RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #1070 - MARY ANN
BARNES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 4, 1995, the Board approved a Site Specific
Development Plan and Use by Special Review Permit #1070 for an Agricultural Irrigation Business
in the A (Agricultural) Zone District for Norman and Mary Ann Barnes on the following described real
estate, to -wit:
Part of the W1/2 SE1/4 of Section 4, Township 2 North,
Range 67 West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from Mary Ann Barnes, 8581 County
Road 24, Fort Lupton, Colorado 80621, to vacate said Use by Special Review Permit #1070, and
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit #1070 be, and hereby is, vacated.

The above and foregoing Resolution was, on motion duly made and seconded, adopted by

The Department of Planning Services has received the attached letter dated March 12,
2013 from Mary Ann Barnes. Mrs. Barnes is requesting that USR-1070 be vacated from
her parcel, 1311 04 000068 since the use of the irrigation business is no longer being
operated on the property.

Legal Description: Part of W2 SE4 Section 4, T2N, R67W of the 6`h P.M., Weld County,
CO.
Location: North of and adjacent to CR 24 and West of CR 17

USR-1070 was approved by the BOCC on January 4, 1995, for A
