Respondents.
THIS MATTER comes before the Court upon the Consent to Entry
of Rule and Order and Stipulation for Correction of Party Name
and of Facts Concerning Remaining peteblis Property. The parties
thereto having agreed to the total amount of compensation due for
the taking of the property described in attached Exhibit A (the
"Property"), and the Court being fully advised in the premises,
the Court does hereby:
FIND that the Court has full and complete jurisdiction of
the subject matter of this action and the parties thereto; that
service has been made upon all interested parties as required by
law; and that the only party who contested any of the allegations
contained in the Petition was Respondent Peteblie, Ltd.
("Peteblie").
The Court also FINDS that Petitioner is acquiring the
Property to construct the 95th Street Interchange Project (the
"Project"). The Project generally includes obtaining right-of-
way for and constructing a six -lane bridge over U.S. Highway 36,
constructing a diamond interchange with on and off ramps to and
from this new bridge, and constructing 96th Street from Coalton
Rmed to Carbon Road. The Project is more specifically described
as Project Number CIP 95-75.

The Court further FINDS that Petitioner and Peteblis have
consented to concluding this litigation.
TREREFbRE, it is hereby ORDERED, ADJUDGED and DECREED that:
1. Petitioner and Peteblis have agreed that $168,000.00,
which amount Petitioner previously deposited into the Court
Registry, plug fulfilling the terms of this Rule and Order,
constitutes full compensation to be paid by the Petitioner to
Peteblis for the taking of the Property, plus damages, if any,
and any reimbursable court costs or litigation expenses,
including any interest, both before and after entry of this Rule
and Order to which Peteblis may be entitled.
2. Upon proper application to this Court, Peteblis may
withdraw the remaining funds held in the Registry of the Court,
plus any accrued interest on the monies previously deposited in
the Registry by the Petitioner.
3. Each party shall bear its own costs and attorney fees
with respect to this action.
4. Pursuant to the Consent between Petitioner and
Peteblis, they will execute an option Agreement concerning 58
acres of additional real property owned by Peteblis (the
"Peteblis Residue"). The executed Option Agreement will be filed
in the office of the Boulder County Clerk and Recorder.
5. Pursuant to the Consent between Petitioner and
Peteblis, Petitioner will not seek reimbursement for any portion
of Project costs from the owner of the Peteblis Residue.

construct or reimburse Petitioner for all or any part of any
future project related to the Project in accordance with law.
S. The name of Respondent Robert E. Law, as Trustee for
the Jessie W. Law Irrevocable Trust, holder of a record interest
in the Property who was previously served with process in this
litigation, is substituted for and corrected from Robert G. Law.
7. The Property has been duly and lawfully taken by the
Petitioner pursuant to the statutes and the Constitution of the
State of Colorado.
8. The Property is hereby vested in the Petitioner free
and clear of all liens and' encumbrances, except as follows:
Petitioner's acquisition of the Property in this action shall be
subject to the continued validity of any interests in the
property currently held by Respondents Robert M. Hardaway III and

Lee Harkey Hardaway, and to an oil and gas lease which wan
conveyed to Respondent Gerrity Oil & Gag Corporation by
instrument recorded January 7, 1993 on film 1790 at reception
number 1264169 in the boulder County real property records (the
°Lease°), provided that oil and gas exploration and production
activities by such Respondents, their successors, assigns, agents
or lessees in, under and around the Property and the Project
comply with the following terms and conditions,
a. Petitioner shall retain full right to subeurface
support for the Project. Such Respondents agree to
undertake no action which will serve to deprive
Petitioner of its subsurface support for the Project.
In the event said subsurface support is interfered with
or disturbed by such Respondents as a result of their
underground production activities, maintenance of their
wells or surface transport of oil and gas, such
Respondents agree to pay Petitioner reasonable damages
associated with said interference.
b. Any future exploration, drilling or production
activities with respect such intermits it the Property
or pursuant to the Lease will not occur on the
Property.
c. Such Respondents shall be responsible for any and
all damage caused to Petitioner's facilities associated
with the Projectcaused by such Respondents' negligent
conduct in drilling, production, surface transportation
of oil and gas products and well maintenance in the
area of the Property.
9. Petitioner shall record a certified copy of this Final
Rule and Order in the office of the boulder County Clerk and
Recorder. This Order shall be recorded and indexed in like name
and with like effect as if it were a deed of conveyance from the
Respondents to the Petitioner herein.
