Dear Sir or Madam,
Coors Energy Company has filed an application for a Phase I bond release work completed at the
Keenesburg Mine with the Colorado Division of Reclamation Mining and Safety (DRMS, permit
C-1981-028) in accordance with the approved reclamation plan. The Phase I bond release
application requests release of bond and liability for successfully completing backfilling and
grading in Areas 30, 31, and 32 encompassing approximately 27.1 acres within the mine site.
These areas are located within Section 25 of Township 3 North, Range 64 West of the 6th
Principal Meridian, Weld County, Colorado. The permit area is located seven miles north of
Keenesburg Colorado and is accessed by Weld County Road 59.
As required by Colorado law,whenever bond release is requested, all interested or affected
parties with a valid legal interest must be notified and afforded the opportunity to comment or
request an informal conference on the bond release in accordance with Rule 3.03.2(3)of the
Regulations of the Colorado Mined Land Reclamation Board for Coal Mining.
This letter will serve to notify you that Coors Energy Company is requesting Phase I liability and
bond release in the amount of$321,794 of the total calculated current reclamation bond amount
of$1,971,874. A copy of the entire bond release application will be on file for public review at
the DRMS (1313 Sherman St, Room 215, Denver, CO 80203),the Weld County Clerk and
Recorder's Office (1402 N 17th Ave, Greeley, CO 80631), the Keenesburg Town Hall in
Keenesburg, CO during the review period. All information pertinent to the bond release request
is presented within this application.

Legal Description of the Area Requested for Bond Release: The Phase I bond release
application requests release of bond and liability for successfully completing grading and drainage
Icontrol tasks in Areas 30, 31, and 32 within the Keenesburg Mine site. These areas are located in
portions of Section 25, Township 3N, Range 64W, Sixth Principal Meridian, Weld County,
Colorado. The total area is approximately 27.1 acres.
I Map: The attached map identifies the areas requested for Phase I bond release as well as the
permit boundary and bond release status of other areas within the permit boundary.
I Dates of Reclamation Work: Area 30 was graded, topsoiled, and seeded in the fall of 2006. Area
31 was graded, topsoiled, and seeded in the fall of 2009. Final grading of Area 32 was just
completed in November 2013.
I Description of Bond Release Amount Request: This Phase I bond release request is for Areas
30, 31, and 32 which have been successfully backfilled and graded. The revised DRMS
I I reclamation cost estimate prepared in March 2014 as a line item for"Backfill B-Pit Parcels 30, 31,
and 32" equals $321,794.07. Coors Energy Company is requesting the release of this full amount.
Notice to Parties Identified in Rule 3.03.2(1): Notification letters were posted via certified
I mail after receipt of DRMS approval of the notification letter content to the entities included in
Section 2.03.4 (7) of the DRMS Reclamation Permit (notification letter and certified mail receipts
are attached). A copy of the letters to the Weld County Clerk and Recorder and the Town of
I Keenesburg, requesting retention of a public copy of bond release application are also attached.
Newspaper Advertisement: A copy of the newspaper advertisement being published in the Fort
Lupton Press is attached. An affidavit of publication will be submitted after the four-week running
Iperiod.

PUBLIC NOTICE
' Coors Energy Company (PO Box 467, Golden, CO 80402) has filed an application for a Phase I
bond release work completed at the Keenesburg Mine with the Colorado Division of
• Reclamation Mining and Safety(DRMS, permit C-1981-028, approved November 3, 1981). The
Phase I bond release application requests release of bond and liability for successfully
completing backfilling and grading in Areas 30, 31, and 32 within the mine site. Backfilling and
' grading in these areas took place in 2006, 2009, and 2013, respectively and has been shown to
meet the approved post-mining topography for the site. Phase I bond release is sought for
approximately 27.1 acres at the site. The current bond is a corporate surety calculated at
' $1,971,874 prior to the proposed release and the amount requested for release is $321,794. The
areas proposed are located within Section 25, Township 3 North, Range 64 West of the Sixth
Principal Meridian, Weld County, CO. Coors Energy Company is the surface owner of the
' property for which bond release in being requested. The permit area is located 7 miles north of
Keenesburg, CO and is accessed by Weld County Road 59. A copy of the bond release
application is available for public review at the Weld County Clerk and Recorder's Office (1402
' N 17th Ave, Greeley, CO 80631), the Keenesburg Town Hall, and at the DRMS (1313 Sherman
St, Room 215, Denver, CO 80203). In accordance with Rule 3.03.2(3) any person with a valid
' legal interest which might be adversely affected by release of the bond, or any federal, state, or
local governmental agency with jurisdiction over regulated activities at the mine shall have the
right to file written objections to or comments upon the requested release and/or file a request for
' an informal conference with the DRMS within thirty(30) days of the last publication of this
notice, or within thirty(30) days of the completed bond release inspection to be conducted by the
DRMS whichever is later. All comments, objections, and requests must be submitted in writing
' to the DRMS at the above address.

Introduction
This document is the proposed decision of the Colorado Division of Reclamation, Mining and Safety (the
Division)for Surety Increase No. 1 (SI1) at the Keenesburg Strip Mine, Division file number Permit No. C-
1981-028. The package contains three parts. These include: 1) procedures and summary of the bond
increase process; 2) observations and findings of the Division regarding compliance with the performance
bond requirements of the Colorado Surface Coal Mining and Reclamation Act (Act) and regulations
promulgated thereunder;and 3)the Division's proposed decision on the surety increase.
Detailed information about the review process can be found in the Act and the Regulations of the Colorado
Mined Land Reclamation Board for Coal Mining (Rules). All Rules refc.enced within this document are
contained within the Regulations. Detailed information about the mining and reclamation operations can be
found in the permit application on file at the Division offices, located at 1313 Sherman Street,Room 215, in
Denver,Colorado.
The Keenesburg Strip Mine is a Surface Mine which is permitted and operated by Coors Energy Company.
The ownership of the land for which bond increase has been proposed is Private, and the coal ownership is
State and Private.
L PROCEDURES AND SUMMARY OF THE INCREASE PROCESS
The Division has initiated this surety increase in order to ensure compliance with Rule 3.02.1,which requires
a performance bond for all requirements of the Act, Rules, and the approved reclamation plan. Rule
3.02.1(3)requires the performance bond to cover land within the permit area upon which surface coal mining
and reclamation operations are to be initiated and conducted, Rule 3.02.1(4) states that liability of the
performance bond shall continue until the entire reclamation plan has been completed.
Rule 3.02.2(4) requires the Division to adjust the required performance bond as affected land acreages are
increased or decreased or when the cost of future reclamation changes. Procedures for adjustment of the
required performance bond include:
(a) Notification of the permittee of any proposed bond adjustment, providing the permittee with an
opportunity for an informal conference on the adjustment;
(b) Issuance of a written proposed decision by the Division to adjust the bond amount, publication of
notice of the proposed decision in a newspaper of general circulation in the locality of the mining
operation once a week for two weeks following issuance of the decision, and notification of the
permittee the surety and any person with a property interest in the collateral who has requested
notification;and
(c) An opportunity for a formal hearing pursuant to Rule 2.07.4(3);
IL OBSERVATIONS AND FINDINGS
Prior to Permit Renewal No. 6 (RN6) the reclamation bond held for the site was $2,001,475.00. In
September of 2011; during the review of RN6, the Division recalculated the financial liability amount and
found it to be $1,913,161.94. The actual financial warranty held was never reduced to that amount. During
the review of the SL6 bond release application which was approved in January of 2012, the Division
approved CEC request to release liability in the amount of$63,799.00. CEC reduced their financial warranty
to $1,937,676.00 ($2,001,475.00 minus $63,799.00). However, the Division re-evaluated the reclamation
liability during SL6 and found the required liability amount to be $1,868,426.16. CEC did not reduce their
liability to the required amount subsequent to the approval of SL6.
During Midterm Review No. 6 (MT6), in accordance with Rule 3.02.2(4) the Division has reviewed the
adequacy of the reclamation bonding instruments and we have also reviewed the adequacy of the reclamation
cost estimate. There is currently a Corporate Surety in place for the Keenesburg Strip Mine in the amount of
$1,937,676.00. The Division calculated a new reclamation cost estimate taking into account the remaining
tasks to be completed that have not been released through the phased bond release process. The Division
estimated the reclamation cost to be $1,971,874.00 which is $34,198.00 more than the current bond held and
is $103,447.84 more than the required liability calculated during the review of SL6. Enclosed with this
document is a copy of the Division's estimate from MT6.
Costs for pit backfilling/grading, road ripping/grading, topsoil application, structure demolition, and
equipment mobilization and demobilization increased from the previous liability estimate. The costs for site
maintenance,water monitoring,and revegetation decreased from the previous liability estimate. An increase
in equipment costs can be attributed to some of the liability increase. However, the majority of the cost
increase can be attributed to task A02 which accounts for backfilling and grading parcels of B Pit that have
not received Phase 1 bond release. Based on these parcels acreages(Parcels 30,31 and 32) and the depth of
spoil required to be placed on these parcels the volume used to estimate the cost of this task was calculated.
The previous cost estimate completed for RN6 and SL6 included a cost for this task however the volume used
was found to be insufficient.
Also, the Division added additional tasks C04 and C05 to finish grade the internal roads and access road.
Topsoiling cost increased based on a new estimate of volume needed for the B-Pit area. A new task was
added to address topsoil application on Parcel 25 which has not been granted Phase II bond release. The unit
costs for structural demolition also increased. Mobilization and Demobilization costs were re-evaluated,
loading and unloading times for non-roadable equipment was increased from the RN6 and SL6 estimate to
address the added cost the Division would incur to assemble and disassemble the equipment needed to
conduct reclamation.
Please see the enclosed cost estimate for details of these costs.
