RESOLUTION RE : GRANT OF SPECIAL USE PERMIT FOR A LAMB, SHEEP AND CATTLE FEED LOT TO CACTUS HILL RANCH. WHEREAS, a public hearing was held on September 13 , 1976 in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Thomas E. Norton, agent for Cactus Hill Ranch, Route 4 , Fort Collins, Colorado, requesting a special use permit for a lamb, sheep and cattle feed lot located on a parcel of land located in the West Half of the West Half of Section 21 and the Southwest Quarter of the Southwest Quarter of Section 16 , Township 7 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : Beginning at the Northwest Corner (NW Cor) of Section 21 and con- sidering the West Line of Section 21 to hear N 00°09' 17" E; thence N 00°00'37" E along the West Line of Section 16, 317.31 ' ; thence S 71°40' 18" E, 933. 59' ; thence S 33°35'36" E, 351.90' ; thence 5 01 °03 ' 21"W, 498. 13' ; thence S 13°38'48"W, 393. 05' ; thence S 39°06'08"W, 379. 17' ; thence S 0°12'00" E, 855. 99' ; thence S 080 45'30" W, 330. 28 ' ; thence 5 11°20' 42" W, 445.68' ; thence S 89°06' 32" 5, 559. 44' to a point on the West Line of Section 21 ; thence N 00°09' 17" 5, along the West Line of Section 21, 3, 101 .09' more or less to the point of beginning; excepting therefrom the State Highway 257 Right of way along the West side and any other ease- ments or rights of way of record; said parcel contains 60.5 acres including the Highway ROW. WHEREAS , the petitioner was present, and WHEREAS , the Board heard the testimony of those present in support of and in opposition to the request of the petitioner for the location of said lamb, sheep and cattle feed lot, and has viewed the site , and WHEREAS, the above described parcel of land is located in an agricultural zone as set forth in the Weld County Zoning Resolution, and WHEREAS, Section 3 . 3E4d of the Weld County Zoning Resolution authorizes such a use in the agricultural district on the grant of a special use permit by the Board of County Commissioners, and WHEREAS , the Board of County Commissioners has considered all the testimony and statements of those present, has studied the request of the petitioners , and has studied the recommendation of the Weld County Planning Commission, and having been fully informed and satisfied that the requested use complies with the Weld County Comprehensive Plan and the provisions of the Weld County Zoning Resolution, NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Thomas E. Norton as agent for Cactus Hill Ranch for a special use permit for a lamb, sheep and cattle feed lot on the above described parcel of land be, and hereby is, granted, subject to the development standards contained in the special use permit. Ben Nix Absent Chuck Carlson Present Bill Elliott Present Bette Kountz Present Percy Hiatt Present Harry Ashley Present John Weigand Absent APPLICANT: Cactus Hill Ranch PC 632 (#0 - 670) CASE NUMBER: SUP 309 LOCATION: WZ Wz Sec. 21 T7N R67W SUBJECT: Cattle and sheep feedlot APPEARANCE: Tom Norton- Norton, Underwood and Lamb DISCUSSION: The feedlot exists presently and Mr. Nelson, property owner, wishes to make some improvements. No additions are anticipated over what is shown on the application. The total operation is 40 acres. The operation itself accomodates 40,000 sheep. There is other acreage around the feeding operation which is owned by Cactus Hill Ranch, but is not part of the Special Use Permit. Weld County Planning staff recommends approval for the following reasons: 1 ) The cattle and sheep feedlot agrees with the Weld County Comprehensive Plan; 2) The Weld County Health Department has indicated the design of the cattle and sheep feedlot operation and the animal waste disposal system is in conformance with State Health Department standards and regulations; 3) The County Extention Agent indicated that the pen space is adequate in size for the anticipated number of animals; 4) the Soil Conservation Service has indicated that the soils in the area pose no limitations for the feedlot operation; and 5) the Weld County Engineering Department has not identified any problems with respect to the design of the facilities. COMMENTS: 1 ) No response was received from the Windsor Severance Fire District; and 2) the B. H. Eaton Ditch Company made no response to the application. Mr. Honn explained that in 1970 there was an application made before the W.C.P.C. . When it went before the Planning Commission there was some discussion with the Health Department regarding drainage problems in the area. There was a suggestion that a meeting be held with Mr. Nelson, Mr. Baldwin, and the Planning Commission to determine exactly what needed to be done to resolve the drainage problems (Mr. Baldwin was with the Health Department at that time). NHPQ was hired to conduct necessary studies to satisfy State Health Department requirements. In 1972 or 73 approval from State Health was given. At that point the applicant was under the impression that everything was approved. Therefore he did not recontact the Weld County Planning Commission, and the application was never actually completed. Last summer a building permit request Page 1302 i on the property was made and research revealed that the application had never been approved. Glen Paul stated that he recommends approval of the request. He feels all Health Department requirements have been met. H. Gordon Howard, surrounding property owner, strongly objected to the odors and flies which he feels are caused by this operation. He immediately stated that if this request is approved immediate litigations will be started against all parties involved . Mr. Howard seemed to be under the impression that this was a request for an expansion and also that the expansion would place the operation within 500 feet of Mr. Howard 's property. It was explained to him that this is a permit for the existing operation and that it does not necessarily mean that the operation itself is within 500 feet, but that Cactus Hill property lines may be within 500 feet of Mr. Howard 's properties. After this was explained to him he stated he would need to confer with his attorney. Adolph Winter, surrounding property owner, feels that his water is being contaminated by this operation. He also objects to the odors. Mr. Winter feels that the County is trying to "cover up" a mistake that was made, instead of having it corrected. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of this request. Motion by Harry Ashley. Seconded by Chuck Carlson. A vote of "aye" by Ashley, Yost, Kountz, Elliott, Heitman, Hiatt, and Carlson. MOTION CARRIED. APPLICANT: Richard H. Geisert CASE NUMBER: Z-275 and S-123 PC Tape 632 (#670 - 990) SUBJECT: "C" to "I-UD" APPEARANCE: Gary Sears LOCATION: Pt. Sec. 4 and Pt. Sec. 5 T5N R65W DISCUSSION: Mr. Sears explained the he is requesting a change of zone and approval of a plat (P-UD) on approximately 16 acres on 5th Street and the by-pass. The property is cut into 10 lots and will be used for warehousing and wholesaling. Mr. Sears intends to comply with the City of Greeley requirements for light industrial uses. Weld County Planning staff recommends tabling at this time for the following reasons: 1 ) The Colorado Geological Survey has indicated the subject property is underlain with a floodplain gravel deposit. Sec. 34-1-305 C.R.S. 1973, as amended, states, "After July 1 , 1973, no board of county commissioners, governing body of any city and county, city , or town, or other governmental authority which has control over zoning shall , by zoning, rezoning, granting a variance, or other official action or inaction, permit the use of any area known to contain a commercial mineral deposit in a manner which would inter- fere with the present or future extraction of such deposit by an extractor. " The applicant has not shown that the mineral deposit under the subject property is not a commercial mineral deposit; and 2) The Weld County Utility Board voted unanimously on July 15, 1976, to recommend disapproval of the utility plat. This includes daily feeding, shipping, receiving, veterinary care, housekeeping and accounting. The vehicular traffic includes an average of 5 tractor trailer units per day to handle shipping and receiving both animals and feed. The interior traffic consists of mobil feed trucks which operate throughout the normal working day, plus pickups, end loaders, dump trucks and a grader which take care of operation and maintenance of road and manure removal. The present operation which is the intended future operation has been established with pollution control as a prime consider- ation. Water pollution is eliminated the majority of the time by containing all the waste water and utilization of land applications. Air pollution is controlled by maintaining moisture in the surface of the feed lot, which minimizes the amount of dust that could occur during extremely dry months. The feeding process is also conducted with a high moisture feed which also eliminates dust. Other operations do not contribute to air pollution or are insigni- ficant as compared to the total operation and surrounding air mass. Odor pollution is inherent with any feed lot operation, however, in this operation, odor is controlled by good housekeep- ing operations such as cleaning pens on a regular basis and maintaining dry condition. in the manure storage area. Safety hazards to the general public are minimized by limiting access to the operations area. This is accomplished with the fences which surround the entire area, except the office, scale and mill area. Safety is also stressed by the management for all feed lot operations. f The sewage system collects all drainage within the special use area, including the feed mill, scales, office, shops, manure handling area along with the feed pens and roads. The drainage from the area surrounding the special use area is diverted around the feed lot by a diversion dam and channel around the east and south sides of the feed pens. The drainage within the special use area is all collected in a liquid storage pond after allowing the solids to settle out in the solids removal ponds and ditches. The liquid from the storage pond is then utilized to irrigate other properties, adjacent to the special use area, which are owned by Cactus Hill Ranch. All of the poltable water supply is furnished by the North Weld Water District as it has been since the beginning of the District. Cactus Hill Ranch was one of the original subscribers to this District, . and there is no reason to question the con- tinued use of this water. There is no need to improve roads beyond normal maintenance which is conducted by Cactus Hill Ranch. Norton. The Division would request that due consideration be given the following comments. Consideration should be given to preservation of at least 150 feet of minimum right of way (75 feet each side of the centerline) that will be needed for improvements to S.H. 257. This additional right of way needed to meet future needs should be protected by reservation, setback, or dedication (preferably the latter) as local zoning laws and regulations permit. The owners seem to have taken adequate precautions in preventing sewage retention ponds. However, the Division would still like to reinforce our drainage guidelines. A developer must not re-contour the land so that water will drain onto the highway right of way where it has not historically done so. Where a drainage system has been developed, an increase runoff or rate of runoff is attributable to the development proposal, the developer must provide necessary on-site drainage retention ponds to hold the increased runoff attri- butable to the development proposal. Also, drainage from sewage lines, sewage ponds, or other waste water will not be permitted to drain onto the highway right of way. We would wish to request that the owners be responsible for any damages to highway right of way by seepage, leakage, or overflow of sewage from any proposed liquid storage pond. The plat provided does not indicate any erections of residential or commercial buildings. If the owners should decide to erect such buildings, the Division would request that due consideration be given the environmental impact the highway would have on the use of the structures. It is important to take into consideration what impact the traffic on the highway will have on noise and air pollution levels at the site of the proposed development. _____VE I.'
