WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of land,
being the property of Robert A. Houtchens, 3765 South Jersey Street,
Denver, Colorado, and more particularly described as follows:
First Replat of GRANDVIEW HIGHLAND ESTATES,
Lot 30, being a part of the Northwest Quarter (NW-41-)
of Section 34, Township 2 North, Range 68 West of
the 6th P.M. , Weld County, Colorado,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has studied the request of the petitioner and
studied the recommendations of the Weld County Planning Commission,
and having been fully informed, now desires to exempt this particular
division of land pursuant to its authority under CRS 106-2-33 (d), 1963,
as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by Robert A. Houtchens, 3765 South Jersey
Street, Denver, Colorado, be exempted from the definition of the terms
"subdivision" and "subdivided land" as provided for in the new Weld County
Subdivision Regulations at Section 2-1, A. , (3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion du male and

Be it Resolved by the Weld County Planning Commission that the

Commissioners for the following reasons : (1 ) Does not conform to the
Comprehensive Plan under Urban Development-Residential (pages 59-60 September
1973 printing), in that the development is not closely connected to and served
by municipal services. The allowance of this type of development would add to
what is called urban sprawl in the Comprehensive Plan; (2) Does not comply with
Section 6-4A(1 ) (a) , page 34 of the Weld County Subdivision Regulations in as
much as the land split would not conform to agricultural zone minimum lot size;
and (3) does not comply with Section 6-4(1 ) (d), page 35 of the Weld County Sub-
division Regulations in as much as the proposed split would increase density
beyond that which was originally approved. However, take into consideration the
human elements such as: The possibility of a variance for a lot size; the time
element (would have been allowed when originally done in 1966 under old subdi—
vision regulations); attributes of what would happen to the property if it is
denied; and the possibility of a zone change.

Dear Mr. Adams:
Enclosed please find a replat of Lot #30 of
GRANDVIEW HIGHLAND ESTATES.
To reconstruct what happened is this: At the
Planning Commission Office I was told by Er. Laurenson
in May of 1971 that it was OK to split #30 in half if
I allowed a 180 foot frontage on the road. On : this
authority I sold the East one/half to Dorothy and
David Hodge on 26 June 1971 , and the 'West half to
Rockford Russel on 19 June 1971, however I did not
understand at that time that it was necessary to
file a replat of Lot 30.
I don' t know the history of the resale but the
present owner of the East half has a letter from your
office saying they could obtain a building permit
since the division of the Last and 'rest half of Lot 30
was now of record.
Both owners have drilled wells and the owner of
the west half, Mr. 4iilliam Burg has a Capp Home ordered .
I will be very willing to attend the Planning
Commission meeting if it will help to straighten out
this situation in any way.

I have reviewed the request for replat and subdivision of
the above lot .
The attached plat calls for a 10 foot easement lines along
all of the lot lines . I assume that means there will he a
20 foot wide easement between the proposed Tract A and Tract B.
I feel that the 20 foot easement line between these 2 proposed
tracts will be necessary to accomodate any existing or future
utilities . I intend to bring up this proposed easement at
the next Utility Board Meeting which will be held on January
30 , 1975 .
The owners of these tracts should state where their access should
be and they should only be allowed one access per lot to the
public Right of Way .
