RE: GRANT CHANGE OF ZONE FROM A-AGRICULTURAL DISTRICT TO C-COMMERCIAL
DISTRICT FOR HENRIETTA HAMMONS , ET AL, P.O. BOX 1098 , GREELEY,
COLORADO 80631.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld tounty, Colorado, and
WHEREAS, a public hearing was held on the 29th day of November,
1978 at 3: 00 o 'clock p.m. for the purpose of hearing the petition
of Henrietta Hammons, et al, P.O. Box 1098 , Greeley, Colorado 80631,
requesting a change of zone from A-Agricultural District to C-Com-
mercial District for the following described parcel of land, to-wit :
A tract of land situated in the Southwest Quarter
(SW4) of Section 29, T6N, R65W, of the 6th P.M.
and being more particularly described as follows:
Beginning at the Southwest Corner of said Section
29, and considering the South line of Section 29
to bear S 84° 43' 00" E, and with all other bearings
contained herein being relative thereto;
Thence S 84° 43' 00" E, a distance of 403.2 feet
to the True Point of Beginning:
Thence N 00° 23' 05" E, a distance of 1490.00 feet;
Thence S 07° 51' 20" E, along the westerly Right-of-
Way of U.S. Highway No. 85 a distance of 981.59 feet;
Thence S 06° 54'30" W, along the westerly Right-of-
Way of U.S. Highway No. 85 a distance of 399.00 feet;
Thence S 03° 20' 15" W, along the westerly Right-of-
Way of U.S. Highway No. 85, a distance of 129.90 feet;
Thence N 84° 43'00" W, along the South line of said
Section 29, a distance of 89.00 feet to the True
Point of Beginning.
Said tract of land contains 2.909 Acres more or less
and is intended to be that sane tract of land recorded
in Book 505 Reception No. 1427331 on file in the Weld
County Clerk and Recorder's Office; and reflects
adjustments made in the Legal Description of said
tract as a result of an actual boundary survey
completed in June of 1978.
WHEREAS, Section 8. 2 and 8 . 3 of the Weld County Zoning Reso-
lution authorizes the Board of County Commissioners to grant a
change of zone upon the showing by the petitioner of certain facts,
and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the request
of the petitioner and the recommendations of the Weld County Planning

Commission, and having been fully informed, is satisfied that the
request for re-zoning complies with the Weld County Comprehensive
Plan and the conditions set out in Section 8. 2 and 8 . 3 of the Weld
County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the petition of Henrietta
Hammons, et al, for a change of zone from A-Agricultural District
to C-Commercial District on the abovedescribed tract of land be,
and hereby is , granted.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission Recommendations
dated October 17, 1978 be, and hereby are, incorporated as the
findings of fact of the Board of County Commissioners in this
matter.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 29th day of
November, A.D. , 1978.

I hereby certify that pursuant to a notice dated October 23,
1978, duly published October 26, 1978 and November 16, 1978 in
the Johnstown Breeze, a public hearing was held on the request
of the Henrietta Hammons, Testamentary Trust, for a change of
zone from agricultural to commercial district. Fred Gibbs
presented the request to the Board and offered testamony to
substantiate the change of zone. No one in the audience
expressed opposition to the granting of the request. After
study, Commissioner Carlson made a motion to grant the change of
zone from agricultural to commercial district with the Planning
Commission's recommendations. Commissioner Jacobucci seconded
the motion and it carried unanimously. Commissioners Carlson,
Jacobucci, Roe and Steinmark were present for the hearing.

according to the requested classification, unsuitable for
the development which is proposed.
There are no other areas. in the Greeley agricultural
trade area that have the desirable features of this particular
tract of land, (1) location, (2) high traffic flow of agri-
cultural buyers from all directions coming to this particular
location, (3) adequate display and storage arra for new and
used irrigation equipment, and (4) means of accessability.
Present utilization of the site for commercial purposes with
a building constructed for this purpose is now located on
the site. The building now located on the premises would
provide adequate storage facilities for irrigation equipment.
The building now on the premises provides adequ-ate space for
service and repair of irrigation equipment.
6 . What -proof of evidence is available that the original
rezoning is faulty or that changing conditions in the area
justify rezoning at this time.
As indicated in the answer to other questions , the
property has been used continuously for commercial purposes
since approximately 1964 . It has never been rezoned from
agricultural to commercial zoning although the property in
question has been continuously used for commercial purposes .
The non-conforming status of use of the site for commercial
purposes has continued uninterrupted since 1964 .
7 . Please submit Economic ar other evidence that the
area covered by the petition, needs additional Commercial or
Business in the area. (To be answered on changes requested
for Business or Commercial) .
The contract price for the purchase of the above described
tract of land containing 2 . 8 acre's, more or less , is $50 , 000 . 00 ,
making the parcel in question economically unfeasible for
use as agricultural ground. The real estate along the
frontage area is not, in fact, agriculturally oriented but
is much more desirable for use as commercial acreage . The
cost peracre is in excess of $16 , 000. 00 , and thus is un-
realistic for crop production. There are no water rights
available for use on the property and the property cannot be
presently irrigated. The contour and shape of the tract of
land is not conducive to crop production or irrigation
purposes. A large commercial building is presently con-
structed on the property. The unit -is far too small to be
economically feasible as an agricultural unit. The -site in
question has been used in -a non-conforming use status for
commercial purposes since 1964 .
8 . Give some evidence of the proposed business or
commercial enterprises that are to locate in the requested
area and a tentative time schedule for construction. (To be
answered on Changquested for Business or Commercial) .
The proposed purchaser of the site in question is
presently engaged in the sale, service and storage of ir-
rigation r sprinkler equipment and the site in question will
be used for these purposes . Within a period of approximately
30 days from the date of granting of the rezoning it is
anticipated that the prospective purchaser will proceed to
utilize the site for sale , service and storage of irrigation
and sprinkler equipment and related agricultural sales
products. The size of the building located on the premises .
is 40 ' x 100 ' , which makes it a very desirable unit for

product. The property would be used for sale of irrigation
equipment. This type of useage is not presently allowed

Weld County Road 61
At its September 26th meeting the Planning Commission reviewed the
requested zone change and recommended that it had no objections .
The Commission did , however , express considerable concern for
congestion resulting from the irregularly shaped parcel' s only access
onto County Road 64 . It was noted that projected traffic volumes
on County Road 64 exceed current roadway width and that a history
of had accidents has been experienced at this intersection . Because
of the property ' s location at the entry to the City and between 11th
Avenue (arterial) , U . S . 85 (expressway) , and County Road 64 (major
arterial ) ; the Commission encourages that the property owner
investigate the potential of developing future access off of 11th
Avenue .

We have reviewed the application from Greeley National Bank/Henrietta C.
Hammons, Trustees , for a change of zone from Agricultural to Commercial . We
find no conflicts with our interests, but we do bring to your attention that
no access to this property can be obtained from State Highway 85, since it is
access-controlled.
We would note that we have had a history of bad accidents experienced at
the Mumper Hill/U.S. 85/U.S. 85 Bypass intersections in this area. We request
that there would be no improvements , advertising devices. or storage of equip-
ment that would create further confusion or limit sight distances in this area.
