HomeMy WebLinkAbout20133572.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO DECEMBER 30, 2013 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, December 30, 2013, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner William F. Garcia, Chair - EXCUSED Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Susan Brown Controller, Barbara Connolly IR MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of December 23, 2013, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. le AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed. Commissioner Freeman seconded the motion, and it carried unanimously. PRESENTATIONS: 1) RECOGNITION OF SERVICES, CLERK AND RECORDER'S OFFICE — JAN ANGEL: Commissioner Rademacher read the certificate into the record. Steve Moreno, Clerk and Recorder, spoke about Ms. Angel's years of services, said that she would be missed, and wished her happiness in retirement. The Board concurred. Ms. Angel said thanks and that she would miss everyone. e PUBLIC INPUT: No public input was given. BIDS: Fl 1) APPROVE BID #61300195, COUNTY NEWSPAPER - DEPARTMENT OF FINANCE AND ADMINISTRATION: Trevor Jiricek, Director of General Services, reported the low bid was the Fort Lupton Press. In response to Commissioner Conway, Esther Gesick, Deputy Clerk to the Board, explained that the Ft. Lupton press bid very low on the same services and then reviewed the last year Minutes, December 30, 2013 2013-3572 Page 1 BC0016 of service from the Greeley Tribune, the other bidder, and the three types of media publications. Commissioner Freeman moved to approve staff's recommendation on bid. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. OLD BUSINESS: 1) CONSIDER FIRST AMENDMENT TO AGREEMENT FOR INMATE HEALTH SERVICES AND AUTHORIZE CHAIR TO SIGN - CORRECT CARE SOLUTIONS, LLC: Sterling Geesaman, Sheriff's Office, explained that Correct Care received the bid last year for a period of three years with two possible extensions, and this is the second year's projected expenses. He said the 3.9 percent Consumer Price Index (CPI) was based on information from Denver/Boulder claims. He said two additional hours for the dentist were added because of a back -log, and four additional hours were allotted for a psychiatrist, also in response to need, and then the CPI increase. He said the Sheriff's Office is very satisfied with Correct Care's services. In response to Commissioner Conway, he said the determination of additional hours was based on the vendor's recommendation with regard to their workload, and this is a better picture of what the needs are. He noted the new dentist is very efficient, but the demand is great for extractions and fillings. He confirmed for Commissioner Rademacher, that unless the population increases the hours will not likely be increased next year. In response to Commissioner Kirkmeyer, Mr. Geesamen said there is a quarterly meeting with the vendor and the back -logs are reviewed at that time. He said addressing the mental health issues is critical and only the psychiatrist can prescribe medication. Commissioner Kirkmeyer suggested that $85,000 a year for 8 hours a week is steep, and the County should consider hiring an independent psychiatrist after this contract is finished. Mr. Geesaman confirmed state funding helps pay for the in-house counselors and help for inmates transitioning back into the community. Commissioner Kirkmeyer reiterated that a $3.2 million contract is a lot of money, and the Board concurred this item needs review in the budget when the contract is up. Commissioner Conway noted that since the mental health ward at NCMC closed, there are a larger percentage of mental health issues seen in the jail. Commissioner Kirkmeyer moved to approve said amendment and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. NEW BUSINESS: e 1) CONSIDER PROMOTING SAFE AND STABLE FAMILIES PARTNERSHIP PROJECT AGREEMENT AND AUTHORIZE CHAIR TO SIGN - CATHOLIC CHARITIES AND COMMUNITY SERVICES OF THE ARCHDIOCESE DENVER WELD REGIONAL OFFICE: Judy Griego, Director of Department of Human Services, explained funding from the Colorado Department of Human Services was awarded to Catholic Charities, and they would like to partner with the County to help fund an existing community liaison position currently serving up to 100 families. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. ID 2) CONSIDER TEMPORARY CLOSURE OF CR 13 BETWEEN STATE HWY 60 AND CR 50: Amy Joseph, Department of Public Works, reviewed the temporary road closure for a bridge redeck. Commissioner Kirkmeyer moved to approve said temporary road closure. The motion was seconded by Commissioner Conway, and it carried unanimously. .Ii 3) CONSIDER TEMPORARY CLOSURE OF CR 29 BETWEEN CRS 34 AND 36: Ms. Joseph reviewed the temporary road closure for seven weeks, a load -posted bridge replacement, and reviewed the ADT and the detour routes. She said the school district will be notified, as well as the Fire District. Commissioner Kirkmeyer moved to approve said temporary road closure. The motion was seconded by Commissioner Freeman, and it carried unanimously Minutes, December 30, 2013 2013-3572 Page 2 BC0016 PE 4) CONSIDER CONTRACT EXTENSION/RENEWAL FOR 2014 ENVIRONMENTAL SERVICES (#61100114) AND AUTHORIZE CHAIR TO SIGN - TIGLAS ENVIRONMENTAL SERVICES: Dave Bauer, Director of the Department of Public Works, said this is the last renewal of a three year contract with Darcy Tiglas, who handles the department's permits for contracted services; she has been doing this for 10-12 years and is excellent. He noted this was originally bid out competitively Commissioner Conway moved to approve said contract extension/renewal and authorize the Chair to sign. Seconded by Commissioner Freeman, the motion carried unanimously. IEI 5) CONSIDER WRITE OFF OF BACK TAXES AND ACCEPT PROPOSAL FROM TOWN OF PIERCE TO PURCHASE TAX LIEN SALE CERTIFICATE (TS CERT 2007-0776) FOR PARCEL #055327104002: Renee Fielder, Assistant Treasurer of Weld County, said the Town of Pierce has destroyed the mobile homes on this land and cleaned up the property, so they have requested a write-off of the taxes on the property, approximately $700 dollars. Bruce Barker, County Attorney, suggested this be called a cancellation, rather than a write-off, so that the certificate itself goes away. Commissioner Conway moved to continue the matter until Monday, January 6, 2014, to give the Treasurer and the County Attorney time to change the resolution. The motion was seconded by Commissioner Freeman, and it carried unanimously. El 6) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 1998-0519) FOR PARCEL #055326211003: Ms. Fielder said the investor did not go forward with the Treasurer's deed, thus, after 15 years, that investment is forfeited. In response to Commissioner Conway, she said the taxes are paid but they don't wish to take possession of the property. She noted this tax lien will likely be auctioned off again. Commissioner Conway moved to acknowledge said cancellation of tax lien sale. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. El 7) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 1998-0071) FOR PARCEL #147106126005: Commissioner Freeman moved to acknowledge said cancellation of tax lien sale. Seconded by Commissioner Conway, the motion carried unanimously. e 8) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 1998-0256) FOR PARCEL #096106429025: Commissioner Conway moved to acknowledge said cancellation of tax lien sale. Seconded by Commissioner Freeman the motion carried unanimously. Fl 9) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 1998-0470) FOR PARCEL #055326203013: Commissioner Freeman moved to acknowledge said cancellation of tax lien sale. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. e 10) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2011-16626) FOR PARCEL #105920428027: Commissioner Kirkmeyer moved to acknowledge said cancellation of tax lien sale. Seconded by Commissioner Freeman, the motion carried unanimously. Fl 11) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2011-16410) FOR PARCEL #146906113011: Ms. Fielder said this is an administrative item, because there was a double assessment/erroneous sale; the mobile home was burned and the title Minutes, December 30, 2013 2013-3572 Page 3 BC0016 purged. Commissioner Kirkmeyer moved to acknowledge said cancellation of tax lien sale. Seconded by Commissioner Freeman, the motion carried unanimously. 12) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2011-16318) FOR PARCEL #096116209094: Ms. Fielder said this was also an erroneous sale, because the mobile home is no longer there. Commissioner Kirkmeyer moved to acknowledge said cancellation of tax lien sale. Seconded by Commissioner Freeman, the motion carried unanimously. 13) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2011-16369) FOR PARCEL #080114000023: Ms. Fielder said this was also an erroneous sale, because the mobile home is no longer there. Commissioner Freeman moved to acknowledge said cancellation of tax lien sale. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. 14) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2012-18603) FOR PARCEL #121313401007: Ms. Fielder said this was also an erroneous sale, because the mobile home is no longer there. She noted her office has been out in the field due to the recent flooding, so that is why these are being discovered and the records updated accordingly. Commissioner Kirkmeyer moved to acknowledge said cancellation of tax lien sale. Seconded by Commissioner Conway, the motion carried unanimously. SE 15) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2012-18725) FOR PARCEL #096129102004: Ms. Fielder said this was also an erroneous sale, because the mobile home is no longer there. Commissioner Conway moved to acknowledge said cancellation of tax lien sale. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. Ei 16) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2012-18728) FOR PARCEL #105911208005: Ms. Fielder said this was also an erroneous sale, because the mobile home is no longer there. Commissioner Freeman moved to acknowledge said cancellation of tax lien sale. Seconded by Commissioner Conway, the motion carried unanimously. 11 17) CONSIDER APPOINTMENTS TO BUILDING TRADES ADVISORY COMMITTEE: Commissioner Kirkmeyer moved to approve said appointments. Seconded by Commissioner Conway, the motion carried unanimously. 18) CONSIDER APPOINTMENT AND REAPPOINTMENT OF MEMBERS TO WELD COUNTY FEDERAL MINERAL LEASE DISTRICT BOARD OF DIRECTORS: Commissioner Conway moved to continue this to Monday, January 6, 2014, to address any potential conflicts of interest. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. El 19) FINAL READING OF WELD COUNTY CODE ORDINANCE #2013-16, IN THE MATTER OF REPEALING AND RE-ENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION, AND CHAPTER 5 REVENUE AND FINANCE, OF THE WELD COUNTY CODE: Commissioner Kirkmeyer moved to read by title only. The motion was seconded by Commissioner Conway, and it carried unanimously. Mr. Barker read the title for the record, noting there have been no changes since second reading. Chair Pro-tem Rademacher opened the floor to public input and none was forthcoming. Commissioner Freeman moved to approve said ordinance on final reading. The motion was seconded by Commissioner Conway, and it carried unanimously. Minutes, December 30, 2013 2013-3572 Page 4 BC0016 le 20) SECOND READING OF CODE ORDINANCE #2013-13, IN THE MATTER OF REPEALING AND REENACTING IN ITS ENTIRETY, CHAPTER 30 SEWAGE SYSTEMS, OF THE WELD COUNTY CODE: Commissioner Kirkmeyer moved to read by title only. The motion was seconded by Commissioner Conway, and it carried unanimously. Mr. Barker read the title for the record. Mr. Jiricek, Director of General Services, said there are a number of edits as a result of the recent work session, but no significant changes. In response to Commissioner Conway, he said this will bring the code up to state standards. Chair Pro-tem Rademacher opened the floor to public input and none was forthcoming. Mr. Jiricek noted the Board of Health also reviewed the ordinance. Commissioner Conway moved to approve said ordinance upon second reading. The motion was seconded by Commissioner Freeman, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2013-16 was approved on Final Reading, and Code Ordinance #2013-13 was approved on Second Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
