RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #1734 - JIMMIE AND
TAMARA JAMES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated June 9, 2010, the Board did approve the request of Jimmie
and Tamara James, for a Site Specific Development Plan and Use by Special Review Permit #1734
for a Home Business (feed distribution business) in the A (Agricultural) Zone District, on the
following described real estate, to -wit:
Lot A of Recorded Exemption #2158; being part of
the E1/2 SE1/4 of Section 29, Township 2 North,
Range 63 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the current property owners Jimmie and
Tamara James, 7033 County Road 65, Keenesburg, CO 80643, to vacate said Use by Special
Review Permit #1734, and
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit #1734 be, and hereby is, vacated.

Date: March 5, 2013
The Department of Planning Services received an electronic mail from Tammy James on
Monday March 4, 2013 requesting vacation of the Site Specific Development Plan and Use by
Special Review Permit #1734 for a home business (Feed Distribution Business) in the A
(Agricultural) Zone District approved by the Board of County Commissioners on June 9, 2010.
The USR Map was recorded September 15, 2010 under reception number 3718762.
The applicant is requesting this action as the James' are selling the property and the new buyer
and their lender have concerns with the current permit on the property.
On behalf of the applicant, the Department of Planning Services requests support of the request.

Kim,
We Jim and Tammy James would like to vacate our U5R-1734. We no longer have
distribution business.
If possible we need this done as soon as possible, we are selling our home and the
4/2. Their lender would like some sort of proof that the USR doesn't affect the
of the home.
