SUBJECT: USR13-0021, Shupe Farms LLC.
(Storage of Bulk Commodities)
The Weld County Public Works Department reviewed the submitted application for critical items,
including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical
Soils Report, and Flood Hazard Development Permit. A detailed review of these items was not
completed at this step in process. Comments made during this stage of the review process will
not be all inclusive; as revised materials are submitted other concerns or issues may arise. All
issues of concern and critical issues during further review must be resolved with the Public
Works Department.
COMMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the
state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-
350-2163) to verify the access permit or for any additional requirements that may be needed to
obtain or upgrade the permit. (State Highway 392)
Access Permit Application Form: The applicant has supplied this form, CDOT Permit no.
412096.
REQUIREMENTS:
Noxious Weeds: Should noxious weeds exist on the property or become established as a
result of the proposed development, the applicant/landowner shall be responsible for controlling
the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code.
Off-street parking spaces including the access drive shall be surfaced with 6 inches of recycled
asphalt base and shall be graded to prevent drainage problems.
Traffic Study:
The applicant has supplied a traffic narrative (questionnaire) indicating that there will be either
unloading or re -loading trucks, 4-5 per day. This will be an unmanned site; no full-time
employees will be at this site.
Drainage Report:
The applicant submitted a "Historic Water Flows Narrative" dated February 15, 2013 and signed
and stamped by Mark Taylor, P.E. with ATD, LLC.

Please place the following notes on the Plat:
a. The historical flow patterns and run-off amounts will be maintained on site in
such a manner that it will reasonably preserve the natural character of the area
and prevent property damage of the type generally attributed to run-off rate and
velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
b. The applicant must take into consideration storm water quantity and provide
accordingly for best management practices.
c. Weld County is not responsible for the maintenance of onsite drainage related
features
d. Please delineate the Water Quality Capture Feature on the plat and label as "No
build/Storage Area." Label the minimum water quality capture volume, 1826 ft3.
Grading Permit:
Please place the following language in the resolution under "Prior to the Release of Building
Permits".
1. The project will disturb over an acre of land therefore, a Weld County Grading Permit is
required before construction. The grading permit application must include the grading
plan, erosion and sediment control plan, typical BMP installation details, typical BMP
installation and maintenance notes, and a copy of the Colorado Department of Health
and Environment construction stormwater discharge permit.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal
Emergency Management Agency (FEMA).

Environmental Health Services has reviewed this proposal for storage of bulk
commodities (dry feed) for delivery to local customers. A 22,000 sq. ft. metal storage
building is proposed to store the commodities.
The application states that there will be no full-time employees at this site; only delivery
drivers who will be on site to load or unload.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Bottled water from a commercial source is allowed in the following
circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Policy: Portable toilets are allowed in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this department that portable toilets are allowed
when employees or contractors are on site for less than 2 consecutive hours a day. As
personnel will be on site for a short duration, in accordance with Environmental Health
Services policy the use of portable toilets is allowed.
The applicant submitted a dust abatement plan which states that a water truck will be
used to control onsite dust during construction. The access drive and circulation areas
will be covered in recycled asphalt and all other areas will be seeded with native dryland
pasture grass.
The waste handling plan states that a dumpster will be provided and serviced by Waste
Management of Ault, CO. Waste Management will also service the portable toilet.
We have no objections to the proposal; however, we recommend the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.

5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in
the Commercial Zone as delineated in Section 14-9-30 of the Weld County
Code.
7. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. Portable toilets and bottled
water are acceptable. Records of maintenance and proper disposal for portable
toilets shall be retained on a quarterly basis and available for review by the
Weld County Department of Public Health and Environment. Portable toilets
shall be serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
8. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

After reviewing the documents to add a steel structure to site plan the Building Department has
the following comments:
A building permit will be required for any new construction, alteration, or addition to any
buildings or structures on the property. A building permit application must be completed and
two complete sets of engineered plans including engineered foundation plans bearing the wet
stamp of a Colorado registered architect or engineer must be submitted. A geotechnical
engineering report performed by a registered State of Colorado engineer shall be required or a
open hole inspection.
Buildings, equipment and structures shall conform to the requirements of the various codes
adopted at the time of permit application. Currently the following has been adopted by Weld
County: 2012 International Building Code; 2012 International Mechanical Code; 2012
International Plumbing Code: 2012 International Energy Code; 2006 International Fuel Gas
Code; 2011 National Electrical Code; 2009 ANSI 117.1 Accessibility Code the 2012
International Plumbing Code. and Chapter 29 of the Weld County Code.
A plan review shall be approved and a permit must be issued prior to the start of construction.
