HomeMy WebLinkAbout750422.tiff RESOLUTION WHEREAS, it has been determined by the Board of County Commis- sioners, Weld County, Colorado, that Ira E. Bone and Elsa Bone of Weld County, Colorado, are the owners of a parcel of land described as follows: All that part of the Northeast Quarter (NE4) of the Northeast Quarter (NE1) of Section six (6), in Township two (2) North, Range 67 West of the 6th P. M., Weld County, Colorado and lying East and South of the Union Pacific Railroad right of way, and WHEREAS, the Bones are desirous of selling the South two (2) acres of this parcel of land, and keeping the balance unto themselves, and WHEREAS, it appears that to accomplish said sale, the Bones may apply for a Recorded Exemption from the Subdivision Regulations of Weld County, as the same is defined in Section 9-4 of the Weld County Subdivision Regulations, and WHEREAS, in addition to evidence presented by the Bones, the Weld County Planning Commission staff has presented evidence and made represen- tations concerning the desirability of granting said variance, and WHEREAS, the Board of County Commissioners feels that when all the evidence and representations are considered, good cause for granting said variance of up to 2 acres, more or less, from the minimum lot size requirements of the Weld County Zoning Resolution has been shown. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the powers granted to the County under Chapter 106 CRS 1963 and Section 9-4.A (6), Weld County Subdivision Regulations as amended; that Ira E. Bone and Elsa Bone are granted a variance of 2 acres, more or less, from the lot size requirements of the Weld County Zoning Resolution. BE IT FURTHER RESOLVED, that this variance is allowed so that Ira E. Bone and Elsa Bone may proceed to apply for a Recorded Exemption and the lot size variance is conditioned on Ira E. Bone and Elsa Bone apply- ing for and doing all necessary to obtain said Recorded Exemption within 1 year, and said variance is limited to Ira E. Bone and Elsa Bone, and will terminate if they sell or otherwise discontinue their interest in the above mentioned Recorded Exemption. Dated this 11th day of June, A. D. , 1975. M. , Weld County, Colorado. The parcel contains approximately five (5) acres and the desire is to split two acres from the south end. The letter of request submitted by the persons desiring to buy the two acres'states they currently farm lease some 400 acres in the area and manage the turkey farm immediately to the south. Based on the information submitted and Weld County Regulations, the Planning staff recommends approval for the following reasons: 1 . The proposed split conforms with the Weld County Comprehensive Plan in that the use would promote agricultural use and would not be incompatible with surrounding uses. 2. The proposed split complies with the intent clause, Section 9-2, of the Weld County Subdivision Regulations in that non-productive lands are being utilitzed for a higher and better use. 3.
