Explain, in detail, the proposed use of the property. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. 4. What type of uses surround the site (explain how the proposed use is consistent and compatible with surrounding land uses). 5. Describe, in detail, the following: a. The proposed use of the 40x50 pole barn is a personal training facility. We take people through workouts and teach them how to be healthy. 2. This proposal is consistent with the intent of the following sections of the Weld County Code, Chapter 22: 1. Section 22-2-1OB, "to protect the rights of the private property owners to convert their agricultural lands to other appropriate land uses". 2. Section 22-2-10E- In keeping with the intent of the preamble of the Weld County Charter "to provide uncomplicated, unburdensome government, responsive to the people, "development in rural areas provides opportunities for land divisions that are exempt from the subdivision regulation and allows land use by small agricultural operations and home businesses. These lots retain the agricultural designation and support a high quality rural character, while maintaining freedom from cumbersome regulations. Our home business looks exactly like it did when we bought and is similar in appearance to many of the properties around it. 3. Section 22-2-20D- Promote a quality environment which is free of derelict vehicles, refuse, litter and other unsightly materials. Section 22-2-20G- County land use regulations should protect the right of the individual property owner's right to request a land use change. We are requesting a land use change. Policy 7.2- Conversions of agricultural land to non -urban residential, commercial and industrial uses should be accommodated when the subject site is in an area that can support such development, and should attempt to be compatible with the region. Our property is in an area that can support a small personal training facility. Our appearance is compatible with the region and we provide a valuable service to the local community by providing a means for a healthier, productive lifestyle. 3. This proposal is consistent with the intent of the following sections of the Weld County Code, Chapter 23: 1. Preamble- "The A zone district is intended to provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other, incompatible land USES. The A Zone district is intended to provide areas for the conduct of USES by Special Review which have been determined to be more intense or to have a potentially greater impact than USES Allowed by Right. The A Zone regulations are established to promote the health, safety and general welfare of the present and future residents of the county." Per the conversations we've had with our neighbors, our home business is compatible with the properties around it. We provide a service that promotes the health, safety and general welfare of present and future residents of the county. 2. 23-3-40W- USES similar to the USES listed above by Special Review as long as the USE complies with the general intent of the A Zone District. Our home business is similar to many of the USES listed in Chapter 23, but makes less of an impact then many of those USES, including, but not limited to: a. Animal boarding where an excess of 60 trips per day is permitted b. Rodeo Arenas c. Roping arenas, race tracks and race courses d. Drive in theatres e. Golf courses f. Shooting ranges g. Guest farms and hunting lodges h. Schools i. Kennels 4. Our property is surrounded by A Zone district that ranges in size from less than half an acre to over 100 acres. The proposed use is compatible and consistent with the surrounding land uses because the appearance is similar and we've spoken with all neighbors with in a quarter mile. 5.0n average, we have about 20 people visit our shop per day, however, in the future we could see as many as 50 per day. They visit in groups as small as 1 and as many as 12, with the average being 5-6. People are here for about an hour at a time based on the schedule, and then they leave. Including ourselves, we have five coaches, though there is only one coach present for each class. We currently have classes Monday through Saturday. Monday through Thursday we have a 5:30am class, a 4:00pm class and a 5:15pm class. On Monday, Wednesday and Friday, we have additional classes, one at 8:30am and one at 6:30pm. On Saturdays, we have one class at 8:30am. As soon as people arrive, we take them through a warm up, then the workout. They're in and out in an hour. People drive passenger vehicles and park on our lot, which has room for about 18 vehicles. The primary lot is located on the east side of the gym, shielding the lot from the road. Our primary vehicle lot has more room than we generally need and is screened from County Road 37 by the pole barn. 7.Not applicable 8.The house has been here since 1979 and the pole barn since 2010. To our knowledge, storm water drainage has never been a problem. We've lived here since December 2012 and don't have any standing water after storms. On the East side of the lot, water drains from North to South. There is low spot on the Southwest side of the lot that has a drain. On the West side of the lot, water drains west and south to the barrow ditch, which runs congruent to County Road 37. 9.The pole barn was here when we purchased the property and we have no intention of erecting any other structures. 10. No other structures will be erected s dust mitigation in the event of construction isn't needed. The entire lot used by the business is covered with gravel and in some cases both road base and gravel. The traffic on the lot isn't off sufficient load to cause a a significant amount of dust, however, if there was an issue, we would use a water truck to mitigate it Waste Management Plan Very little waste is expected to be generated by the business. No chemicals will be stored on site. The trash cans for the business are located on the east side of the residence, out of view from any traffic. There are three standard household trash cans that range in size from 30 gallon to 90 gallon. Trash removal is handled by Ram Waste. They pick up the trash on Thursdays. Regarding a motor vehicle oil leak, we will dig up the contaminated oil and deliver it to the Ault Waste Management Facility.
