HomeMy WebLinkAbout20143597.tiff HEARING CERTIFICATION DOCKET NO. 2014-93 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR14-0053, FOR A MINERAL RESOURCE DEVELOPMENT FACILITY INCLUDING AN OIL AND GAS SUPPORT AND SERVICE FACILITY (WATER DEPOT) IN THE A (AGRICULTURAL)ZONE DISTRICT- EQUUS FARMS, LLC A public hearing was conducted on November 26, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia - EXCUSED Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman Public Works representative, Wayne Howard Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated October 17, 2014, and duly published October 22, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Equus Farms, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0053, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (water depot) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. El Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. This will be an unmanned water depot with a six-valve station, which will operate 24/7. There are an estimated 40 truck trips per day coming north from U.S. Highway 34. The footprint is a 10.4-acre area on a 100-acre parcel, and is outside the floodplain areas of the parcel. The nearest residence is 1/2 mile to the south, and is on property owned by the applicant. He said they have a well approved for 164-acre feet per year. He showed images of the site and the facility layout. 19 Wayne Howard, Department of Public Works, provided a brief overview of the transportation plans and requirements. He stated the applicant was asked to delineate an additional ten feet, increasing the right-of-way from 60 to 80 feet. There will be an Offsite Improvements and Maintenance Agreement, a grading permit has been granted, and a Drainage Report has been accepted by County engineering staff. Ei Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. Portable toilets are adequate and there is a Waste Handling Plan. ID In response to Commissioner Conway, Mr. Howard stated he doesn't have pictures of the intersection in question or an ADT available for U.S. Highway 34 from CDOT. El Sherri Jones, Vista Engineering, represented the applicant. She stated she has not seen the emails from CDOT regarding traffic triggers, and if 40 tri s per day trigger a Maintenance Agreement they would prefer to reduce their number of trips. PJ In response to Commissioner Conway, Ms. Jones said they are unsure what the ratio is going to be, but they hope to have more 'fastlines' and less trucks. El Mike Johnson,Vista Engineering, explained the haul route and the lanes in detail for the Commissioners. He said there are enough wells being drilled on their side of the highway, so primarily their goal is to supply those wells and keep to the south. There was further discussion regarding traffic. He stated they are also tired of truck traffic; they have done one fastline system and they are hoping to get to a point where no water trucks are needed at all. IC No public testimony was offered concerning this matter. .El John Finegan, Equus Farms, stated he had no issues with the Development Standards or Conditions of Approval. II Mr. Gathman said he had a clarification on Condition of Approval #1.C.6, which needs the access permit number listed — AP14-00396. He said Development Standards #20 and #21 were removed by the Board in a previous (unrelated) hearing as redundant, and he asked if they would like to do that in this case, which was affirmed, and the last two sentences in Development Standard #22 were also deleted by assent of the Board. IlE1 In response to Commissioner Kirkmeyer, Ms. Light stated that Development Standard#11 is standard for water depots, water may infiltrate into the ground, but polluted water may not infiltrate surface water. Commissioner Kirkmeyer stated there is no surface water there so it isn't really an issue. Ms. Light noted the site is located next to a flood plain. Commissioner Kirkmeyer suggested deletion; done by assent of the Board. El In response to Chair Rademacher, Mr. Finegan, indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. ID Commissioner Kirkmeyer moved to approve the request of Equus Farms, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0053, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (water depot) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously. 2014-3597 PL2309 HEARING CERTIFICATION - EQUUS FARMS, LLC (USR14-0053) PAGE 3 There being no further discussion, the hearing was completed at 10:29 a.m. This Certification was approved on the 1st day of December, 2014.
