WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of land,
being the property of Herman Huwa and Anna Huwa, husband and
wife, and Harold Huwa and Ruby Dell Huwa, husband and wife, of
Keenesburg, Colorado, and more particilarly described as follows,
to-wit:
Part of the El of the SE4 of Section 3, Township 1
North, Range 63 West of the 6th P.M., Weld County,
Colorado, being more particularly described as follows:
Beginning at the Southeast Corner (SE Cor) of said
Section 3, and considering the South Line of said Sec-
tion 3, as bearing North 90°00'00" West, with all
other bearings contained herein relative thereto;
Thence North 90°00'00" West, along the South Line
of said Section 3, 705. 00 feet to the True Point of
Beginning;
Thence North 90°00'00" West along said South Line
589. 48 feet;
Thence North 00°09'16" East, 2603. 42 feet;
Thence South 89°57'07" East, 1308. 64 feet;
Thence South 00°28'00" West, 2277. 40 feet;
Thence North 90°00'00" West, 705. 00 feet;
Thence South 00°28'00" West, 325. 00 feet to the True
Point of Beginning.
Said described parcel of land contains 72. 513 acres,
more or less,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the matter came on for hearing on March 26, 1975, and
the Board of County Commissioners of the County of Weld, State of Colorado,
having heard the testimony and evidence adduced upon said hearing, having
considered the testimony, evidence, remonstrances and recommendations of
the Weld County Planning Commission filed with said Board, and having
carefully weighed the same, now desires to exempt this particular division
of land, pursuant to its authority under CRS 106-2-33 (d) 1963, as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by Herman Huwa and Anna Huwa, husband and wife,
and Harold Huwa and Ruby Dell Huwa, husband and wife, of Keenesburg, Colo-
rado, be exempt from the terms "subdivision" and "subdivided lands" as pro-
vided for in the new County Subdivision Regulations at Section 2-1, A., (3)
adopted August 30, 1972.
The above and foregoing Resolution was, on motion a Tade and
seconded, adopted by the following vote on the 2nd day of �i, A.D., 1975.

Dear Sirs:
The attached plat, application and other items are in reference to a request,
by Herman and Anna Huwa and Harold and Ruby Dell Huwa, for a Recorded Exemption.
The parcel contains approximately 72.513 acres of irrigated farm land and
desire to split 1 .250 acres.
Based on the information submitted andthe Weld County Regulations, the Planning
staff recommends denial for the following reasons:
1 . The proposed split does not conform to the Weld County Comprehensive
Plan in-as-much as the use would be on prime agricultural land and
would not promote agricultural use.
2. The proposed split does not comply with the intent clause, Section 9-2,
of the Subdivision Regulations for Recorded Exemption in-as-much as
productive farmland would be developed.
3. The soils are Class I and II irrigated agricultural lands; however,
4. A Lot Size Variance was granted to allow the Huwas' to apply for
Recorded Exemption.
