RE: APPROVAL OF RECORDED EXEMPTION NO. 311 - MELVIN F. AND MARTHA
E. HOWARD.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 3rd day of April, 1978 , in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the plat
known as Recorded Exemption number 311, being the property of
Melvin F. and Martha E. Howard, described as Part of the E'NE4NEi
Section 16 , Township 5 North, Range 65 West of the 6th P.M. , Weld
County, Colorado, being more particulary described as follows :
A parcel of land located in the East Half of the Northeast
Quarter of the Northeast Quarter of Section 16, Township 5
North, Range 65 West of the Sixth Principal Meridian, Weld
County, Colorado, said tract of land being PARCEL. "B" of
MINOR SUBDIVISION NO. 0961-16-1-MS-12 as recorded on
November 27, 1972 under Reception No. 1602495, Weld County
Records, and being more particulary described as follows:
Commencing at the Northeast Corner of said Section 16 and
considering the North line of said Section 16 to bear North
89°39'36" West with all other bearings contained herein
being relative thereto;
Thence North 89°39'36" West along said North line 533.88
feet to the Northwest corner of PARCEL "A" of said
MINOR SUBDIVISION NO. 0961-16-1-MS-12;
Thence South 00°15'17" West along the West line of said
PARCEL "A", 330.00 feet to a point on the North line of
said PARCEL "B", said point being the True Point of
Beginning;
Thence around the perimeter of said PARCEL "B" by the
following seven courses;

is subject to reservation for a roadway 30.00 feet in width as
shown along the East line of the above described parcel.

Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Melvin F. and Martha E. Howard, be and
hereby is , exempt from the definition of the terms , "subdivision"
and "subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended, subject to the requirements
of a dedicated Right-of-Way as per the request by the City of
Greeley, Colorado.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 3rd day of
April, A.D. , 1978.

Dear Commissioners :
The attached application, plat and related items are in reference
to a request by Mr. & Mrs. Melvin Howard for a recorded exemption .
The parcel of land is described as Pt . EINE*NE4 Section 16 , T5N,
R65W of the 6th P.M. , Weld County, Colorado . This property is
located approximately 3/8 miles south of East 18th Street (U.S .
34) on the west side of Cherry Avenue. The subject property con-
tains 10. 648 acres of Estate Zoned property. The request is to
split the property into parcels of 3 . 500 acres and 7 . 148 acres.
The 10. 648 acre parcel was created as Parcel B of Minor Subdivi-
sion #12 which was approved by the Board of County Commissioners
on November 22 , 1972 .
The Howards currently reside on the 7. 148 acre parcel where there
is an existing set of improvements. Their stated intent is to
split off the 3. 500 acre parcel which will be used for a residen-
tial building site if their request is approved.
Based upon the information submitted and the adopted policies in
the County, the Department of Planning Services Staff recommends
the request be approved for the following reasons :
1 . The City of Greeley Planning Commission has indicated
they have no objections to the granting of this re-
quest which lies within their comprehensive plan area.
2 . The request agrees with the policies contained within
the Weld County Comprehensive Plan in that the request
for residential use is in compliance with the City of
Greeley' s comprehensive plan.

3 . The request complies with the provisions of Section
9-4(A) of the Weld County Subdivision Regulations .
The City of Greeley is requesting that a right-of-way dedication
be made on the east side of the property if possible under the
recorded exemption procedure .

off of Cherry Avenue, provided the conditions stated in the January 11
letter from Pete Morrell to you are satisfied .
In order to provide domestic water service, the 4" line could be tapped
in Cherry Avenue and a fire hydrant could be installed on the 8" line

SUBJECT: WATER TAP REQUEST
Dear Dennis:
With reference to your December 29 letter requesting a water tap for a
residence on Cherry Avenue, the City staff has reviewed the request and
has the following comments:
(1) In order for the City Manager to approve the tap, an 8" main would
have to be extended south from 20th Street to within 400 feet of
the proposed residence and a fire hydrant would have to be installed,
The cost of the water line would be approximately $13 per linear foot
installed and the cost of the hydrant installed would be approxi-
mately $1300.
(2) Raw water requirements for the property would be assessed on the gross
acreage of the land upon which the new building will be built, If a
tap greater than 3/4" is requested, the assessment will be calculated
using 3 acre feet per acre, If a tap of 3/4" size is requested, the
assessment will be figured on one acre foot per acre. However, should
a larger tap or an additional tap be requested in the future , the
assessment would revert to 3 acre feet per acre and the extra 2 acre
feet per acre would have to be provided before a larger or additional
tap would be granted.
(3) At the present time, the cash in lieu of water rights exchange price
is $1200 per acre foot.
(4) The plant investment fee for an outside city 3/4" water tap is $832.50.
The plant investment fee for a 1" tap is $1 ,470.00

VI . REFERRAL FROM COUNTY : RECORDED EXEMPTION
LOCATION: 2119 Cherry Avenue
Applicant: Dennis DeVore
The requested Recorded Exemption is for a 10 .6 acre parcel to be
split into parcels of 3 . 5 and 7 . 1 acres . The smaller parcel ,
having a dimension of 229 ' by 665 ' , is proposed for a single
family residence. The area is zoned estate , which would permit
a single residence on each lot . In 1972 , a minor subdivision
split off a parcel 330 ' by 533' from a total area that includes
the proposed Recorded Exemption.
The development would be served by City of Greeley water off of
the Consolidated Delta Pipeline and a fire hydrant is proposed
for the corner of 20th Street and Cherry Avenue . Sewer service
would be from a private septic system. Planning Staff expressed
concern for a development pattern occuring in east Greeley in
which large rural residential land uses are being created through
Recorded Exemption and Minor Subdivision procedures . The area
between Cherry Avenue and East Memorial School and between 22nd
Street and 18th Street would be anticipated to develop at urban
residential densities and to be incorporated into the City of
Greeley at some future date . The large , deep parcels created by
Recorded Exemptions could be more creatively subdivided to make
efficient use of the land. It was noted that municipal sewer
service is limited at this time in this area and that the subse-
quent use of septic tank systems requires lower densities .

V. REFERRAL FROM COUNTY: RECORDED EXEMPTION
LOCATION: 2119 Cherry Avenue
John Given pointed out the location of the area and noted that the
two parcels are 330 feet south of 20th Street on Cherry Avenue.
The total parcel is presently unimproved and Lot A is proposed for
single family residences. This parcel was previously a part of a
minor subdivision zoned estate, and the Comprehensive Plan suggests `
residential uses. There is water in 20th Street and Cherry Avenue. phi
This area is developing along the lines of deep rural residential
lots, and they are receiving another request of this type for a
parcel along 20th Street. Commissioner Clift asked if the next
request is for property west of this. Mr. Given replied that it is. {
A concern was brought up concerning large, deep rural lots being put
in where this is not the most efficient use of the land, especially '
being near the school and anticipating industrial development in
the areas south of 22nd Street over a long period of time. The !
lots could be more efficiently subdivided although sewer is available
. for this use.
Commissioner Keirnes suggested that they should look at the rules ,.
which allow for proper use of land. Mr. Sasaki replied that there 4'1
is no problem with the rules. The Recorded Exemption was put in
the code for families who wanted another residence on their land for
another member of the family. There is a five year waiting period
before resubdivision is allowed, but this is a process for getting
around subdivision rules. Mr. Given commented that the difference
• seems to be that Recorded Exemptions apply to large farms. The
process here is through Recorded Exemptions over a long period of
time, which allows no opportunity to bring the property up to the
standards required for the new use being created.
Commissioner Keirnes noted that it took 20 years to absorb 58
acres of industrial land and they were just discussing annexing '„
. more industrial areas. He could not anticipate industrial '
pressures in this area for another 50 years, so he saw no basis for
the argument for industrial pressure. Mr. Sasaki pointed out
that the process of the Comprehensive Plan is to anticipate growth . .
20 years from now. If a use is allowed contrary to that Plan simply
because it will take 20-30 years for conflicts to develop, then
there will still be a compatibility problem 20-30 years from now. tly
It is unfavorable to have property owners in the position of p
' having their property depreciate as it is paid off on a 30 year 'sI
loan. This problem did occur in Denver although it did take 20-30
years and Greeley will not industrialize as fast as Denver, but 9
there will be pressure for industrial uses. He also anticipates F., • 4
the Franklin farm moving very rapidly. Commissioner Clift asked -

if the people on the property north of this know that this is r. •
industrial. Mr. Sasaki replied that they do. Staff has no objet-
. tions to this lot split and would have no control if they did. - AAA1
Commissioner Clift made a motion to recommend no objections to the
proposed Recorded Exemption. Commissioner Keirnes seconded the
motion. Vote was taken and the motion carried unanimously.
