WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of
land, being the property of Harry Yelek, Windsor, Colorado,
and more particularly described as follows, to-wit:
A tract of land located in the Southwest Quarter of
Section 34, Township 6 North, Range 67 West and the
Northwest Quarter of Section 3, Township 5 North,
Range 67 West of the 6th Principal Meridian, Weld
County, Colorado, being more particularly described

also the Southwest corner of said Section 34 , and

WHEREAS, the Board of County Commissioners of the
County of Weld, State of Colorado, desires to exempt this
particular division of land upon the recommendation of the
Weld County Zoning Administrator for the reasons as stated
and pursuant to its authority under CRS 106-2-33 (d) , 1963,
as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by Harry Yelek, Windsor, Colorado,
be exempted from the definition of the terms "subdivision"
and "subdivided lands" as provided for in the new County
Subdivision Regulations at Section 201 A. , (3) adopted August 30,
1972, as amended.

BE IT FURTHER RESOLVED, that said request is granted
subject to petitioner agreeing to convey fifteen feet along
the Colorado State Highway #257 for road purposes.
The above and foregoing Resolution was, on motion

RE: REcorded Exemption 202
Dear Commissioners:
The attached plat, application and related items are in reference to a
request by Harry Yelek, for a Recorded Exemption. The parcel in question
is described as part of the SW4 of Section 34, T6N, R67W and part of the
NW4 of Section 3, T5N, R67W of the 6th P.M. , Weld County, Colorado. Said
property contains 79.6 acres more or less. The request is to split off a
6.188 acre parcel with on set of improvements from said property. The
remaining parcel containing 73.413 acres would also have an existing set
of improvements.
Based on the information submitted, the Planning Commission staff re-
commends approval for the following reasons:
1 . The proposed split conforms with the intent clause, Section 9-2 of
the Weld County Subdivision Regulations, and the Weld County Com-
prehensive Plan in that each resulting parcel would have an existing
set of improvements. The use would be compatible with surrounding
agricultural uses.
2. As explained by Mr. Yelek, the 6.188 acre parcel is severed from the
remainder of the farm by a deep drainage ditch which makes access
difficult. In .addition, only about 2 acres out of the 6.188 acres
are tillable. These two items combined make normal farming operations
impractical .
3. The Town of Windsor Planning Commission has no objection.
It should be pointed out that the State Department of Highways has requested
the applicant to provide an additional 15 feet of right of way by either
reservation, setback, or dedication (preferably the latter).

Sirs:
This letter is being submitted with accompanying data
compiled by the Kruback Engineering Company to request
your approval for a Recorded Exemption.
The parcel of land in question is 6.188 acres, more or
less, located at the west end of my property. The par-
cel is separated from the farm by a deep drainage ditch.
This ditch can be crossed only by going onto Colorado
Highway 257 and across the bridge. This will be further
complicated this year by highway improvements which will
move my farm access approximately 1200 feet to the south-
east.
Of the total 6.18 acres, only about two acres are tillable.
The remainder is the house site, ditches and waste land.
The small plot of tillable land and the difficult access
make normal farming operations impractical.
The line separating this parcel from the remainder of the
farm was established by following the east side of the big
ditch. We made some minor compromises to keep the line
reasonably straight.
It is my intention to sell the house and six acres. I be-
lieve the land would ,be better utilized if owned separately
rather than remain a part of the total farm operation.
From a personal economic standpoint, the value received from
this parcel sold separately can be used more effectively
by re-investing it elsewhere.
I believe we have furnished the Commission with all the in-
formation required to document this exemption. We would
appreciate expeditious and favorable action.

Dear Mr. Honn:
The Colorado Division of Highways has reviewed the request from Harry Yelek
for exemption of parcels in Sec. 34, T. 6N. and Sec. 3, T. 5N. , R. 67W.
The Division would like your office to have the applicant follow the
Division's Guidelines which were recently submitted to your office. Future
right-of-way needs for this area are 150 feet: 75 feet each side of center-
line. Thus, we would request that your office give consideration to having
the applicant provide an additional 15 feet of right of way by either reserva-
tion, setback, or dedication (preferably the latter) .
Driveway permits are available from the District Maintenance Superintendent,
Mr. Dave Fraser, 1420 Second Street, P. 0. Box 850, Greeley, Colorado 80631.
It should be brought to the attention of the applicant that our recommenda-
tion for residential building setback should be no less than 125 feet from
the centerline of the highway. This will reduce the amount of noise and air
pollution from the highway to acceptable E.P.A. recommendations at the dwellings.
