HomeMy WebLinkAbout790385.tiff RESOLUTION RE: APPROVAL OF AGREEMENT BETWEEN WELD COUNTY, COLORADO AND THE WELD COUNTY HUMANE SOCIETY. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Weld County Humane Society has established and is maintaining a shelter and impoundment facilities for dogs which may be picked up in accordance with the Weld County Resolution regarding the regulating of and running at-large of dogs , and WHEREAS, said Society has personnel who are experienced in the apprehension, care and disposal of dogs , and WHEREAS , an agreement between Weld County and the Weld County Humane Society for enforcing the running at-large of dogs, providing for seizure, impoundment and other disposition thereof , has been presented to the Board of County Commissioners . A copy of said agreement is attached hereto and incorporated herein by reference, and WHEREAS , for said services provided by the Weld County Humane Society, Weld County agrees to pay the Society $3 , 000 . 00 per month, effective with the month of January, 1979 , and WHEREAS , the Board of County Commissioners deems it advisable and in the best interests of Weld County, Colorado to approve said agreement. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Weld County, Colorado that the agreement between Weld County and the Weld County Humane Society be, and hereby is , approved. The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 7th day of March, A.D. , 1979, nunc pro tunc, January 1, 1979. WITNESSETH: WHEREAS, the Society has established and is maintaining a shelter and impoundment facilities for dogs which may be picked up in accordance with the Weld County Resolution regarding the regu- lating of and running at-large of dogs, and WHEREAS, the Society has personnel who are experienced in the apprehension, care and disposal of dogs, and WHEREAS, it is deemed desirous by the County that the Society perform the services mentioned in this agreement. IT IS ACCORDINGLY AGREED and understood that in consideration of the payments to be made by the County as hereinafter provided, the Society will carry out its agreements as stipulated and perform the services hereinafter mentioned. 1. The County will pay the Society as follows : a. For services rendered for the year 1979, the sum of Three Thousand Dollars ($3, 000. 00) per month, effec- tive with the month of January, 1979. 2. The Society shall be responsible for enforcing the Weld County Resolution regulating the running at large of dogs, providing for seizure, impoundment and other disposition thereof. A copy of which is attached hereto and incorpo- rated herein by reference. 3. It is recognized by the Society and the County that said $3, 000. 00 per month will not be sufficient to provide for the enforcement of all possible violations within Weld County. It is thereby agreed between the Society and the County that the following priorities for service shall apply in the following order: a. Vicious dogs b. Dogs attacking agricultural livestock c. Dogs running at-large within unincorporated towns or within a two (2) mile radius of incorporated towns d. Dogs running at-large within or adjacent to rural subdivisions e. Dogs running at-large in rural areas 4. The Society shall provide a quarterly report to the County. The report shall indicate, as a minimum, the following: a. The number of dogs picked up in Weld County listed separately for each item (a-e) under Paragraph 3 above and by approximate location (i.e. town, etc. ) . 5. All dogs picked up or apprehended by the Society shall be impounded at the shelter and facilities of the Society and processed pursuant to said Resolution. In the event that the dog-control Resolution referred to herein shall be repealed or cease to be effective by operation of law, it is mutually agreed by the parties that this Agreement shall automatically terminate. 6. The Society and its personnel will, to the best of their ability, enforce the dog-control Resolution, will abide and conform to said Resolution and shall be entitled to retain, to the use of the Society, all impounding or boarding fees. 7. The parties acknowledge their intention that this agree- ment shall place the Society in the category of an inde- pendent contractor and not as an agent or employee of the County, and as such, the Society and its employees will not represent to the public that the Society or its employees are agents or employees of the County. In addition, the Society will indemnify the County from and against all claims by Society employees such as workman' s compensation benefits, and employment benefits, and the like. 8. The term of this agreement shall be from January 1, 1979 through December 31, 1979. Either party may terminate this agreement at an earlier date by providing written notice to the other party thirty (30) days in advance. THIS AGREEMENT executed the day and year first above written.
