The Weld County Council met in regular session in full q ' ea, 9��'Z/
conformity with the Weld County Home Rule Charter at � '
9th Avenue and 9th Street, Greeley, Colorado, July 5,
1977 at the hour of nine o'clock.
ROLL CALL: The meeting began with an invocation by Nancy Clark, President.
The following members were present:

Also present: County Commissioners: Mr. Leonard Roe, Mr. Ed
Dunbar, Mr. Victor Jacobucci; Members of the Canvas Board:
Bette Kountz and Lauretta Gibson; County' Clerk 8 Recorder:
Mary Ann Feuerstein; Election Officer: Wanda Hughes; 6 members
of the press; and secretary, Bev Thomas.
MINUTES: The following corrections were made to the minutes of June 21,
1977: Bob Martin clarified that the expenditures that were
"under the estimated amount" on page 2 under FINANCES were for
special counsel. Also, the following sentence was corrected to
read: "Nancy stated that Mr. Dority had been hired by the County
Commissioners to be the finance officer." Bob White corrected
page 3 under OLD BUSINESS to read "an article from the Tribune".
Under NEW BUSINESS on page 3 Bob corrected a sentence to read:
"Bob White asked if the County Attorney had been contacted."
Bob Martin moved the minutes be adopted as corrected. Bob White
seconded the motion and it passed unanimously.
CORRESPONDENCE: Nancy said a letter had been hand-delivered to John
Martin requesting an investigation of the Planning Commission
and Planning Staff. She said this would be presented as New
Business.
Nancy stated that the County Commissioners were sending the
Council their agendas. She pointed out that these agendas list
a calendar of events and it would be a good practice for a copy
of them to be passed around at the Council meetings. She
further said the Commissioners had requested advance copies of
the Councils' meeting agendas.
REPORTS:
FINANCE: Nancy suggested the Council invite the new County Finance Officer,
Mr. Dority, to came to a Council meeting. Thereby Council members
could get to know him and to ask him what role he sees himself
playing in County government. Bob Martin said he might also give

the Council a detailed explanation of the workings of the IGA fund.
Ed Dunbar suggested Jack Shumaker, the Internal Auditor, would be
able to give a more specific explanation of the IGA fund. Bob White
made a motion that the Chairperson be instructed to schedule a meeting
with Mr. Dority and Mr. Shumaker in August. Bob Martin seconded
the motion and it passed unanimously.
OLD BUSINESS: Nancy introduced the topic of the Council's investigation into
the election process. She said that the Council had invited the
Canvas Board, who had gone through individual ballots from the last
election. Since the ballots had been disposed of in the manner
prescribed by law without the Council having access to them, the
Council wanted first hand information about them.
Both members of the Canvas Board agreed the ballots they had handled
were in good shape. They both sa id that they had no problems deter-
mining to whom any votes were to be credited. Bette Kountz said
that of the systems she had worked with the present system was the
most accurate. She stated further that the ballots that were hand-
counted agreed with the computer totals.
Mary Ann Feuerstein confirmed that at the next election there are to
be more precincts eliminating the possibility of crumpled ballots
resulting from overloaded ballot boxes.
Bob White said that having heard the report of the Canvas Board, he
felt the vote of the people had been properly managed. Nancy Clark
said she felt the Council had completed their investigation of the
concerns that had been expressed regarding the election process.
Floyd Oliver made a motion that the Council make a final and official
report to conclude the previous election report. John Martin seconded
the motion and it passed unanimously.
ROAD AND BRIDGE INVESTIGATION: Nancy told the Council that on June 29, 1977,
Mr. Woodroof had come to Greeley and devoted his day to the accounting
aspects of the investigation. Mr. Rood had met with Frank Smith, Betty
Rhoden, Chuck Lucio, and personnel in Road and Bridge. Mr. Woodroof
and Mr. Rood are ready to meet with the Council. It was arranged for
Mr. Woodroof and Mr. Rood to meet with the Council on July 19, 1977.
Ed Dunbar said that the Commissioners had been meeting with the
employees of the Road and Bridge Division without the foremen and
superintendents present. After the Commissioners meet with the
foremen and superintendents this week there will probably be a work
session to take some action on the information they have gathered.
BATY GRAVEL REMOVAL CASE: Nancy informed the Council a meeting had been
arranged on Tuesday, July 12, 1977 at 9 A.M. with Mr. Baty to determine
whether his case against the county had received due process. Mr. Baty
had been invited to bring whomever he wanted to the meeting with him.

LOUSTALET CONFLICT OF INTEREST: After a five minute recess the Council met
with Attorney Robert Ray. Nancy read a letter from Mr. Loustalet
stating his possible conflict of interest. She also read the
minutes of the meeting of the Council in which the Council had
decided Mr. Loustalet did not have a conflict of interest. The
Council members then presented to Mr. Ray the reasons behind their
decision that Mr. Loustalet did not have a conflict of interest.
It was determined that Mr. Ray would draw up a Loustalet resolution
for the Council to approve at their July 12, 1977 meeting.
John Martin made a motion that Mr. Ray also write a resolution
regarding the Council's change of meeting time. Robert Martin
seconded the motion and it was carried.
REQUEST FOR PLANNING COMMISSION INVESTIGATION: Nancy Clark read a letter
requesting an investigation of the Planning Commission and Planning
Staff from three citizens in Hudson, Colorado. John Martin, who
had been approached by one of the citizens relayed their concerns.
The citizens felt that they had been ignored by the Planning
Commission.
Ed Dunbar and press person Rick Thompson gave the Council their
interpretations of what had transpired thus far in this case. The
citizens' complaints are about odor from a manure processing plant.
Nancy felt that it was premature for the Council to get involved with
the matter until a final determination had been made by the Planning
Commission or the health boards involved. Other Council members felt
the citizens should have some sort of response from the Council now.
Bob White made a motion that the Council send a copy of the citizens'
letter to Gary Fortner and Glen Paul asking for a full report in the
matter. Then the Council could respond to the citizens. Floyd Oliver
seconded the motion and it carried. John Martin and Floyd Oliver were
instructed by Nancy Clark to prepare the letter and send a carbon copy
of it to the citizens involved.
There being no further business, the meeting was adjourned.
