The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 32 and 3 are local gravel roads and require a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. These roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right- of-way line. Access is off of CR 32. The Average Daily Traffic was 87 in 2012. An access permit application was submitted. Please supply the missing information for a complete application. a. The application fee of $75 b. Traffic control plan (example can be found on the PW website) http://www.co.weld.co. us/Departments/Pu blicWorks/Permits/Appl ications.html The Traffic Engineer will review the application and assign an access permit number for any approved accesses to the site. Please label on the plat approved accesses with access permit numbers. For questions on the access permit please contact the Traffic Engineer, Janet Carter at 970-304-6496. A traffic narrative was submitted and indicates it is anticipated there will be 6 people per day which includes employees and customers initially and hope to grow to 29 people per day. A 25' radius is required on all accesses to public roads to accommodate passenger vehicle traffic. A water quality feature is required to capture and treat stormwater runoff associated with the development prior to flowing off site onto adjacent properties or downstream water ways. A water quality feature has been included in the site design. Please contact Public Works for assistance with sizing the water quality feature. Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from extending beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or plantings. Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete, recycled asphalt or recycled concrete and shall be graded to prevent drainage problems. An improvements agreement is required for all onsite improvements. Public Works will provide a draft of the agreement after the Board of County Commissioners hearing for this project. An example Improvements Agreement is available on the County Planning website under Application Assistance. If improvements are completed prior to recording the plat to the satisfaction of Weld County Staff, the improvements agreement and collateral may not be required. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction. The grading permit application must contain: an erosion and sediment control plan, a grading plan, installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be utilized, and a copy of the approved CDPHE stormwater permit. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Show on the Plat: a. County Road 3 and 32 are designated on the Weld County Road Classification Plan as local roadways, which requires 60 feet of right-of-way at full build out. The applicant shall verify the existing 60 feet of right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. All setbacks shall be measured from the edge of future right-of-way. If the existing right-of-way cannot be verified, it shall be dedicated. This road is maintained by Weld County. b. Show the approved accesses on the Plat and label with the approved access permit numbers (will be provided). c. Show on the plat a 25ft radius access and parking wheel stops. d. Delineate the water quality feature(s) on the plat and label as "No Build/Storage Area". Label the volume of the water quality feature(s) on the plat. 2. Before recording the Plat: a. The applicant shall enter into an Improvements Agreement According to Policy Regarding Collateral for Improvements and post adequate collateral for all transportation (access drive, parking areas, et cetera) and non -transportation (fencing, screening, drainage, et cetera). The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. The applicant may submit evidence that all the work has been completed and reviewed by the Departments of Planning Services and Public Works. 3. Before Construction: a. In the event that 1 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. b. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction. Add the following notes to the plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. b. Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, recycled asphalt base, concrete or the equivalent and shall be graded to prevent drainage problems. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. d. The applicant must take into consideration storm water quality and provide accordingly for best management practices. e. Weld County is not responsible for the maintenance of onsite drainage related features. C:AUsers\kfordAAppDataALocalAM icrosofl\W indows\Temporary Internet Files\ Low VContent.IE5\32TCUENI\USRI3-0024_chi Ids_kennel[1 t.docx MEMORANDUM TO: Diana Aungst, Planning Services FROM: Lauren Light, Environmental Health SUBJECT: USR13-0024 Robert Ehrlich DATE: May 28, 2013 Environmental Health Services has reviewed this proposal for a site specific development plan and use by special review permit for a kennel (75 dog boarding kennel and 25 doggie day care for a maximum of 100 dogs) and any use permitted as a use by right, an accessory use, or a use by special review in the commercial or industrial zone districts, (retail sales of dog food, supplies, and toys) in the A (Agricultural) zone district Water will be supplied by Longs Peak Water District. The application states that at full capacity the kennel could have six employees. There will also be clients who come to the site and they must have access to potable water, restroom and hand washing facilities. An engineer designed septic system will be installed for kennel usage and shall be sized for grooming and veterinarian services as well. The application indicates that waste will be cleaned from the kennel on a daily basis and placed in a covered dumpster which will be picked up at least weekly by Western Disposal or another local company. No information was provided regarding waste from the veterinarian office. The dust abatement plan states that dog runs will be covered with pea gravel and internal roads and parking areas will be gravel or road base. The plan should also contain a statement that water will be utilized for dust control if necessary. Noise will be restricted to the level allowed in the non -specified zone district. The application states that the kennel building will be insulated and all dogs will be inside at night. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: The following requirements are recommended to be met prior to allowing the plat to be recorded: 1. The applicant shall resubmit a dust abatement plan that includes, "watering as necessary", to Environmental Health Services, Weld County Department of Public Health & Environment. 2. The applicant shall provide written documentation that a license under the Pet Animal Care Facilities Act (PACFA) has been issued. The documentation shall be submitted to Environmental Health Services, Weld County Department of Public Health and Environment. 3. The applicant shall resubmit a waste handling plan, to Environmental Health Services, Weld County Department of Public Health & Environment. The plan shall incorporate at a minimum, the following: How chemicals, drugs and animal carcasses from the veterinarian office will be disposed of. The name, address, and phone number of the waste handler and facility where disposal will occur shall be included. We recommend that the following requirement be incorporated into the permit as a condition that must be met prior to the issuance of the Certificate of Occupancy for the kennel facility: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed weekly from the facility and disposed of by a commercial hauler. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for 2 final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. The applicant shall comply with the Colorado Department of Agriculture (CDA), Division of Animal Industry. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Non -specified Zone as delineated in Section 14-9-30 of the Weld County Code. . 8. Adequate drinking, handwashing and toilet facilities shall be provided for employees and clients of the facility, at all times. 9. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the existing public water supply. (Longs Peak Water District) 11.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 12. A building permit application must be completed and two complete sets of engineered plans including engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted. A geotechnical engineering report performed by a registered State of Colorado engineer shall be required or a open hole inspection. Buildings, equipment and structures shall conform to the requirements of the various codes adopted at the time of permit application. The Fire District will make the following comments with regard to this use: • All buildings shall be designed and constructed in accordance with the provisions of the International Fire Code, as ratified by the Weld County Commissioners. • In accordance with the International Fire Code, water supply for fire protection is required for this use. The largest structure appears to be approximately 3,375 square feet. The required fire flow for the building is 1,500 gallons per minute, measured at a residual pressure of 20 pounds per square inch. A letter must be provided to the Fire District from the water supplier that this water supply is available to the property. All fire hydrants used to meet the required water supply shall be within 600 feet of the building as measured along approved fire apparatus access routes around the exterior of the building; and, at least one fire hydrant shall be located such that it is within 450 feet of all portions of the buildings. • Fire apparatus access will need to be provided to all structures so fire apparatus may reach to within 150 feet of all portions of the buildings. Apparatus access roads shall be a minimum of 20 feet in width and be designed and maintained to support the imposed loads of fire apparatus (75,000 pounds). Roads must have a surface that provides all-weather driving capabilities and be free from obstructions which includes locked gates, unless otherwise approved.
