RE: APPROVAL OF RECORDED EXEMPTION NO. 327 - VIRGINIA M. LESH.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 19th day of June, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the plat
known as Recorded Exemption number 327, being the property of
Virginia M. Lesh, described as Lots One and Two in the South Half
of the Northeast Quarter of Section 6 , Township 8 North, Range 66
West of the 6th P.M. , Weld County, Colorado, being more particularly
described as follows :
Lots One (1) and (2) , and the South Half (S1) of the
Northeast Quarter (NF.%d) of Section six (6) , Township Eight
(8) North, Range Sixty-six (66) West of the Sixth (6th)
P.M. , also known as the Northeast Quarter (NE4) of Section
Six (6) , Township Eight (8) North, Range Sixty-six (66)
west of the Sixth (6th) P.M., Weld County, Colorado.
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A (3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Virginia M. Lesh, be and hereby is, exempt
from the definition of the terms "subdivision" and "subdivided land"

RE: Recorded Exemption #327
Dear Commissioners :
The attached application , plat and related items are in reference to a request
by Virginia Markham Lesh for a recorded exemption. The property on which the
recorded exemption has been requested is described as Lots One (1) and Two
(2) in the SI of the NE* of Section 6, T8N, R66W of the 6th p.m. , also known
as the NE* of Section 6 , TBN, R66W of the 6th p.m. , Weld County, Colorado.
This property is located one mile west of the incorporated limits of the
Town of Nunn. The property contains approximately 144 acres of non-irrigated
land with Class II through VII non-irrigated soils. The request is to split
the property into parcels of two acres and 142 acres.
Mrs. Lesh desires to sell the two acre parcel which presently has an existing
residence and other improvements located on it . The balance of the property
is in agricultural use (dryland farming) and has no improvements located on it
On i,4ovember 14, 1977, the Board of County Commissioners approved a request
by Virginia Lesh for a Lot Size Variance subject to a proper sewer system
being installed prior to the time a recorded exemption application was made.
Mrs. Lesh has accomplished this.
Based upon the information submitted and the adopted policies in the county,
the Department of Planning Services staff recommends the request be approved
for the following reasons :
1. The proposed split conforms with the intent clause of the recorded exemp-
tion procedure (Section 9-2 of the Weld County Subdivision Regulations) ,
the intent clause of the Agricultural District (Section 3. 3 A. of the Weld
County Zoning Resolution ) , and the Weld County Comprehensive Plan since
the use would be compatible to surrounding agricultural uses. Agriculture
will continue to be the predominant land use.

2. The Nunn Town Board of Trustees has indicated they have no objections
to this request .
3. The request complies with the provisions of Section 9-4 (A) of the
Weld County Subdivision Regulations .

Dear Mr. Fortner:
The deficiencies, noted by the Weld County Health Department of
Environmental Services, in the Lot Size Variance request for the Virginia
Lesh property, located in the NE1, Section 6, T8N, R66W, have been corrected
as follows:
1. Water well pump was made operable and water samples
from that supply have been found to be bacteriologically
safe.
2. A septic system was completed March 30, 1978 which complied
with Weld County Health Department regulations. A 750
gallon tank with 150 square feet of leach area was installed.
