BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
OCTOBER 10, 2013
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Administration Building, Greeley, Colorado, October 10, 2013, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner William F. Garcia, Chair
Commissioner Douglas Rademacher, Pro-Tem - EXCUSED
Commissioner Sean P. Conway — BY PHONE

Ej AMENDMENTS TO AGENDA: Chair Garcia added Item #2) Consider Intergovernmental
Agreement for Provision of Mutual Aid during Disaster Emergencies and authorize Chair to sign —
Mesa County, under NEW BUSINESS.
NEW BUSINESS:
1) CONSIDER AGREEMENT FOR THE PROVISION OF A TEMPORARY CONSTRUCTION
EASEMENT FOR RECONSTRUCTION OF A PIPELINE, ACCEPT COLLATERAL, AND AUTHORIZE
CHAIR TO SIGN - ROCKY MOUNTAIN PIPELINE SYSTEM, LLC: Stephanie Arries, Assistant County
Attorney, explained this pertains to reboring and reinstalling a pipeline which is now floating in the St.
Vrain River near the Hoekstra Pit. She said this agreement includes a bond for $1.5 million to ensure
against damage to the slurry wall and Rocky Mountain has made every effort to accommodate Weld
County and would like to get started tomorrow. In response to Commissioner Kirkmeyer, Ms. Arries
confirmed the base of the river washed out in the recent flood event, leaving the pipeline exposed.
Commissioner Conway moved to approve said agreement and authorize the Chair to sign. The motion
was seconded by Commissioner Freeman, and it carried unanimously.

2) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR PROVISION OF MUTUAL AID
DURING DISASTER EMERGENCIES AND AUTHORIZE CHAIR TO SIGN - MESA COUNTY: Bruce
Barker, County Attorney, said that Mesa County has trucks and crews for bridge and road repairs in
route. He said this agreement will include reimbursement after an accounting of their time and money
spent. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign.
The motion was seconded by Commissioner Freeman, and it carried unanimously. Commissioner
Conway thanked Mesa County, and all the counties, for their help with flood recovery, and Chair Garcia
and Commissioner Freeman concurred.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was recessed at 9:20 a.m., to be reconvened on Friday,
October 11, 2013, at 9:00 a.m.
