WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for the Temporary Operation
of a Cell Site on Wheels in the A (Agricultural) Zone District, between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Department of Planning Services, and Viaero Wireless on property described as follows:
Being part of the SE1/4 NE1/4 of Section 15,
Township 3 North, Range 61 West of the 6th P.M.,
Weld County, Colorado.
WHEREAS, Viaero Wireless has requested to place a 35 -foot tall Cell Site on Wheels
(hereinafter "COW") on the property to help determine whether a permanent 35 -foot tower will be
adequate or whether they will need to seek a permit for a 70 -foot tower, and
WHEREAS, Section 23-4-805 of the Weld County Code defines "Telecommunication
Antenna Tower" as "Any structure that is designed and constructed primarily for the purpose of
supporting one (1) or more antennas." The County therefore believes that a "COW" is not a
structure and therefore is not considered a Telecommunication Antenna Tower, and
WHEREAS, Section 23-1-90 of the Weld County Codes defines "Structure" as "Anything that
is built, constructed or erected, an edifice or building of any kind, or any piece of work artificially built
up or composed of parts joined together in some definite manner, but not including piles, lines or
distribution facilities of public utilities." The County therefore believes that a "COW" is not a structure
and therefore is not considered a Telecommunications Antenna Tower, and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that an Agreement for Temporary Operation of a Cell Site on Wheels in the
A (Agricultural) Zone District between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Department of Planning Services,
and Viaero Wireless be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said agreement.

SUBJECT: Proposed Agreement to allow a Cellular Tower on Wheels
facility (COW) on a property for up to 6 months
Request: NE Colorado Cellular dba Viaero Wireless (Viaero) is requesting to place a Cellular
Tower on Wheels or (COW) facility on a parcel that they own in part of the SE4NE4 of Section
15, T3N, R61W (North of and adjacent to Interstate 76 and approximately 1 mile west of County
Road 95). Viaero wishes to temporarily place a tower at this site to do National Environmental
Policy Act (NEPA) studies prior to placing a 35 -foot permanent cellular tower on the site. Viaero
believes that the COW meets the definition of a "Structure" per Section 23-1-90 of the Weld
County Code and meets the definition of a "Telecommunication Tower, Attached" per Section
23-4-805 of the Weld County Code. Viaero has indicated that COWs were allowed on two
different occasions relating to the Cedar Creek Wind Farm USR (USR-1723) and the New
Raymer Viaero Cellular Tower Site (USR-1729).
Staff Determination:
Staff has reviewed the request and has determined that COWs are not allowed in the County
Code.
Section 23-4-805 of the Weld County Code defines "Telecommunication Antenna Tower" as
"Any structure that is designed and constructed primarily for the purpose of supporting one (1) or
more antennas". A COW is not considered a structure and therefore does not meet the definition
of a Telecommunication Antenna Tower.
Section 23-4-805 of the Weld County Code defines "Telecommunication Antenna, Attached" as
"An antenna mounted on an existing building, silo, smokestack, water tower, utility or power pole
or a support structure other than a Telecommunication Antenna Tower." A COW is not
considered a structure and therefore does not meet the definition of a Telecommunication
Antenna Tower.
Section 23-1-90 of the Weld County Code defines "Structure" as "Anything that is built,
constructed or erected, an edifice or building of any kind, or any piece of work artificially built up
or composed of parts joined together in some definite manner, but not including piles, lines or
distribution facilities of public utilities". A COW is not considered a structure and therefore is not
considered a Telecommunication Antenna Tower.

Staff has researched the records regarding the Cedar Creek Wind Farm site and the Viaero
Wireless site adjacent to New Raymer and could find nothing specific in regards to county
authorization of these requests. However, it should be noted that both of these sites were
associated with pending/permitted Special Use Permits (and permanent structures to be
constructed associated with these permits) whereas this site is currently not associated with a
county permit/process of any kind.
Staff Recommendation:
The COW is proposed be located on the site for a temporary period of time before a permanent
cellular can be built which complies with the definition of a Telecommunication Antenna Tower,
per the Weld County Code. Therefore, staff is recommending allowing the COW to remain on
the property for a period of up to 6 (six) months per the attached agreement between the County
and Viaero.

I wanted to take this opportunity to clarify any confusion that exists regarding Viaero's Wiggins Hill project.
Viaero has experienced coverage issues west of Wiggins Hill on 176 for a long time. This coverage issue has
manifested itself with many dropped calls both west and east bound on I76. In order to address this issue,
Viaero's engineers have recommended a cell site on Wiggins Hill to eliminate the problem.
Our research found that there was an unused parcel of land located on Wiggins Hill that was originally used by
Mountain States Telephone and Telegraph as a Microwave forwarding station. That site has since been
abandoned and the tower removed. The current owners, Century Link were willing to sell this parcel to Viaero,
and that sale has been completed. It is Viaero's intent to place a 35 foot cell tower on this parcel, which by Sec.
23-4-830 of the Weld County Code, is a Use by Right.
Until all of the NEPA studies are completed, Viaero would like to place one of its COWs (Cell Site on Wheels)
on the site. The tower would only be extended to 35 feet. Viaero believes that our COW falls under the
definition of a structure per the Wels County Code in Sec 23-1-90. We also believe that at a minimum this falls
under the definition of a Telecommunication Antenna Attached (Sec 23-4-805, and probably should be defined
as a Telecommunication Antenna Tower (Sec 23-4-805. A Cell Site on Wheels is a structure that is designed
and constructed primarily for the purpose of supporting one (1) or more antennas.
As a point of reference, Weld County has approved the placement of a COW on at least two occasions. The
first was on a request by the Cedar Creek Wind Farm to place a COW west of highway 71 in Weld County.
The second was the placement of a COW at our Raymer site after our permanent tower was approved.
The placement of the COW on Wiggins Hill will help Viaero to determine if we will need to seek a permit for a
70 foot tower or if the 35 foot tower will be adequate.
I hope this explains Viaero's plans for Wiggins Hill. I look forward to your response.

AGREEMENT BETWEEN WELD COUNTY, COLORADO. AND VIAERO WIRELESS
FOR THE TEMPORARY OPERATION OF A CELL SITE ON WHEELS
THIS AGREEMENT ("Agreement") is made and entered into this day of April,
2013, by and through the County of Weld, State of Colorado ("County"), acting through the
Weld County Board of Commissioners, and Northeast Colorado Cellular, Inc. dba Viaero
Wireless ("Viaero"), whose address is 1224 West Platte Avenue, Fort Morgan, CO 80701.
RECITALS
WHEREAS, Viaero, is the owner of real property described as Part of the SE4NE4 of
Section 15, T3N, R6 W of the 6th P.M., Weld County, CO (hereinafter "Property"); and
WHEREAS, Viaero, has requested to place a 35 -foot tall Cell Site on Wheels (hereinafter
"COW") on the Property to help Viaero determine whether a permanent 35 -foot will be adequate
or whether they will need to seek a permit for a 70 -foot tower, and
WHEREAS, Section 23-4-800 of the Weld County Code defines "Telecommunication
Antenna Tower" as "Any structure that is designed and constructed primarily for the purpose of
supporting one (1) or more antennas". The County therefore believes that a COW is not a
structure and therefore is not considered a Telecommunication Antenna Tower; and
WHEREAS, Section 23-1-90 of the Weld County Code defines "Structure" as "Anything
that is built, constructed or erected, an edifice or building of any kind, or any piece of work
artificially built up or composed of parts joined together in some definite manner, but not
including piles, lines or distribution facilities of public utilities". The County therefore believes
that a COW is not a structure and therefore is not considered a Telecommunication Antenna
Tower; and
WHEREAS, without waiving any rights with respect to the County's interpretation
regarding whether a COW is a Telecommunication Antenna Tower as set forth above, Viaero
desires to place a 35 -foot tall on the Property for a maximum of six (6) months as set forth
below.
NOW, THEREFORE, in consideration of the foregoing, County consents to allow a
COW to locate on the site in accordance with the following terms and conditions:
1. The above recitals are incorporated herein by reference.
2. The COW can stay on the property for a maximum of six (6) months beginning on the
date that this Agreement is executed by both parties. After this six (6) month period, the
COW shall be removed from the Property.
3. With the exception of the COW, no additional improvements shall occur until Viaero is
granted appropriate building permits and (if required) zoning permits.
4. Staging or parking trucks on the travel lanes of the public roads adjacent to the Property
is prohibited. Nuisance conditions, including, but not limited to, mud and puddles on
roads, are to be prevented and immediately addressed by Viaero, at Viaero's sole
expense, to the County's reasonable satisfaction.
5. Viaero shall be responsible, at Viaero's sole expense, for excavating, repairing, or
patching any damage resulting from ingress or egress to the Property from adjacent
roadways located in the County. The County shall be consulted prior to any work being
conducted on any County road. The type and method of repair will be determined by the
County and must be performed and completed to the County's reasonable satisfaction.
6. Failure by Viaero to adhere to the terms and conditions of this Agreement, as solely
determined by the County, may, at the County's sole discretion, result in the termination
of this Agreement. In the event this Agreement is so terminated, Viaero shall have
Fifteen (15) days to remove the COW and to return the Property to the condition it was in
prior to the execution of this Agreement. Failure to do so within the Fifteen (15) day
period may result in prosecution for violations of the Weld County Code.
