RESOLUTION
RE: GRANT OF CHANGE OF ZONE FROM E - ESTATE DISTRICT TO C -
COMMERCIAL DISTRICT FOR D. REA SCUDDER.
i
WHEREAS, the Board of County Commissioners of Weld County,
Color-ado, pursu-ant to Colorado -statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Color-ado, and
WHEREAS, a public hearing was held on the 1st day of
F-ebruary, 1978 at 2:00 o'clock p.m. for the purpose of hearing
the petition of D. Rea _cudder, 2605 1st Avenue, Greeley,
Colorado 80631, r-equesting a change of zone from E -state District
to C-Commercial District for the following described Parcel of
land, to-wit:
Part of the-Southeast Quarter (SE'') of Section 17,
Taanship 5 North, Range 65 West of the 6th P.M.,
Weld County, Colorado, being more particularly
described as follows:
Beginning at the Southeast Corner (SE Cor) of said Section 17,
and considering the East Line of the Southeast Quarter (SE')
of-said Section 17, as bearing North 00°15'10" West, with all
other bearings contained herein relative thereto;
Thenc-e North 00°15'10" West, along said East Line 1005.43 feet
to the True Point of Beginning;
Thence continuing North D0°15'10" West, 331.85 feet;
Thence North 89°19'30" West, 380.64 feet;
Thence South 02°44'00" East, 156.70 feet;
Thence South 0117'30" East, 159.00 feet;
Thence South 07°06'00" East, 16.90 feet;
Thence South S9°22'00" East, 368.95 feet tO the True
Point of Beginning.
Said described parcel of land contains 2.854 acres,
more or less.
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of the
petitioners for a change of zone upon the aforementioned tract
of land, and
WHEREAS, Section 8.2 and 8.3 of the Weld County Zoning
Resolution authorizes the Board of County Commissioners to grant
a change of zone upon the showing by the petitioner of certain
facts, and

WHEREAS , the -Board of County Commissioners heard all the
testimony and statements of those present, has studied the re-
quest of the petitioners and the recommendations of the Weld
County Planning Commission, and having been fully informed and
satisfied that the request for rezoning complies with the Weld
County Comprehensive Plan and the conditions set out in Section
8. 2 and 8. 3 of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the petition of
D. Rea Scudder for a change of zone from E-Estate District to
C-Commercial District on the above-described tract of land, be,
and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated December 20, 1977 , be, and hereby are, incorporated as
the findings of fact of the Board of County Commissioners in
this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 1st day of
February, A.D. , 1978.

I hereby certify that pursuant to a notice dated December 28 ,
1977 , duly published December 28 , 1977 and January 18 , 1978 in
the Greeley Journal, a public hearing was held on the request
of D. Rea Scudder for a Change of Zone from E-Estate District to
2 Commercial District. Ms. Scudder was present as was her
real estate broker, Doug Sears. They made the request for
the COZ and answered questions for the -Board. After discussion,
Commissioner Jacobucci made a motion to grant the COZ . Commis-
sioner Roe seconded the motion and it carried unanimously.
Commissioners Jacobucci and Roe and Chairman Dunbar were present
for the hearing. Commissioners Carlson and Steinmark were
absent.

Be -it Resolved by the Weld County Planning Commission that the appli-
cation for rezoning from E ( Estate District) to
C ( CommereAga DistnrcHl covering the following described
property in Weld tout, Colorado, to-wit:

be recommend (favorably) (rkh]f%KNMxX) to the Board of County Commissioners
for the following reasons:
1 . It is the opinion of the Planning Commission that the applicant
has complied with Sertion B. 3 of the weld County Resolution which
states : "Request for rezoning of tracts within Weld County should
be supported by detailed and substantial evidence that such
rezoning is necessary. Recent findings and oral statements by
petitioners should show very clearly that either the original zoning
was faulty or that changing conditions in the area now justify a
new classification. Without the presentation of such supporting
documentation, the County Planning Commission should not recommend
a change of zoning. "
It is -the opinion of the Planning Commission that the applicant has

2. The rezoning request agrees with the policies contained within
the Weld County Comprehensive Plan in that the request for
commerei-al development is in compliance with the use designation
for this area as outlined in the Greeley Comprehensive Plan.
3. The Greeley Planning Commission has recommended this rezoning
request be approved since the proposed commercial use agrees
with the City's Comprehensive Plan.
4. The City of Evans Planning and Zoning Commission indicated they
recommend the rezoning request be approved.
5. The Weld County Health yep artment has indicated they havo to
objections provided the developercomplies with the stipulations
indicated in their letter dated December 9, 1977.
6. The State Department of -Highways has indicated they have no
objections to the rezoning.
7. The Weld County Engineering Department has indicated they could
not identify any problems with the rezoning request.
8. The Greeley Irrigation Company has indicated they have no
objections to the proposal.
9. To date, our office has not received any opposition to this
request from any of the surrounding property owners.
The Planning Commission recommendation for approval is subject to a
6' chain link fence and security gate constructed around the
perimeter of the property for safety reasons. The fence would
prevent children from gaining access to State Highway 85 from the
facility and also it would prevent children from utilizing the
facility when supervision is not present .
Comment :
The Planning Commission is concerned with the lack of pedestrian
access to the facility.

ANSWERS BY THE PETITIONER TO QUESTIONS ATTACHING TO REZONING APPLICATION
1 . Because the subject land is adjacent to South First Avenue, which
presently is a county arterial highway servicing industrial and
commercial traffic , and is adjacent to U. S. Highway 85, it would be
both impractical and undesirable to develop subject land as it is
now zoned.
2. The proposed rezoning will benefit all of Weld County because it
will allow for commercial usage compatible with the neighborhood
and the area.
3. The City of Greeley has officially recognized the appropriateness
of industrial and commercial usage in the entire area in which this
subject parcel is situated.
4. The physical features and location of this property, as well as with
immediately surrounding properties , appear most suitable for the zone
being requested.
5. Other areas in the county already zoned "C" are not deemed by this
petitioner to be unsuitably zoned. The fact is , that there is now
insufficient "C" zoned land in Weld County, especially in near
proximity to Greeley.
6. Both Weld County and Greeley planners have designated this area for
future commercial and industrial development.
7. This property has been listed for sale since October 20 , 1976. Two
offers have been generated , both subject to rezoning to "C". The
-developer's plot plan , attached to this application , graphically
displays the intended use. This facility will be the first of its
kind in Weld County, so, its economic market is untested.
8. Evidence is attached depicting intended use. Construction is
contemplated in 1978.

Enclosed are 11 prints of the Site Tianfor the proposed Greeley Skatepark.
The site is basically flat but has a slight fall to the Northeast corner. We
have proposed the drainage to flow toward the No. 3 Canal on the South of the
property where the water can be disposed of after the storm.
The site plan shows the proposed office building and a parking area for 50 cars,!
The actual layout of the skatepark of course is to be done by the consultants
in California.
If there are any questions concerning the drainage or utilities, we would be happy

to skate-board.

Re : Scudder Rezoning , 2605 First Avenue
At its last regular meeting en December 13, 1977 , the Greeley
Planning Commission reviewed the rezoning from Estate to Commer-
cial for property located at 2605 First Avenue . The Commissioners
recommended that they had no objections to the proposed rezoning .
Their vote was based upon the compatibility of the County ' s
Commercial district with the I- 2 (Medium Industrial ) district
that is proposed for the surrounding properties in the S . E . Greeley
Industrial Annexation. The Commissioners did, however, express
concerns related to the timing of the proposed skate park develop-
ment and to the location of the proposed skate hoard park .
Staff had noted that the property will he surrounded by the City
and should therefore be developed in the City in order to avoid
conflicts in public safety service delivery . In addition , concerns
were noted for the location of a high density youth oriented
facility located in an area where many users will be forced to
walk across U . S . 85 Bypass and along First Avenue , an industrial
collector .

TO WHOM IT MAY CONCERN:
The Change of Zon-e from "E" to "C11 as requested by D. Rea Scudder
meets with this department 's approval with the following stipulations :
1 . No septic permit shall te issued if a community
sewer exists within 400 feet of proposed establishment.
If a community sewer does not exist within 400 feet
of said establishment, then a septic permit may be
issued provided the septic system is engineer designed
and it (the design) meets with Board of -Health approval .
2. Any discharge from the retention pond will require a
water discharge permit.
3. Any food preparation (excluding vending machines) will
require a state food service license. -Also, any
construction plans for a kitchen shall -be submitted to
this department -prior to construction.
