RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT, USR-1772
- PECAN PIPELINE (RM) INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated June 15, 2011, the Board approved the request of
Peters 313 Ranch, Inc., P.O. Box M, Carpenter, Wyoming 82054, do Pecan Pipeline (RM) Inc.,
600 17th Street, Suite 1000N, Denver, Colorado 80202, for a Site Specific Development Plan
and Use by Special Review Permit #1772 for an Oil and Gas Support Facility (field office,
storage yard, warehouse, 150 -foot communication tower, shop, power generation facility,
processing plant, gas metering station, truck loading facility and parking) in the A (Agricultural)
Zone District, on the following described real estate, to -wit:
E1/2 NE1/4 of Section 26, Township 12 North,
Range 63 West of the 6th P.M., Weld County
Colorado
WHEREAS, the Board has received a request from Pecan Pipeline (RM) Inc., to vacate
a portion of said Use by Special Review Permit, USR-1772, described as Lot A of Recorded
Exemption, RECX12-0082, being part of the E1/2 NE1/4 of Section 26, Township 12 North,
Range 63 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said partial vacation,
conditional upon the following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant
shall submit a revised plat, titled "Partial Vacation of Use by Special
Review Permit, USR-1772, conforming to Section 23-2-260.D of the Weld
County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Use by Special Review Permit, USR-1772, be, and hereby is,
partially vacated, with the abovementioned condition, with said plat to be titled and recorded as
Partial Vacation of Use by Special Review Permit, USR-1772.

Partial vacation of USR-1772 — Pecan Pipeline
November 25, 2013
The Department of Planning Services received the attached letter on October 18, 2013 from
Pecan Pipeline (RM), Inc. Pecan Pipeline, represented by Mr. Greg Jacobson, is requesting
that USR-1772 be vacated on Lot A of RECX12-0082. When USR13-0002 was approved one
of the Conditions of Approval was to have the applicant complete a partial vacation of the
existing USR (USR-1772) prior to recording the map for the new USR (USR13-0002). If this
partial vacation is approved the applicant will need to submit a revised USR map for USR-1772
per Section 23-2-280 of the Weld County Code.
The Department of Planning Services is recommending approval of this partial vacation.
Background information:
Legal Description: Lot A of Recorded Exemption RECX12-0082 Part of E2NE4 of Section
26, T12N, R63W of the 6th P.M., Weld County, CO
Location: North and adjacent to County Road 136.5 and west and adjacent to
County Road 71
June 19, 2013: USR13-0002 was approved by the BOCC on June 19, 2013, for A Site
Specific Development Plan and Use By Special Review Permit for Mineral
Resource Development Including Oil and Gas Support and Service
(Natural Gas Processing Facility with a Field Office, Storage Yard,
Processing Plant, and a Gas Metering Station) in the A (Agricultural)
Zone District. This USR is located on Lot A of RECX12-0082.
February 7, 2013:
June 15, 2011:
RECX12-0082 was recorded with the Weld County Clerk and Recorder.
This recorded exemption split the 77 acre parcel that USR-1772
encompassed into Lot A, 23 acres in size and Lot B, 54 acres in size.
USR-1772 was approved by the BOCC on June 15, 2011, for A Site
Specific Development Plan and Special Review Permit for an Oil and Gas
Support Facility (Field Office, Storage Yard, Warehouse, 150 -Foot
Communication Tower, Shop, Power Generation Facility, Processing
Plant, Gas Metering Station, Truck Loading Facility and Parking) in the A
(Agricultural) Zone District. This USR encompassed the 77 acre parcel.

Dear Ms.Aungst:
Pecan Pipeline (RM), Inc. does hereby request the partial vacation of USR 1772. The tract of
land to be vacated from USR-1772 is Lot A as shown on the enclosed plat. Lot A is a tract of land
located in the E/2NE/4 of Sec. 26-T12N-R64W, Weld County, Colorado as more further described on
the enclosed plat and in Recorded Exemption No. 0043-26-01. It Is our intent that Lot B, as
described and shown on the enclosed plat, will continue to be subject to USR-1772 and that Lot B will
not be vacated from USR-1772. Please note that this request for partial vacation of USR-1772 does
not create separate parcels.
