If ._ _ _____ __`+�1 i. �,.< - - - ; .0z.... r ., n I RESOLUTION WHEREAS, a public hearing was held on April 28, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Charter Gas Resources, c/o Industrial Gas Services, Inc. , 12 Lakeside Lane, Denver, Colorado, request- ing approval of site for the construction of a natural gas processing plant and supporting facilities on the following described property, to-wit: A parcel of land in the Southeast Quarter of the Southwest Quarter (SEaSW1) of Section 24, Township 2 North, Range 63 West of the 6th P. M. , Weld County, Colorado, and more particularly described as follows: Commencing at a point 30 feet North and 316 feet West of the South Quarter corner (Si- Cor) of said Section 24; thence Northerly 600 feet to a point which is 307 feet West of the East side of said South- east Quarter Southwest Quarter (SESW4) of Section 24; thence West parallel to the South side of said Southeast Quarter Southwest Quarter (SE3SW4) of Section 24 802 feet to a fence; thence South along said fence line to a point 30 feet North and 1118 feet West of the South Quarter corner of said Section 24; thence East parallel to and 30 feet North of the South side of said Southeast Quarter Southwest Quarter (SE4SW-) of Section 24 802 feet to the point of beginning, containing in all 11. 05 acres, more or less, and WHEREAS, the petitioner was present, being represented by Mr. Kerry Brittain, counsel for said petitioner, and WHEREAS, there was no opposition to the request of petitioner for the location of said natural gas processing plant and supporting facilities, and WHEREAS, said requested location for said natural gas processing plant and supporting facilities is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (2) of the Zoning Resolution of Weld County, said location for said natural gas processing plant and support- ing facilities may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Charter Gas Resources, c/o Industrial Gas Services, Inc. , 12 Lakeside Lane, Denver, Colorado, to locate a natural gas processing plant and supporting facilities on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect said construction of said natural gas processing plant and supporting facilities and that it shall have up to one year from date hereof to begin the construction VI r‘1 5c7 750434 of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That such natural gas processing plant and supporting facilities shall be limited to the items as shown on plans as submitted and attached hereto and made a part hereof by reference. 4. Subject to a suitable chain-link fence six feet high being erected along the front side of said premises, and a suitable hog or sheep wire fence with three strands of barbed wire fencing on top, with additional in-between wire stays, around the other three sides of said premises. 5. That all structures erected upon said premises be removed within one year from the time that said natural gas processing plant and supporting facilities cease to operate and are closed. 6. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Honn Zoning Administrator Gentlemen: By Resolution dated April 30, 1975 , the Weld County Board of County Commissioners granted Charter Gas Resources , Inc. a Special Use Permit for the construction of a natural gas pro- cessing plant. The Plot Plan (Sheet 2 of 3 in Application) under the ap- proved Special Use Permit provides for an area 100 feet by 100 feet for undesignated Gas Measurement Facilities . Due to the circuitous rerouting of the gas purchaser' s gas pipeline, it is necessary to relocate the Gas Measurement Facilities . It is proposed and requested, therefore, that Charter Gas Resources , Inc. be given permission to relocate and redefine the Gas Measurement Facility area as shown on the attached Roggen Gas Processing Plant Plot Plan. As depicted on the Plot Plan, a 50 feet by 100 feet area will be set aside for utilization by Colorado Interstate Gas Company for Residue Gas metering facilities . Exact utilization of this portion of site will be defined more completely by Colorado Interstate Gas Company. In addition to the Residue Gas metering facilities , it is proposed and requested that Charter Gas Resources , Inc. be given permission to utilize the additional 50 feet by 100 feet area for the location of a Residue Gas Booster Compressor. Dimensions of the subject building will be no greater than 30 feet by 30 feet and will conform to all County and State codes . All facilities located within the 100 feet by 100 feet area will be removed and the premises cleared upon permanent cessation of operations of the gas plant. This is in compliance with Paragraph 5 of the Resolution dated April 30 , 1975 , as well as the surface leases by which Charter Gas Resources , Inc. is bound "to leave the leased premises at the expiration of this term in as good a condition as the same were at the beginning of this tenancy". It is our feeling that erecting these facilities on the backside of the plant site will enhance the esthetic integrity of the gas plant. As originally proposed, the Gas Measurement Facilities area was located adjacent to County Road 18 . In all instances , the structures erected will be constructed in conformance with local building codes and any other applicable rules or regulations . Honn, Zoning Administrator Gentlemen: By Resolution dated April 30 , 1975, the Weld County Board of County Commissioners granted Charter Gas Resources Inc. a Special Use Permit for the construction of a natural gas processing plant. The Plot Plan (sheet 2 of 3 in Application) under the approved Special Use Permit provides for an area 100 feet by 200 feet for storage of construction, repair and maintenance pipe and material. However, through oversight, no provision was made on the Plot Plan for a structure on the storage area in which to safeguard the materials to be stored. It is proposed and requested, therefore, that Charter Gas Resources Inc. be given permission to erect a storage building on the site of the storage area. As proposed, the storage building will be basically the same in size and will be constructed of similar metalic material as the shop and office building already provided for on the Plot Plan. Storage Building Dear Tom: Enclosed is a drawing of the office and shop building to be erected by Charter Gas Resources Co. at the site of their natural gas processing plant. As I indicated to you on the phone last week, it is Charter' s desire to erect a storage building on the storage yard shown on the plot plan approved by the Weld County Board of County Commissioners. The storage building will be constructed of the same materials and will be of the same diminsions as the office and shop building shown on the drawing. By having duplicate buildings, we feel a uniformity of appearance will be achieved that will not affect the overall integrity of the gas plant. As proposed, the only external difference between the storage building and the office and shop building would be that the storage building will have no windows. The interior of the storage building will not be like the office and shop building. As you might expect, the storage building will be completely open with the possible exception of appropriate storage shelves or racks. I have noted the differences between the storage building and the office and shop building on the drawing itself. Application for Charter a cross section of the roadways and burn pits. We have accordingly revised Sheets 2 and 3 of 3 of the plot plan for the Roggen Gas Processing Plant and the development property. Please note that on Sheet 2 of 3, which is the plot plan, we have added a small storage area in the northeast corner of the yard proper. It appears that during construc- tion and perhaps also subsequent to construction there will need to be a small storage area such as this for pipe and small equipment. The pipe will be stored on racks no higher than 12 inches off of the ground and any equipment stored there will not exceed a height from ground level in excess of 4 feet. On drawing Sheet 3 of 3, which is the "planned unit development prop- erty", we have shown a cross section of the burn pit which is located on the plot plan and also we have shown a cross section of the road- way. A statement has been included below the roadway cross section having to do with securing approval of the County Engineer's office for road usage and the restoration of the roads to their original condition. Ten copies each of the above described maps are attached. It is intended that these will replace the copies we left with you at the time we filed the P.U.D. Application. PiEa note carefully any conditions of approval that may be written on your permit.. These conditions must be complied with in order for the permit to be valid. The original copy of this permit is on file in the office of the Division of Water Resources. AIditdonal_ copies may be obtained there for a fee of $0.50 per page. • Please note the expiration date of your permit carefully. This date may be extended for good cause shown to the issuing agency. This means that the permit shall expire and be of no force or effect unless your well has been drilled and the Well Completion Report (Form WRJ_26-72) has been completed, notarized and submitted by the driller to the Division of Water Resources prior to the expiration date of the permit. The enclosed Statement of Beneficial Use of Ground Water (Form WRJ-25-73) should be co:Ipleted, notarized and filed with the Division of Water Resources as soon as possible after the water from the well has been nut to beneficial use. Only when the water is actually being put to beneficial use can the right to the use of the water be perfected. In the event that two copies of the permit are enclosed, one of them should be given to the well driller you select. Your well must be drilled by a well drilling con- tractor and the pump installed by a pump installation contractor, both of whom must be licensed by the State of Colorado. One or both of these operations may be done by yourself only if you own and operate the equipment used. Any change in your mailing address or a change in the ownership of the well should be reported to the office of the Division of Water Resources as an Amendment of an existing Record (Form WRJ-25-73) . The fee for a change of record is $1.00. The following information, as well as the Table of Water Equivalents on the back side of the Statement of Beneficial Use of Ground Water are provided as an aid in completing that form. • The "maximum sustained pumping rate of the :ell." is the greatest stabilized pumping , rate of the well with the permanent equipment installed. The "pumping rate claimed hereby" is the pumping rate approved on your permit, or the maximum sustained pumping rate, whichever is less. This is the pumping rate for the normal operation of the well. Application In many instances where oil is found in the geological reservoirs in this area, there is also found a significant amount of gas. As the oil is being produced, the gas produced with the oil is wasted to the air unless it is gathered, processed and sold. If the ratio of gas to oil is found to be excessive it is unlawful to produce the oil without marketing the gas, thus much needed oil production is restricted. Many marginal economic oil wells will not be drilled in this area unless the gas can be marketed making it economically feasible to drill these wells. Therefore, in most instances the production of oil necessarily involves the treating and marketing of the associated gas and marketing of liquid hydrocarbons result- in; from processing the gas in a plant similar to that described herein to be constructed by Charter. In order to gather, compress, treat and process oil well gas for recovery of liquid hydrocarbons, Charter plans to install. an inte- grated gas processing plant on the acreage shown on Sheet 3 of 3 of the attached maps. A plot plan of equipment and related facil- ities are shown on Sheet 2 of 3 of the attached maps. Charter's proposed Roggen gas processing plant will be initially designed to handle all available oil well gas and/or gas well gas in the area, thus making this gas available for domestic and other uses; and at the same time manufacture for sale much needed propane, butane, gasoline and possibly ethane. , Weld County Planning Commission February 11, 1975 Page Two Major plant equipment will initially consist of three 1,000 H.P. gas compressors, refrigeration compressors, heat exchangers for cooling gas and liquid streams, processing towers to absorb and separate natural gas liquids from the wet gas, a heater which will provide heat for processing, and liquid storage facilities. Initially natural gas liquids manufactured will be hauled from the plant by truck, therefore truck loading facilities have been provided as shown on the plot plan. A minimum of air pollution can be expected from the exhausts of the natural gas powered gas compressors, refrigeration compressor and the nacural gas fired heaters. The only water discharged from this equipment will be in the form of a small volume of steam from the unit that removes water from the natural gas. Some noise levels will be produced by the compressors and to a lesser extent by the process air exchangers using electric motor driven fans. The nat- ural gas processing equipment will initially manufacture approxi- mately 40,000 gallons of liquid product per day. Therefore, four tanker truck loadings per day is anticipated. Some additional traffic can be expected from operation and maintenance personnel driving to and from the plant as tours of duty change. The plant will be adequately protected as to fire hazard through installation of 150# wheeled ansul fire extinguishers, and 30# ansul dry powder hand held extinguishers located strategically throughout the facility, in addition to automatic emergency shut down systems for high and low temperatures, and high and low pressures. There will be a minimum of one operator on duty for each eight hour shift. During the daylight tour there will be from two to five persons on duty. A combined plant office, storage room and workshop is planned. These are necessary to the efficient and economic operation of the entire facility. The office will include sanitary and drinking water facil- ities. All such facilities will drain to a 1,000 gallon septic tank utilizing a leaching field. These facilities will be installed and operated pursuant to rules, regulations, and approvals of the Weld County Health Department. Weld County Planning Commission February 11, 1975 Page Three Water for the aforementioned proposed sanitary and drinking water facilities should not exceed 3 acre feet per year. However, at the present time there is no water available from water distribution systems or other sources in the plant area. Therefore, we have applied to the Colorado Board of Water Resources for a permit to drill an ex- empt water well, the use of which will be limited to the proposed san- itary and drinking water facilities. The proposed equipment and related facilities, as well as the office, warehouse and shop, water well, and ingress and egress roads are shown on the plot plan, Sheet 2 of 3 of the attached maps. The County Engineer's office will be furnished all information relating to County road usage, grading and culvert specifications, and similar items of concern, and that office's approval obtained for same. Nothing contained in this Sub-Lease shall release Lessee from the obligation to perform and be bound by all the covenants and conditions contained in the Leases as to the Sublet Tract. -2- r 8. This Sub-Lease shall be subject to the terms and con- ditions of the Leases and shall automatically terminate on the termination, cancellation, or expiration of the Leases unless previously terminated between the Lessee and the Sublessee as hereinbefore provided. It is mutually agreed, however, that if, after the expiration of this Sub-Lease, the Sublessee shall remain in possession of the Sublet Tract and continue to pay rent without a written agreement as to such possession, then Sublessee shall be regarded as a tenant from month to month at a monthly rental, payable in advance, equivalent to the last month' s rent hereunder, and subject to all the terms and pro- visions of this Sub-Lease. 9 . Lessee warrants and represents to Sublessee that the Leases are in good standing and not in default, that all rents under the Leases as of the date hereof are fully paid, and that so long as the Sublessee complies with the terms of this Sub-Lease and the Leases, the Sublessee shall have free and quiet possession and enjoyment of the Sublet Tract free of all claims of the Lessee or persons claiming through or under the Lessee, 10. As to the Sublet Tract, Sublessee shall have the right at any time, at the expense of the Lessee, to take any action required of the Lessee under the Leases that Lessee fails to perform in a timely manner and that may be necessary to prevent a default under the terms of the Leases. 11. As to the Sublet Tract, in the event the Lessee shall have the right to proceed against, or to otherwise enforce any rights against the owners/lessors or any other party, under the Leases, due to the default of the Lessor or any other party, and Lessee fails, within a reasonable period after a written request by Sublessee, to enforce said rights , Sublessee shall have the right, whether in its own name or in the name of the Lessee, to enforce any rights of Lessee.
