RE: APPROVAL OF PRELIMINARY SUBDIVISION PLAN, PINNACLE PARK,
3RD FILING, - - GEORGE HOECHER, 16581 HIGHWAY 392 ,
GREELEY, COLORADO 80631, LOCATED IN THE SOUTH HALF OF THE
SOUTH HALF OF SECTION 14 IN TOWNSHIP 6 NORTH OF RANGE 66
WEST OF THE 6TH P.M. , IN WELD COUNTY, COLORADO.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, held a public hearing on the 16th day of May, 1977, at
the hour of 9 :00 o'clock A.M. , for the purpose of hearing the
application of George Hoecher, 16581 Highway 392 , Greeley, Colo-
rado 80631, for approval of the Preliminary Subdivision Plan for
Pinnacle Park, 3rd Filing, on the following described real estate,
to-wit:
A tract of land located in the South Half of the
South Half (SAS') of Section 14 , Township 6 North,
Range 66 West of the Sixth Principal Meridian, Weld
County, Colorado and being more particularly des-
cribed as follows :
Commencing at the Southwest Corner (SW Cor) of Section
14 and considering the West Line of said Section 14 to
bear North 00°02 ' 16" East and with all other bearings
containted herein being relative thereto:

Said tract of land contains 47.020 acres and is sub-
ject of any Rights-of-Way or other Easements as granted
or reserved by instruments or record or as now existing
on said tract of land.
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of the approval
of said Preliminary Subdivision Plan and evidence was presented
in opposition to the approval of the Preliminary Subdivision Plan
for the aforementioned tract of land, and
WHEREAS, the Board of County Commissioners has studied the
request as submitted, and having been fully informed and satisfied
that the submitted Preliminary Subdivision Plan conforms in all
respects with the requirements of Section 5 of the Weld County
Subdivision regulations, and that approval of said Preliminary
Subdivision Plan would be in the best interests of the County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the Preliminary Subdiv-
ision Plan for Pinnacle Park, 3rd Filing - - George Hoecher,
16581 Highway 392, Greeley, Colorado 80631, located in the South
Half of the South Half of Section 14 in Township 6 North of Range
66 West of the 6th P.M. , in Weld County, Colorado is hereby
approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
May, A.D. , 1977.

1. The preliminary plan conforms with the requirements of Section 5-4(A) of
the Weld County Subdivision Regulations,
2. The Weld County Health Dept. has indicated the preliminary plan as pro-
posed is in compliance with Weld County and State Health Standards and
Regulations.
3. The Eaton School District has indicated they have no objections to the
approval of the preliminary plan.
4. The New Cache La Poudre Irrigating Company has indicated they have no
objections to the plans as presented.
5. To date none of the surrounding property owners have expressed any
opposition to this preliminary plan.
COMMENTS :
1. The Eaton Fire Protection District failed to respond to the referral sent
to them.

2. As requested by the West Greeley Soil Conservation District the
covenant pertaining to livestock and animals should be amended to
read, "A-6 - LIVESTOCK AND ANIMALS - Barnyard animals may be
kept and maintained on each lot provided adequate ground cover
is maintained during and after the grazing season. Animals may
not be kept or maintained for any commercial purpose."
3. As requested by the West Greeley Soil Conservation District, a
surface drainage plan and a soil erosion control plan must be
submitted for review as part of the final plat application
submission.
4. The applicant has submitted a letter dated April 12, 1977 request-
ing a variance from the requirement of providing an asphalt paving
surface for the roads within this 3rd Filing of Pinnacle Park.
The Weld County Planning Commission recommends the request be
approved because:
A. A preliminary plan for the subject area was approved in mid
1968 which has now expired since a final plat was not filed
within 12 months of approval of the preliminary plan. The
Subdivision Regulations in effect at that time did not
require paving with the proposed density for this develop-
ment. It is the opinion of the Planning Commission that the
County has an obligation to grant a variance from the
paving requirement due to the confusion and misunderstanding
associated with the preliminary plan approval in 1968.
B. As indicated in Mr. Hoecher's letter of April 12, 1977, Mr.
Hoecher will construct approximately 1460 feet of road from
the west end of this proposed 3rd filing of Pinnacle Park
west to County Road 33 to provide additional access. The
cost of paving this additional 1460 feet of access road
along with the roads inside the 3rd filing would be pro-
hibitive.
C. Surfaced roads within the 3rd filing would not be consistent
with the remainder of the existing development which has
gravel surface roads.
5. The Subdivision Improvements Agreement submitted by the applicant
shall specify the date for completion of the improvements con-
tained in the agreement.

Gentlemen:
• We are aware that the current County policy requires asphaltic pavement.surfacing
on all roads in subdivided areas. We are requesting a wavier of this policy for
Pinnacle Park Third Filing for the following reasons:
1. The preliminary plat for this subdivision was originally presented and accepted
in mid 1968. The First Filing of 9 lots and the Second Filing of 7 lots have been
platted and recorded. Roads in these areas were constructed and gravelled to County
Standards existing at the time of acceptance. These roads must be travelled toget
to the Third Filing.
2. The Third Filing is the last of the property to be developed and consists of
16 lots, approximately 2 1/2 acres in size (as are the lots in the First and Second
Filings). The Third Filing sets about 1750 feet from County Road No. 35 through
the First and Second Filings and 1460 feet from County Road No. 33. As part of
the Third Filing, the road to County Road No. 33 will be dedicated and constructed.
The cost of surface improvements on this additional access road would be prohibi-
tive as no lots will front on this access road.
3. Asphalt surfaced roads would not be computable with the existing nature or use
of the area.
4. In prior discussions with Glen Billings, Kay Horton, and Tom Hahn, the consen-
sus appeared to be that a wavier could be granted due to the above reasons, and
consequently, we have submitted the revised preliminary plan.
Therefor, as part of the request for approval of the Preliminary Plat on Pinnacle
Park- Third Filing, we are requesting a wavier on the asphaltic surfacing require-
ment for this filing.

Dear Mr. and Mrs. Hoecher:
We are pleased to commit the loan in the amount of $100,000.00 of
which $76,000.00 will be utilized to pay-off the First National
Bank of Greeley and $24,000.00 to complete the development for
the remaining portion of Pinnacle Park.
The loan will be for a period of 12 months with an interest
rate of 10% which is to be paid semi-annually.
We also will require a 1% loan fee in the amount of $1,000.00
to be paid upon acceptance of this commitment.
The loan is to be secured by the remaining 16 lots in Pinnacle
Park along with your residence at 16581. Hwy, 392, Greeley,
Colorado, plus approximately 9.36 acres, However, we cannot
advance any funds on the loan until you provide the United
Bank of Greeley a Plat approved by the Weld County Commissioners
on the 16 lots. We will release each individual lot for an
agreed sum of $11,500.00 as we previously discussed.
We trust that this commitment is satisfactory and if you find
it acceptable, kindly acknowledge so by signing below and
returning within 10 days along with the check for the loan
fee of $1,000.00

Gentlemen:
Pinnacle Park-Third Filing is a continuation and final platting of the
remaininG tract of laud in this development. She irel-iminary Plat on the
total area was submitted in Parch, 11966. The Fret!ni ary Plat has been
revised to reflect the existing conditions and thin'cing of the planning
staff in regards to the road system asd to sect the current rej;ulationa.
The total area of this filing is 47.02_ Acres ai,i 16 lots of approximately
2 1/2 Acres each are proposed. These will be sin"lc family residential
units and comply with the zoning which was r:ecentl_y changed to "IP Estate.

ground for rubbish nor shall any salvage operation of any nature be permitted.
A-8. SUBDIVIDING LOTS. No lot shall be further subdivided than as shown
on the plat of said area.

PART B. GENERAL PROVISIONS
B-L TERM. These covenants are to run with the land and shall be binding on
all parties and all persons claiming under them for a period of twenty-five years
from the date these covenants are recorded, after which time said covenants shall
be automatically extended for successive periods of ten years unless an instrument
signed by a majority of the then owners of the lots has been recorded, agreeing to

There is very little information to review. A final
set of plans should be submitted with all required
information and computations.
Problems may arise in drainage as the development
grows to the north . The stub streets in this and
other filings show this intention and I do not see
how drainage is to be handled.
What is the purpose of the ditch that runs north and
south through the development , what will happen to it ,
and what effect will it have on the stub street shown .
Is there any agreement with the No. 2 Ditch Company to
handle runoff .
What is the proposed road cross section , profile , and
what is the pavement design .
I understand that a variance from paved streets might
be requested. Mr . Smith and I feel we should abide by
County standards . If the developer feels otherwise
he should submit a written request to the Engineering
Department .
The ownership and maintenance of the stub street should be
made clear in order to avoid future problems .
If the developer or his engineer has questions regarding
these or other design problems prior to final submittal
have him contact me .

Our office received copies of a letter dated April 12, Z977
from Mr. George W. Hoecher requesting waving the asphalt
surfacing requirement for Pinnacle Park, Third Filing.
The Engineering Department is not in favor of waving paving
requirements . However, we will not protest such a decision
if the Planning Commission 's recommendation to the commissioners
is that the request is justified in this case .
Westrongly feel a precedent, by which future developers may
request special consideration, not he set. If paving is not
required it should be documented that Weld County has no
intention of doing so in the future. That should be made clear
in the dedication acceptance procedure and possibly on the
recorded plat.

We have reviewed the preliminary plat and supporting information on the referenced
subdivision. The preliminary soils and geology investigation report, prepared by
Empire Laboratories, Inc. , adequately describes the geologic and soils conditions
which may adversely affect subdivision development.
Percolation rates generally are acceptable for standard leach field construction;
however, a relatively shallow ground water table in the subdivision area could
' affect leach field construction. Because water table measurements may have been
obtained when the elevation is at a minimum, we recommend that test pits be
excavated to ascertain the maximum water table elevation. If the distance between
the maximum water table elevation and proposed leach field depth is less than
4 ft, effluent could be directly discharged into the ground water aquifer and
into Greeley Canal No. 2. If this is the case, we strongly recommend that an
alternate sewage disposal system be used in the development.
In conclusion, the Empire report adequately describes adverse geologic conditions
in the subdivision area. The recommendations contained in this report should be
followed closely during construction. We strongly recommend that on-lot septic
systems be further evaluated before this application is approved.

This will acknowledge your request for comments on Pinnacle Park-third filing,
George Hoecher, Preliminary Plat.
We have reviewed previous plans for the subdivision and a few problems were
noted on those reports . One problem that concerns the board is the effect of
livestock grazing intensities being provided by the covenants . They establish a
maximum of four (4) animals per acre, which means that 13. 6 head of animals may be
kept on the largest lot and 8.8 head could he kept. on the small 2.2 acre lot. This
definitely brings up the point of proper grazing use and peroanant vegetation pro-
tection for the soil surface. As mentioned in the previous report , both soil types
on the subdivision area are very susceptable to wind erosion when the surface is
exposed. We believe a better method for calculating maximum number of livestock
allowed should be based on amount of forage production and forage requirements of
animals to be kept. This would provide better land protection and indicate to the
land owner the amount of forage he would need to adequately maintain his animals .
Livestock numbers do not necessarily denote forage needs unless it in referenced by
the class of livestock. The covenanats should stress soil cover and protection by
specifying minimum grass stubble height after grazing season rather than number of
livestock.
A tile drain system has been installed to lower the water table within the
subdivision to allow for septic tank installation.

Neither a surface drainage or erosions control plan was submitted as part
of the preliminary plat. Comments as to adequacy of these plans cannot be
made . We would like to see the developer prepare a surface drainage plan which p�p
will provide for safe elimination of surface runoff through correctly designed
r
outlet systems . A dike could be constructed and graded to carry water to speci-
fic outlet structures with appropriate sediment entrapment features . This would
eliminate excess sediment leaving the site during the development and construc-
tion stage. An erosion control plan,should be prepared to show provisions for
wind erosion control when vegetation is too depleted to provide adequate soil
cover.
There are no outside drainage areas traversing the subdivision to cause
flooding problems. The surface drainage should ba adequately handled by pro-
perly designed roadside ditches, culverts and crossings .
