HomeMy WebLinkAbout20131937.tiffMEMORANDUM TO: Kim Ogle, Planning Services DATE: June 4, 2013 FROM: Jennifer Petrik, P.E., Public Works Department SUBJECT: USR13-0028, Kerr McGee/Anadarko Vollmar Compressor Station A Use by Special Review permit for a natural gas compressor station. The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 22 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 - foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. An access permit has been approved for three access points to the site (AP13-00073). Discussions with the applicant indicate the approved access points may not meet the needs of the site. The applicant has been directed to contact the Traffic Engineer, Janet Carter at 970-304-6496x3726 to discuss changes to the approved accesses for this project. The traffic information provided with the submittal states that the site (at build out) will be unmanned and will be visited by one employee per day in a pickup truck for a length of 2 hours. During construction, there will be 30-40 personnel with large vehicles, cranes, concrete trucks, etc... Access improvements are required and shall include 60ft radii to accommodate turning trucks and double cattle guards across the accesses to prevent the tracking of mud onto the County maintained gravel roadway. A right of way permit is required for any work within the County right of way. A special transport permit is required for over length, width, height, or weight vehicles. Adjustments to the design are required to meet state water law. Please contact Public Works Development Review Engineer with questions at 970-304-6496. Label the water quality feature on the plat as "Water Quality Feature, No Build/Storage Area" and label the required volume. An Improvements Agreement between the Applicant and the County will be required for this project. It will detail the approved haul route(s), any onsite and offsite requirements, and a maintenance agreement for the haul routes. Road maintenance after construction is not required for this site due to the minimal traffic stated in the application (1 pickup truck/day). This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). Plat shall be amended to delineate the following: 1. County Road 22 is designated on the Weld County Road Classification Plan as a local roadway, which requires 60 feet of right-of-way at full build out. The applicant shall verify the existing 60 feet of right-of-way and the documents creating the right- of-way and this information shall be noted on the plat. All setbacks shall be measured from the edge of right-of-way. If the existing right-of-way cannot be verified, it shall be dedicated. This road is maintained by Weld County. 2. Show the approved accesses on the Plat and label with the approved access permit number. 3. The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is dedicated, private, or deeded. 4. Show and label the tracking control and turning radius at the site accesses. 5. Delineate the water quality feature(s) on the plat and label as "Water Quality Feature, No Build/Storage Area". B. The applicant shall provide an accepted water quality design. C. The applicant shall enter into an Improvements Agreement According to the Policy Regarding Collateral for Improvements and post adequate collateral for all transportation (access drive, parking areas, et cetera) and non -transportation (fencing, screening, drainage, et cetera). The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. Road maintenance requirements including dust control, and damage repairs for improvements will be a part of the agreement. Road maintenance agreement will be required for construction only. 2. Prior to Construction: A. In the event that 1 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. B. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction. The grading permit application must contain: an erosion and sediment control plan, a grading plan, installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be utilized, and a copy of the approved CDPHE stormwater permit. Development Standards (notes on the plat): 1. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. 2. Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete, recycled asphalt or recycled concrete and shall be graded to prevent drainage problems. The historical flow patterns and runoff amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. 4. The applicant must take into consideration storm water quality and provide accordingly for best management practices. 5. Weld County will not maintain on -site drainage related areas or medians. This must be addressed by the homeowner's association or owner. 6. There shall be no parking or staging of vehicles on County roads. On -site parking shall be utilized. The site will be unmanned, although there will be an employee that visits the site on a daily basis. The applicant is proposing to provide portable toilets and bottled water. During the construction phase water trucks will be utilized to control dust. After construction is complete, the site will be stabilized with native vegetation, access drives and inner roads will be graveled, and the applicant will contract a water truck if necessary to control dust. The waste handling stipulates a dumpster will be provided and serviced by Waste Management. Waste oils and coolants will be removed by Meso Oil for recycling. A Spill Prevention, Control and Countermeasure Plan (SPCC Plan) template has been developed and will be finalized when construction is completed. A signed copy of the plan shall be kept on site at all times. Storage tanks will be enclosed within secondary containment. Noise may be regulated by the Colorado Oil and Gas Conservation Commission. The use of berms, sound walls and enclosing equipment in a sound proof building could be utilized to limit noise impacts if necessary. The applicant will need to submit a noise abatement plan. The applicant provided copies of their APEN application to the Colorado Air Pollution Control Division (APCD). The applicant will need to submit documentation from the APCD of their air permit approval. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment to Environmental Health Services Division of the Weld County Department of Public Health & Environment. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2. The applicant shall submit a noise abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. We recommend that the following requirements be incorporated into the permit as conditions that must be met one month prior to construction activities: 1. A State stormwater discharge permit may be required for a development / redevelopment / construction site where a contiguous or non-contiguous land disturbance is greater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit for application more information. We recommend that the following requirements be incorporated into the permit as development standards. 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. Adequate drinking, handwashing and toilet facilities shall be provided for 2 employees and patrons of the facility, at all times. As employees or contractors are on site for less than 2 consecutive hours a day portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code, or with all applicable State noise statutes and/or regulations. 8. The operation shall comply with all applicable rules and policies regulated by the Colorado Oil and Gas Conservation Commission. 9. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 10. The facility shall comply with the Air Pollution Emission Notice (A.P.E.N.) permit requirements as stipulated by the Air Pollution Control Division, Colorado Department of Public Health and Environment, as applicable. 11. The signed Spill Prevention, Control and Countermeasure Plan shall be available on site, at all times. 12. The applicant shall comply with all provisions of the State Underground and Above Ground Storage Tank Regulations. 13. The applicant shall obtain a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, as applicable. 14. A building permit application must be completed and two complete sets of engineered plans including engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted. A geotechnical engineering report performed by a registered State of Colorado engineer shall be required or a open hole inspection. Buildings, equipment and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2012 International Building Code; 2012 International Mechanical Code; 2012 International Plumbing Code: 2012 International Energy Code; 2006 International Fuel Gas Code; 2011 National Electrical Code; 2009 ANSI 117.1 Accessibility Code the 2012 International Plumbing Code and Chapter 29 of the Weld County Code. A plan review shall be approved and a permit must be issued prior to the start of construction. Fire extinguishers must be located inside all occupied buildings. Travel distance to an extinguisher in the office area cannot exceed 75' in the business office. Extinguisher size and type need to meet the requirements of NFPA 10. 2. Copies of all MSDS sheets shall be provided on site upon request. 3. Fire Department approval is required for fire detection/suppression systems. 4. Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire apparatus. All fire apparatus access roads must have a surface to provide all- weather driving capabilities. The fire department will need to have access that goes around all areas of parking and the office. 5. The address must be placed on the business and in a position that is clearly visible from the street fronting the business. Address numbers need to be a minimum of 4 inches high, have a 3/4 inch stoke, and they need to be on a contrasting backboard. Sites having multiple outbuildings shall identify each separate building by a letter or number and post that identifying marker on that building using the same requirements as above. 6. Fort Lupton Fire Protection District will need to be contacted to conduct a fire safety inspection prior to the start of business in the new structure. Hello
