DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, MUSR12-0005
(FKA USR-950), FOR A LIVESTOCK CONFINEMENT OPERATION (1,000 -HEAD
DAIRY FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT - PHIL JR. AND
MARYANN PENNOCK
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on June 27, 2012, by Resolution #2012-1614, the Board approved the
application of Phil Jr. and Maryann Pennock, 329 Highway 56, Berthoud, Colorado 80516, for a
Minor Amendment for a Site Specific Development Plan and Use by Special Review Permit
MUSR12-0005 (FICA USR-950), for a Livestock Confinement Operation (1,000 -head dairy
facility) in the A (Agricultural) Zone District, on the following described real estate, being more
particularly described as follows:
E1/2 SW1/4 of Section 18, Township 4 North,
Range 68 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board was presented with a request from Phil Jr. and Maryann Pennock
to amend Condition of Approval #2.A to become Development Standard #39 and extend the
date to record the plat for a Minor Amendment to Site Specific Development Plan and Use by
Special Review Permit, MUSR12-0005 (FKA USR-950), for a Livestock Confinement Operation
(1,000 -head dairy facility) in the A (Agricultural) Zone District, until August 16, 2013, and
WHEREAS, the Board heard all of the testimony and statements of those present and
reviewed the request of the applicant and, having been fully informed, finds that the request to
amend a Condition of Approval and extend the date to record the plat, as described above, be
approved.
NOW, THEREFORE, BE RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Paul Jr. and Maryann Pennock to amend Condition of
Approval #2.A to become Development Standard #39 and extend the date to record the plat
until August 16, 2013, for a Minor Amendment to a Site Specific Development Plan and Use by
Special Review Permit, MUSR12-0005 (FKA USR-950), for a Livestock Confinement Operation
(1,000 -head dairy facility) in the A (Agricultural) Zone District, on the parcel of land described
above be, and hereby is, approved.

SUBJECT: Request to Amend a condition of approval for MUSR12-0005
and extend the recording date for the MUSR12-0005 plat (Pennock)
Background:
USR-950 was approved by the Board of County Commissioners on June 26, 1991. USR-950 allows for an
80,000 head turkey & 150 head dairy facility. The applicant proposed in 2012 to replace this approved
operation with a 1,000 head dairy facility under a USR Minor Amendment request (MUSR12-0005).
MUSR12-0005 was approved by the Board of County Commissioners on June 27, 2012.
AGPRO, on behalf of the applicant has two requests regarding this case:
Proposed Modification to MUSR12-0005 Condition of Approval 2.A:
The applicant is requesting to move the following condition of approval (condition of approval 2.A) to a
development standard (Development Standard #39):
The applicant shall address the requirements of the Weld County Department of Public Health and
Environment as stated in their referral dated June 20, 2012, as follows:
The applicant shall apply for and obtain a commercial Individual Sewage Disposal System (I.S.D.S.)
permit for disposal of sanitary wastes from the milk parlor, and from restroom facilities for employees and
patrons of the facility. If the applicant intends to use any existing system, the system must be evaluated
and permitted in accordance with Environmental Health Services Division policy and all provisions of the
Weld County Code, pertaining to I.S.D.S.
Request to Extend the deadline to record the MUSR12-0005 plat:
The approved USR12-0005 resolution granted the applicant one -hundred twenty (120) days to complete
conditions of approval and submit the plat for recording. This would have been October 27, 2012.
If the proposed modification to the condition of approval 2.A is granted, AGPRO has indicated requests a
thirty (30) day extension to record the plat. Should the proposed modification not be approved, the
applicant is requesting to extend the recording date until June 27, 2015. AGPRO has indicated that
business conditions have been changed which has delayed the construction of the dairy parlor for the
facility.
Staff Recommendation:
Staff has reviewed the requested change to condition of approval 2.A with Environmental Health and he is
in favor of this request. The Department of Planning Services is in favor of the proposed amendment to
Condition 2.A and the 30 -day extension request to record the plat.

Dear Chris:
On behalf of my client, Doug Pennock, I respectfully request an extension until June 27, 2015
for the of the plat recording deadline for the above mentioned USR Minor Amendment. Business
conditions have changed since the amendment was approved. As such there has been a delay in
the construction of the milking parlor. Condition 2.A.1 is a construction related condition
requiring an approved septic permit for the milking parlor. The additional time to record the plat
will provide sufficient time for construction.
Alternatively, I propose removing condition 2.A entirely and replacing it with a development
standard 39 to read:
Any Individual Sewage Disposal System (LS.D.S.) on the property
shall be permitted, installed, maintained and operated in
compliance with all provisions of the Weld County Code,
pertaining to I.S.D.S.
This language is being used in the USR conditions for Prado Dairy (USR13-0012) which is
scheduled for a hearing on the July 17, 2013. If you and the board are amenable to this option, I
propose a one month extension from the approval date to address any redlines on the USR plat.

Dear Chris:
This letter is to verify the Conditions of Approval for MUSR12-0005 have been completed prior to
recording the plat. The following conditions have been met as shown with the submitted
documentation. Please forward the information to the corresponding departments for their review.
1-A. Plat Amendments: The requested amendments are included in the revised plat for your
review.
2-A. Environmental Health: All currently required septic permits have been obtained at this
time. A commercial septic permit can only be obtained when the milk parlor is ready to be
constructed. Current plans call for construction over a year from now. As such, any septic
permit obtained would likely expire prior to installation. This meets the intent of the
condition.
