/exist, frontages, and travel distance
must be submitted. There are limits to the amount of alcohol that can be stored in a building without a firewall or separation
of other occupancies. Please provide information on the alcohol content, how and where it will be stored and the amount that
will be stored in the building. A ComCheck for the building envelope, mechanical, and electrical must be submitted showing
that the building will comply with the 2006 International Energy Code for all new construction or new heated areas. Bathroom
plans with details must be submitted to show accessibility. Also an overall accessibility plan must be submitted. Mechanical,
plumbing and electrical drawings with a one line and fault current calculations are required for new work. The building must
comply with the requirements set forth by the Fire District. A letter of notification that they have received the drawings and
that they are ok with the release of the building permit must be submitted to our office with the application.
Currently we are under the 2006 IECC, 2011 NEC and the 2012 IBC, IRC, IFGC, IMC and IPC.

I have reviewed the submitted materials for compliance with the adopted codes and standards of the Fire
District. The District has no objections to the project, if the requirements of the District can be met. Based
on my review, I have the following comments:
1. Submit the site plan and construction drawings to the Fire District for review and approval. Since
this will be open to the public for special events, the building must comply with all of the
requirements for an assembly occupancy. (Note that 140 parking spaces are available.)
2. The water supply to the site must comply with the requirements of the International Fire Code for
required fire flow and hydrants. It is unknown at this time whether there is an adequate water
supply to meet this requirement. This could be an obstacle to the completion of the project.
3. The access to the buildings on the site must meet the requirements of the International Fire Code.
It is not possible from the included drawing to determine this.
I recommend that the applicants provide construction and site plan drawings to the Fire District for review
and approval before moving further ahead. This will allow the applicants to determine how feasible this
project is.
