RESOLUTION
WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of land,
being the property of Ray Emry and Vera Emry, Ault, Colorado, and
more particularly described as follows, to-wit:
The Southwest Quarter (SW4) of Section 16,
Township 7 North, Range 66 West of the 6th
P.M., Weld County, Colorado, being more
particularly described as follows:
Beginning at the Southwest Corner (SW Cor)
of said Section 16 and considering the West
line of the Southwest Quarter (SW 4) of said
Section 16, as bearing North 00°00'00" West,
with all other bearings contained herein re-
lative thereto;
Thence North 00°00'00" West, along the West
Line of the Southwest Quarter (SW4) of said
Section 16, 2661. 68 feet to the West Quarter
Corner (WI Cor) of said Section 16;
Thence North 89°18'24" East, along the North
line of the Southwest Quarter (SW4) of said
Section 16, 2660. 31 feet to the Center of said
Section 16;
Thence South 00°04'44" East, along the East
line of the Southwest Quarter (SW4) of said
Section 16, 2660. 45 feet to the South Quarter
Corner (Si Cor) of said Section 16;
Thence South 89°16'52" West, along the South
line of the Southwest Quarter (SW4) of said
Section 16, 2663. 98 feet to the Southwest
Corner (SW Cor) of said Section 16, said point
being the Point of Beginning;
Said described parcel of land contains 162. 619
Acres, more or less, including a strip of ground
30 feet in width along the West and South lines of
the Southwest Quarter (SW4) of said Section 16,
reserved for County Road Right-of-Way purposes
and is subject to and rights-of-way or other ease-
ments as recorded by instruments of record or
as now existing on said parcel of land,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHERAS, the Board of County Commissioners of the County of
Weld, State of Colorado, desires to exempt this particular division of
land upon the recommendation of the Weld County Planning Director for
the reasons as stated and pursuant to its authority under CRS 106-2-33
(d), 1963, as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by Ray Emry and Vera Emry, Ault, Colorado,

be exempt from the terms "subdivision" and "subdivided land" as provided
for in the new Weld County Subdivision Regulations at Section 2-1, A. , (3)
adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 15th day of January, A. D. ,
1975.

Dear Sirs:
The enclosed plat, application, and other material are in reference to
a request, by Ray and Vera Emry, for a recorded exemption. The parcel in
question contains 162.619 acres more or less, and they desire to split
approximately 2 acres with improvements from the property.
Based upon the information submitted and Weld County Regulations, the staff
recommends approval for the following reasons:
1 . The proposed land split conforms to the Weld County Comprehensive Plan
in that it promotes the use of agricultural land.
2. The proposed division complies with the intent of recorded exemption,
Section 9-2, of the Weld County Subdivision Regulations which is defined
as "a means whereby non-productive agricultural lands may be developed
for higher or more productive uses, in-so-far as such uses are compatible
with surrounding agricultural uses in areas where such land divisions are
proposed".
