WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 1st day of February, 1978 at the hour of 2: 00 o ' clock p.m. , in the Chambers of the Board of County Commissioners, for the purpose of hearing the application of Ralph Northrup, Box 62, Stoneham, Colorado 80754 , for the granting of a Special Use Permit for a hog operation on the following described real estate, to-wit: A parcel of land described as the East Half (E1/2) of the Northwest Quarter (NA) of Section 28, Township 8 North, Range 56 West of the 6th P.M. , Weld County, Colorado. WHEREAS , the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a hog operation on the above-described real estate, and WHEREAS, Section 3. 3.E. 4.d. of the Weld County Zoning Reso- lution authorizes such a use in an Agricultural District upon approval by the Board of County Commissioners , and WHEREAS, the Board of County Commissioners of Weld County, Colorado, heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed and satisfied that the request for a Special Use Permit for a hog operation on the hereinabove described real estate, conforms to the purposes of Section 3. 3.E. 4.d. of the Weld County Zoning Resolution; NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application of the petitioner for a Special Use Permit for a hog operation 7211a 11 on the aforementioned tract of land, be, and hereby is , granted subject to the Development Standards contained in the Special Use Permit. C. RESOLUTION December 20, 1977 the future development in the area and will not adversely affect the health, safety, and welfare of the inhabitants of the area and the county. This determination is based upon the following: A. The hog operation and management practices as outlined and controlled in the Development Standards will make this operation compatible with the surrounding area by minimizing the potential adverse impacts. B. The proposal is for an agri-business in an agriculturally zoned area, with existing land uses being predominantly agricultural. C. The Weld County Extension Agent has indicated the facilities will provide adequate space for proposed number of animals. D. The Weld County Health Department has indicated the proposed operation is in compliance with all applicable Weld County and State Health Standards and Regulations. E. The Weld County Engineering Department indicated no engineering problems could be identified with the proposed operation. F. The State Engineer, Division of Water Resources, has indicated the quantity of water to be supplied by the well should be sufficient for this proposed operation and they recommend approval of the application. G. To date there has been no opposition to this request from any of the surrounding property owners. t _) 777 Northrup ., SUP DEVELOPMENT STANDARDS 1. The hog farrowing operation on►the hereon described parcel shall be limited to the facilities shown which are designed to handle approximately 300 sows and 800 baby pigs. 2. The Special Use Permit area shall be maintained in such a manner as to prevent fugitive dust, soil erosion, and the growth of noxious weeds. 3. All sewage disposal facilities installed on the site and all management practices for the hog operation shall conform with all applicable Weld County and State Health Standards and Regulations. If the sewage lagoon is to be constructed, then the plans shall be approved by the Weld County Health Department prior to construction. 4. Any new access shall be approved by the County Engineer prior to installation. 5. There shall be no discharge from any of the proposed hog operation into streams, other bodies of water, or adjacent drainage systems without obtaining a wastewater discharge permit from the Water Quality Control Commission, State Health Department. 6. The Special Use Permit shall be limited to the plans submitted and governed by the Development Standards stated above. Discussion then followed regarding the safety problem along 1st Avenue for pedestrian traffic in that there are presently no sidewalks . MOTION: Be it therefore resolved to recommend approval subject to the staff ' s recommendation to the Board of County Commissioners. Motion by Harry Ashley, seconded by Jerry Kiefer. Northrup explained his request in that he and his son presently have feeder pigs and their own replacement gilts and now want to increase the herd to a 300 sow unit . Farrowing will be total confinement only with breeding and gestation outside. Weaner pigs will be sold privately. Mr . Doeringsfeld stated that the land will be undisturbed, there will be no channelization of the river, and no change in the vegetation. Discussion followed regarding the amount of water to be used in the operation and evaporation. Ken McWilliams then read .the staff 's recommendation. Mr. Nix asked where the gravel will be used and Mr. Doeringsfeld responded by saying that primarily northeastern Colorado will be using it. Discussion followed regarding future use of the gravel and paving of the access road to the site. Mr. Doeringsfeld also said that he feels $100, 000 liability coverage is not sufficient and will increase it to $500, 000. MOTION: Be it therefore resolved to recommend approval and further recommends that the access road be paved and that if the SUP is approved by the Board of County Commissioners that the State Mined Reclamation Board and the State Engineer, Division of Water Resources, be sent a letter recommending that a water augmentation plan be submitted and approved with the permit . Ken McWilliams then read the staff ' s recommendation for tabling pending receipt in the Department of Planning Services office for a suitable plan for control of the ground water table under the subject property. Two soil types are present over the area: Ascalon sandy loam, 3 to 5 percent slopes and Platner loam, 1 to 3 percent slope. Your plans for hog farrowing and nursery should have no problems as long as an adequate design is prepared. There is a moderate limitation for concrete buildings due to high shrink-swell potential of the Platner loam, 1 to 3 percent slopes. The soil has a slow permeability which limits its use for septic tank filter field. This characteristic, however, will provide excellent conditions for animal waste sewage lagoon facility. Both soil types will provide excellent conditions for growing nursery stock. The soil description lists the types of plants suitable. It formed in calcareous eolian and alluvial deposits and is extensive in hardland areas throughout the county. The average annual precip- itation ranges from 11 to 13 inches. Slopes are nearly level to gently sloping. Typically the surface layer is grayish brown loam about 7 inches thick. The subsoil layer is grayish brown heavy clay loam about 14 inches thick and is calcareous in the lower part. The substratum is white and very pale brown, calcareous loam and fine sandy loam about 13 inches thick over brown, calcareous gravelly coarse sandy clay loam extending to 60 inches or more. Permeability is slow. Effective rooting depth is 60 inches or more. Available water capacity is high. Surface runoff is slow and erosion hazard is slight. This soil is used mainly for nonirrigated cropland. Some areas are used for irrigated cropland and grazing. Wheat and grain sorghum are the principal crops grown in nonirrigated cropland. Corn, alfalfa and sugar beets are the main crops in irrigated areas. In nonirrigated cropland areas the primary objective of management is conserving moisture. Management practices such as stubble mulch tillage and incorporating crop residues in and on the surface are essen- tial to protect soil from possible blowing, improve water infiltration, improve soil tilth, and conserve moisture. NIL Tillage pans form easily if this soil is tilled when wet. Chiseling or subsoiling breaks up tillage pans and improves water infiltration. Tillage operations should be kept to a minimum. Terracing is also beneficial in reducing runoff and conserving moisture. Management concerns in irrigated areas are proper use of irrigation water and maintenance of fertility and controlling soil erosion. This soil is well suited to furrow and border irrigation. Land leveling is necessary in most areas to obtain uniform distribution of water. Irrigation water management is needed for efficient use of water because of the slow permeability and control of soil loss. Incorporating crop residues into the surface soil increases infiltration, reduces soil loss and improves soil tilth. Applications of manure and commercial fertili- zers containing nitrogen and phosphorous are important in maintaining soil productivity. Rangeland vegetation of this soil consists mainly of blue grama, buffalograss, western wheatgrass, and sedge. Proper grazing use coupled with planned grazing systems are the most important practice to maintain quantity and quality of desirable rangeland vegetation. Range seeding will speed the revegetation of areas depleted by heavy grazing, cultivation or other disturbances. Combinations of stockwater development, fencing and deferred grazing help improve grazing distribution and maintain range condition. Contour furrowing and pitting are practices that improve water infiltration and reduce runoff and especially effective on range areas in poor and fair condition. Windbreaks and environmental plantings are well suited on this soil in the more moist eastern part of the county. Summer fallow a year prior to planting, supplemental water during planting and early stages of growth, and continued cultivation for weed control are needed to insure establishment and survival of plantings. Trees best suited and having best survival are Rocky Mountain juniper, Eastern redcedar, Ponderosa pine, Siberian elm, Russian olive and Hackberry. Shrubs best suited are skunkbush sumac, lilac, Siberian peashrub, and American plum. Openland wildlife such as pheasant, cottontail rabbit and mourning dove are suited to this soil. In cropland areas favorable habitat can be developed by establishing areas for nesting and escape cover. For pheasants undisturbed nesting cover is vital and should be included in plans for habitat development. Tree and shrub plantings along fence lines, irrigation ditches, roadsides and streambanks also help encourage wildlife. Rangeland wildlife, including antelope and jackrabbits, can be encouraged by water developments and types of fencing to permit unrestricted antelope movement. The primary limiting soil properties for homesites and other urban developments are high shrink-swell potential and slow permeability of the subsoil. These limitations can be overcome with careful design and construction. Septic tank filter fields will not function properly because of the slow permeability. Capabilities Subclass IIIc, nonirrigated. Ile, irrigated. 6 -Ascalon sandy loam, 3 to 5 percent slopes This is a deep, well drained soil on uplands at elevations of 4600 to 5200 feet. It formed in alluvium. Included in this unit are some rock outcrops. Typically the surface layer is brown sandy loam about 8 inches thick. The subsoil is pale brown to yellowish brown sandy clay loam about 10 inches thick. The substratum, to a depth of 60 inches, is calcareous fine sandy loam. Permeability is moderate. Available water capacity is high. Effective _ _ _ _ rooting depth_ is 60 inches or more-. Surface runoff is medium and -erosion hazard is- low. - - This soil is well suited to winter wheat , barley and sorghum, with alternate years being in summer fallow. Winter wheat is the principle crop. If the crop- of winter wheat should fail due to winter kill, _ spring wheat _may be seeded. Normally, precipitation is too low to make beneficial use of fertilizers. " - - Good cultural practices such as stubble mulch farming, strip cropping and minimum tillage are needed to combat wind and water erosion. Terracing may also be needed to control water erosion. The potential native vegetation on this site is dominated by sand bluestem, sand reedgrass and blue grama. Needle-and-thread , switchgrass sideoats grama and western wheatgrass are also prominent. Potential production -ranges from 2200 pounds per acre in favorable years to 1800 - pounds per acre in unfavorable years. When range condition deteriorates , sand bluestem, sand reedgrass and switchgrass decrease and blue grama, sand dropseed and sand sage increase. Annual weeds and grasses invade the site as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sand bluestem, sand reedgrass , switchgrass, sideoats grama, blue grama, pubescent wheatgrass and crested wheatgrass are suitable for seeding. The grass selected should meet the seasonal requirements of livestock. For successful seeding, a clean, firm, _ sorghum stubble -- prepared the growing season prior to seeding -- or__a- . firm, prepared seedbed ans grass drill should be used. Early spring seeding has proven most successful. C Windbreaks and environmental plantings are generally suited to this soil. Soil blowing is the principle hazard to establishing trees and shrubs. This hazard can be overcome by cultivating only in the tree' row and by = __ leaving- a strip of- vegetative cover between the rows-.- Supplemental -_ - irrigation may be necessary at the time of planting and during dry periods. Trees that are best suited and have good survival are Rocky Mt. juniper, eastern redcedar, ponderosa pine , Siberian elm, Russian olive and hackberry. In cropland areas , habitat favorable (I, for ring-necked pheasant, mourning doves and many non-game species can be developed by establishing wildlife areas for nesting and escape cover. For pheasants, the inclusion of undisturbed nesting cover is vital and should be included in plans for habitat development. Rangeland wildlife, exemplified by the pronghorn antelope, can be assisted and encouraged by development of livestock watering facilities , proper livestock grazing management, and range reseeding where needed. Almost all of this Ascalon soil is located away from major growth centers and urbanization. The shrink-swell potential of the subsoil as it wets and dries is the most limiting" soil feature that must be - --- - considered when planning the construction of homes and their appur- _ tenances , and roads.
